Artikel 41 - Ret til god forvaltning

  1. Enhver har ret til at få sin sag behandlet uvildigt, retfærdigt og inden for en rimelig frist af Unionens institutioner, organer, kontorer og agenturer.
  2. Denne ret omfatter navnlig:

    a) retten for enhver til at blive hørt, inden der træffes en individuel foranstaltning over for ham eller hende, som måtte berøre vedkommende negativt
    b) retten for enhver til aktindsigt i de akter, der vedrører ham eller hende, under iagttagelse af legitime fortrolighedshensyn samt tavshedspligt og sagernes fortrolighed
    c) pligt for forvaltningen til at begrunde sine beslutninger.

  3. Enhver har ret til erstatning fra Unionen for skader forvoldt af institutionerne eller de ansatte under udøvelsen af deres hverv i overensstemmelse med de almindelige principper, der er fælles for medlemsstaternes retssystemer.
  4. Enhver kan henvende sig til Unionens institutioner på et af traktaternes sprog og skal have svar på samme sprog.

    Artikel 41 er baseret på eksistensen af Unionen som et retsfællesskab, der er opstået via den retspraksis, der har stadfæstet god forvaltning som et overordnet retsprincip (se bl.a. Domstolens dom af 31. marts 1992, sag C-255/90 P, Burban, Sml. I, s. 2253, samt dommene afsagt af Retten i Første Instans den 18. september 1995, sag T-167/94, Nölle, Sml. II, s. 2589, og den 9. juli 1999, sag T-231/97, New Europe Consulting m.fl. Sml. II, s. 2403). Retten, som den kommer til udtryk i stk. 1 og 2, følger af retspraksis (Domstolens dom af 15. oktober 1987, sag 222/86, Heylens, Sml. 1987, s. 4097, præmis 15, af 18. oktober 1989, sag 374/87, Orkem, Sml. 1989, s. 3283, og af 21. november 1991, sag C-269/90, TU München, Sml. I, s. 5469; dommene afsagt af Retten i Første Instans den 6. december 1994, sag T-450/93, Lisrestal, Sml. II, s. 1177, og den 18. september 1995, sag T-167/94, Nölle, Sml. II, s. 2589) og er for så vidt angår pligten til at begrunde beslutninger baseret på artikel 296 i traktaten om Den Europæiske Unions funktionsmåde (jf. også retsgrundlaget i artikel 298 i traktaten om Den Europæiske Unions funktionsmåde for vedtagelse af lovgivning, der tilsigter en åben, effektiv og uafhængig europæisk forvaltning).

    Stk. 3 er en gengivelse af den ret, der nu er sikret ved artikel 340 i traktaten om Den Europæiske Unions funktionsmåde. Stk. 4 er en gengivelse af den ret, der nu er sikret ved artikel 20, stk. 2, litra d), og artikel 25 i traktaten om Den Europæiske Unions funktionsmåde. I henhold til chartrets artikel 52, stk. 2, skal disse rettigheder anvendes på de betingelser og med de begrænsninger, der er fastlagt i traktaterne.

    Adgangen til effektive retsmidler, der er et vigtigt aspekt ved dette spørgsmål, sikres ved dette charters artikel 47.

    Preamble - Explanations relating to the Charter of Fundamental Rights:
    Disse forklaringer blev oprindelig udarbejdet under præsidiet for den forsamling, der udarbejdede chartret om grundlæggende rettigheder. De er blevet ajourført under Det Europæiske Konvents præsidiums ansvar i lyset af de udkast til tilpasninger, som konventet har foretaget i charterteksten (især i artikel 51 og 52) og videreudviklingen af EU-retten. Selv om forklaringerne ikke i sig selv har retskraft, udgør de et værdifuldt fortolkningsinstrument beregnet til nærmere præcisering af chartrets bestemmelser.

Saamelaisten oikeudesta käyttää saamen kieltä viranomaisessa säädetään lailla. Viittomakieltä käyttävien sekä vammaisuuden vuoksi tulkitsemis- ja käännösapua tarvitsevien oikeudet turvataan lailla. 21 § Oikeusturva Jokaisella on oikeus saada asiansa käsitellyksi asianmukaisesti ja ilman aiheetonta viivytystä lain mukaan toimivaltaisessa tuomioistuimessa tai muussa viranomaisessa sekä oikeus saada oikeuksiaan ja velvollisuuksiaan koskeva päätös tuomioistuimen tai muun riippumattoman lainkäyttöelimen käsiteltäväksi. Käsittelyn julkisuus sekä oikeus tulla kuulluksi, saada perusteltu päätös ja hakea muutosta samoin kuin muut oikeudenmukaisen oikeudenkäynnin ja hyvän hallinnon takeet turvataan lailla.

    Pursuant to a procedure provided by law, any citizen of Estonia is entitled to access information about himself or herself held by government agencies and local authorities and in government and local authority archives. This right may be circumscribed pursuant to law to protect the rights and freedoms of others, to protect the confidentiality of a child’s filiation, and in the interests of preventing a criminal offence, apprehending the offender, or of ascertaining the truth in a criminal case.
    Unless otherwise provided by law, citizens of foreign states and stateless persons in Estonia enjoy the rights specified in paragraphs two and three of this section equally with citizens of Estonia.
    Article 46. Everyone has the right to address informational letters and petitions to government agencies, local authorities, and their officials. The procedure for responding to such letters and petitions is provided by law.

    2. Where any interested person is aggrieved by any such decision or where no such decision is notified to such person within the period specified in paragraph 1 of this Article, such person may have recourse to a competent court in the matter of such request or complaint.

Η απόφασις της αρχής ταύτης, δεόντως ητιολογημένη, γνωστοποιείται εγγράφως αμέσως εις τον υποβαλόντα την αίτησιν ή τα παράπονα εν πάση περιπτώσει ενός προθεσμίας μη υπερβαινούσης τας τριάκοντα ημέρας.
    2. Εφ’ όσον ο ενδιαφερόμενος δεν ικανοποιείται εκ της αποφάσεως ή οσάκις ουδεμία απόφασις γνωστοποιήται προς αυτόν εντός της καθοριζομένης εν τη πρώτη παραγράφω του παρόντος άρθρου προθεσμίας δύναται ο ενδιαφερόμενος ν’ αγάγη ενώπιον αρμοδίου δικαστηρίου διά προσφυγής την υπόθεσιν, εις ην αφορά η αίτησις ή το παράπονον αυτού.

    Article 93

    Državljani Republike Hrvatske su građani Europske unije i uživaju prava koja im jamči pravna stečevina Europske unije, a osobito:

    – pravo podnošenja peticija Europskom parlamentu, predstavki Europskom ombudsmanu te pravo obraćanja institucijama i savjetodavnim tijelima Europske unije na hrvatskom jeziku, kao i na svim službenim jezicima Europske unije, te pravo dobiti odgovor na istom jeziku.
    Sva prava ostvaruju se u skladu s uvjetima i ograničenjima propisanima ugovorima na kojima se temelji Europska unija te mjerama prihvaćenima na temelju tih ugovora.
    U Republici Hrvatskoj sva prava zajamčena pravnom stečevinom Europske unije uživaju svi građani Europske unije.
