Artikel 23 - Gleichheit von Frauen und Männern

Die Gleichheit von Frauen und Männern ist in allen Bereichen, einschließlich der Beschäftigung, der Arbeit und des Arbeitsentgelts, sicherzustellen.
Der Grundsatz der Gleichheit steht der Beibehaltung oder der Einführung spezifischer Vergünstigungen für das unterrepräsentierte Geschlecht nicht entgegen.

    Absatz 1 dieses Artikels stützte sich auf Artikel 2 und Artikel 3 Absatz 2 EGV, die nunmehr durch Artikel 3 des Vertrags über die Europäische Union und Artikel 8 des Vertrags über die Arbeitsweise der Europäischen Union ersetzt wurden und die die Union auf das Ziel der Förderung der Gleichstellung von Männern und Frauen verpflichten, sowie auf Artikel 157 Absatz 1 des Vertrags über die Arbeitsweise der Europäischen Union. Er lehnt sich an Artikel 20 der revidierten Europäischen Sozialcharta vom 3. Mai 1996 und an Nummer 16 der Gemeinschaftscharta der Arbeitnehmerrechte an.
    Er stützt sich auch auf Artikel 157 Absatz 3 des Vertrags über die Arbeitsweise der Europäischen Union und auf Artikel 2 Absatz 4 der Richtlinie 76/207/EWG des Rates zur Verwirklichung des Grundsatzes der Gleichbehandlung von Männern und Frauen hinsichtlich des Zugangs zur Beschäftigung, zur Berufsbildung und zum beruflichen Aufstieg sowie in Bezug auf die Arbeitsbedingungen.
    Absatz 2 übernimmt in einer kürzeren Formulierung Artikel 157 Absatz 4 des Vertrags über die Arbeitsweise der Europäischen Union, wonach der Grundsatz der Gleichbehandlung der Beibehaltung oder der Einführung spezifischer Vergünstigungen zur Erleichterung der Berufstätigkeit des unterrepräsentierten Geschlechts oder zur Verhinderung oder zum Ausgleich von Benachteiligungen in der beruflichen Laufbahn nicht entgegensteht. Nach Artikel 52 Absatz 2 ändert dieser Absatz nicht Artikel 157 Absatz 4.

    Preamble - Explanations relating to the Charter of Fundamental Rights:
    Die Erläuterungen wurden ursprünglich unter der Verantwortung des Präsidiums des Konvents, der die Charta der Grundrechte der Europäischen Union ausgearbeitet hat, formuliert. Sie wurden unter der Verantwortung des Präsidiums des Europäischen Konvents aufgrund der von diesem Konvent vorgenommenen Anpassungen des Wortlauts der Charta (insbesondere der Artikel 51 und 52) und der Fortentwicklung des Unionsrechts aktualisiert. Diese Erläuterungen haben als solche keinen rechtlichen Status, stellen jedoch eine nützliche Interpretationshilfe dar, die dazu dient, die Bestimmungen der Charta zu verdeutlichen.
