Artículo 41 - Derecho a una buena administración

1. Toda persona tiene derecho a que las instituciones, órganos y organismos de la Unión traten sus asuntos imparcial y equitativamente y dentro de un plazo razonable. 2. Este derecho incluye en particular: a) el derecho de toda persona a ser oída antes de que se tome en contra suya una medida individual que la afecte desfavorablemente; b) el derecho de toda persona a acceder al expediente que le concierna, dentro del respeto de los intereses legítimos de la confidencialidad y del secreto profesional y comercial; c) la obligación que incumbe a la administración de motivar sus decisiones. 3. Toda persona tiene derecho a la reparación por la Unión de los daños causados por sus instituciones o sus agentes en el ejercicio de sus funciones, de conformidad con los principios generales comunes a los Derechos de los Estados miembros. 4. Toda persona podrá dirigirse a las instituciones de la Unión en una de las lenguas de los Tratados y deberá recibir una contestación en esa misma lengua.

      El artículo 41 se basa en la existencia de la Unión como una comunidad de Derecho, cuyas características ha desarrollado la jurisprudencia, que consagró, entre otras cosas, la buena administración como un principio general de Derecho (véase, entre otras, la sentencia del Tribunal de Justicia de 31 de marzo de 1992, C-255/90 P, Burban, Rec. 1992, p. I-2253; así como las sentencias del Tribunal de Primera Instancia de 18 de septiembre de 1995, T-167/94, Nölle, Rec. 1995, p. II-2589; de 9 de julio de 1999, T-231/97, New Europe Consulting y otros, Rec. 1999. p. II-2403). Las manifestaciones de este derecho enunciadas en los dos primeros apartados se derivan de la jurisprudencia (sentencias del Tribunal de Justicia de 15 de octubre de 1987, asunto 222/86, Heylens, Rec. 1987, p. 4097, apartado 15; de 18 de octubre de 1989, asunto 374/87, Orkem, Rec. 1989, p. 3283; de 21 de noviembre de 1991, C-269/90, TU München, Rec. 1991, p. I-5469, y sentencias del Tribunal de Primera Instancia de 6 de diciembre de 1994, T-450/93, Lisrestal, Rec. 1994, p. II-1177; de 18 de septiembre de 1995, T-167/94, Nölle, Rec. 1995, p. II-2589) y, con respecto a la obligación de motivar, del artículo 296 del Tratado de Funcionamiento de la Unión Europea (véase asimismo la base jurídica en el artículo 298 del Tratado de Funcionamiento de la Unión Europea para la adopción de actos legislativos en aras de una administración europea abierta, eficaz e independiente).

      El apartado 3 reproduce el derecho garantizado ahora en el artículo 340 del Tratado de Funcionamiento de la Unión Europea. El apartado 4 reproduce el derecho garantizado ahora en la letra d) del apartado 2 del artículo 20 y en el artículo 25 del Tratado de Funcionamiento de la Unión Europea. De acuerdo con el apartado 2 del artículo 52 de la Carta, estos derechos se aplicarán en las condiciones y dentro de los límites establecidos en los Tratados.

      El derecho a la tutela judicial efectiva que constituye un aspecto importante de esta cuestión está garantizado en el artículo 47 de la presente Carta.

      1. Έκαστος έχει το δικαίωμα ατομικώς ή ομού μετ’ άλλων να υποβάλλη εγγράφους αιτήσεις ή παράπονα προς οιανδήποτε αρμοδίαν δημοσίαν αρχήν δικαιούμενος ν’ απαιτήση, όπως αύτη επιληφθή αυτών και αποφασίση ταχέως. Η απόφασις της αρχής ταύτης, δεόντως ητιολογημένη, γνωστοποιείται εγγράφως αμέσως εις τον υποβαλόντα την αίτησιν ή τα παράπονα εν πάση περιπτώσει ενός προθεσμίας μη υπερβαινούσης τας τριάκοντα ημέρας.
      2. Εφ’ όσον ο ενδιαφερόμενος δεν ικανοποιείται εκ της αποφάσεως ή οσάκις ουδεμία απόφασις γνωστοποιήται προς αυτόν εντός της καθοριζομένης εν τη πρώτη παραγράφω του παρόντος άρθρου προθεσμίας δύναται ο ενδιαφερόμενος ν’ αγάγη ενώπιον αρμοδίου δικαστηρίου διά προσφυγής την υπόθεσιν, εις ην αφορά η αίτησις ή το παράπονον αυτού.

      constitutional or legal rights have been threatened or violated as a result of any illegal or irregular act by governmental bodies and the civil service, local and regional selfgovernmental bodies and bodies vested with public authority.

      Citizens of the Republic of Croatia shall be European Union citizens and shall enjoy the rights
      guaranteed by the European Union acquis communautaire, and in particular:

      – the right to submit petitions to the European Parliament, complaints to the European Ombudsman and the right to apply to European Union institutions and advisory bodies in the Croatian language, as well as in all the other official languages of the European Union, and to receive a reply in the same language.
      All rights shall be exercised in compliance with the conditions and limitations laid down in
      the founding treaties of the European Union and the measures undertaken pursuant to such
      treaties.
      In the Republic of Croatia, all rights guaranteed by the European Union acquis
      communautaire shall be enjoyed by all citizens of the European Union.

      (2)Svatko može podnijeti pritužbu pučkom pravobranitelju ako smatra da su, uslijed nezakonitog ili nepravilnog rada državnih tijela, tijela lokalne i područne (regionalne) samouprave i tijela s javnim ovlastima, ugrožena ili povrijeđena njegova ustavna ili zakonska prava.

      Državljani Republike Hrvatske su građani Europske unije i uživaju prava koja im jamči pravna stečevina Europske unije, a osobito:

      – pravo podnošenja peticija Europskom parlamentu, predstavki Europskom ombudsmanu te pravo obraćanja institucijama i savjetodavnim tijelima Europske unije na hrvatskom jeziku, kao i na svim službenim jezicima Europske unije, te pravo dobiti odgovor na istom jeziku.
      Sva prava ostvaruju se u skladu s uvjetima i ograničenjima propisanima ugovorima na kojima se temelji Europska unija te mjerama prihvaćenima na temelju tih ugovora.
      U Republici Hrvatskoj sva prava zajamčena pravnom stečevinom Europske unije uživaju svi građani Europske unije.
