41. pants - Tiesības uz labu pārvaldību

1. Ikvienai personai ir tiesības uz objektīvu, godīgu un pieņemamā termiņā veiktu jautājumu izskatīšanu Savienības iestādēs un struktūrās. 2. Šīs tiesības ietver: a) ikvienas personas tiesības tikt uzklausītai, pirms tiek veikts kāds individuāls pasākums, kas to varētu nelabvēlīgi ietekmēt; b) ikvienas personas tiesības piekļūt materiāliem, kas uz to attiecas, ievērojot konfidencialitātes, kā arī profesionālā noslēpuma un komercnoslēpuma likumīgas aizsardzības apsvērumus; c) pārvaldes pienākumu pamatot savus lēmumus. 3. Ikvienai personai ir tiesības panākt, lai Savienība atlīdzinātu zaudējumus, kurus ir radījušas tās iestādes vai darbinieki savu dienesta pienākumu izpildē, saskaņā ar dalībvalstu tiesību sistēmām kopīgiem vispārējiem tiesību principiem. 4. Ikviena persona drīkst rakstīt Savienības iestādēm, izmantojot kādu no Līgumu valodām, un atbildei ir jābūt tajā pašā valodā.

      Hartas 41. pants ir balstīts uz Savienības kā tiesiskas kopienas pastāvēšanu, kuras pamatiezīmes ir nostiprinātas judikatūrā, nosakot inter alia labu pārvaldību kā vispārēju tiesību principu (sk. inter alia Tiesas 1992. gada 31. marta spriedumu lietā C-255/90 P Burban, Recueil, 1992., I–2253. lpp., un Pirmās instances tiesas 1995. gada 18. septembra spriedumu lietā T-167/94 Nölle, Recueil, 1995., II–2589. lpp., kā arī 1999. gada 9. jūlija spriedumu lietā T-231/97 New Europe Consulting un citi, Recueil, 1999., II–2403. lpp.). Avots minēto tiesību formulējumam panta pirmajās divās daļās ir judikatūra (Tiesas 1987. gada 15. oktobra spriedums lietā 222/86 Heylens, Recueil, 1987., 4097. lpp., 15. pamatojuma punkts; 1989. gada 18. oktobra spriedums lietā 374/87 Orkem, Recueil, 1989., 3283. lpp.; 1991. gada 21. novembra spriedums lietā C-269/90 TU München, Recueil, 1991., I–5469. lpp. un Pirmās instances tiesas 1994. gada 6. decembra spriedums lietā T-450/93 Lisrestal, Recueil, 1994., II–1177. lpp. un 1995. gada 18. septembra spriedums lietā T-167/94 Nölle, Recueil, 1995., II–258. lpp.), un formulējuma, kas attiecas uz pienākumu sniegt pamatojumu, avots ir Līguma par Eiropas Savienības darbību 296. pants (sk. arī Līguma par Eiropas Savienības darbību 298. pantā noteikto juridisko pamatu to tiesību aktu pieņemšanai, kas saistīti ar atvērtu, efektīvu un neatkarīgu Eiropas pārvaldību).

      Panta 3. punktā atspoguļo tiesības, kas garantētas Līguma par Eiropas Savienības darbību 340. pantā. Panta 4. punktā atspoguļo tiesības, kas garantētas Līguma par Eiropas Savienības darbību 20. panta 2. punkta d) apakšpunktā un 25. pantā. Saskaņā ar Hartas 52. panta 2. punktu minētās tiesības jāpiemēro saskaņā ar Līgumos paredzētajiem nosacījumiem un ierobežojumiem.

      Tiesības uz efektīvu lietas izskatīšanu, kas ir svarīgs šā jautājuma aspekts, ir garantētas šīs Hartas 47. pantā.

      Šie paskaidrojumi ir sagatavoti Eiropas Savienības Pamattiesību hartu izstrādājušā Konventa prezidija vadībā. Tie ir atjaunināti Eiropas Konventa prezidija vadībā, ņemot vērā Konventa izdarītos Hartas teksta (jo īpaši 51. un 52. panta) precizējumus un Savienības tiesību turpmāku attīstību. Kaut arī šiem paskaidrojumiem nav juridiska spēka, tie ir vērtīgi interpretācijas līdzekļi, kas paredzēti Hartas noteikumu izskaidrošanai.

Viittomakieltä käyttävien sekä vammaisuuden vuoksi tulkitsemis- ja käännösapua tarvitsevien oikeudet turvataan lailla. 21 § Oikeusturva Jokaisella on oikeus saada asiansa käsitellyksi asianmukaisesti ja ilman aiheetonta viivytystä lain mukaan toimivaltaisessa tuomioistuimessa tai muussa viranomaisessa sekä oikeus saada oikeuksiaan ja velvollisuuksiaan koskeva päätös tuomioistuimen tai muun riippumattoman lainkäyttöelimen käsiteltäväksi.
