Articolul 41 - Dreptul la bună administrare

(1) Orice persoană are dreptul de a beneficia, în ce privește problemele sale, de un tratament imparțial, echitabil și într-un termen rezonabil din partea instituțiilor, organelor, oficiilor și agențiilor Uniunii. (2) Acest drept include în principal: (a) dreptul oricărei persoane de a fi ascultată înainte de luarea oricărei măsuri individuale care ar putea să îi aducă atingere; (b) dreptul oricărei persoane de acces la dosarul propriu, cu respectarea intereselor legitime legate de confidențialitate și de secretul profesional și comercial; (c) obligația administrației de a-și motiva deciziile. (3) Orice persoană are dreptul la repararea de către Uniune a prejudiciilor cauzate de către instituțiile sau agenții acesteia în exercitarea funcțiilor lor, în conformitate cu principiile generale comune legislațiilor statelor membre. (4) Orice persoană se poate adresa în scris instituțiilor Uniunii în una dintre limbile tratatelor și trebuie să primească răspuns în aceeași limbă.

    Articolul 41 se întemeiază pe existenţa Uniunii ca o comunitate de drept ale cărei caracteristici au fost dezvoltate în jurisprudenţa pertinentă, care a consacrat, în special, buna administrare ca principiu general de drept (a se vedea, între altele, hotărârea Curţii din 31 martie 1992, în cauza C-255/90 P, Burban, Rec. 1992, p. I-2253, precum şi hotărârile Tribunalului de Primă Instanţă din 18 septembrie 1995, T-167/94, Nöelle, Rec. 1995, p. II-2589; din 9 iulie 1999, T-231/97, New Europe Consulting şi alţii, Rec. 1999, p. II-2403). Modul în care este enunţat acest drept în primele două alineate reiese din jurisprudenţă (hotărârile Curţii din 15 octombrie 1987, cauza 222/86, Heylens, Rec. 1987, p. 4097, punctul 15; din 18 octombrie 1989, cauza 374/87, Orkem, Rec. 1989, p. 3283; din 21 noiembrie 1991, cauza C-269/90, TU München, Rec. 1991, p. I-5469) precum şi hotărârile Tribunalului de Primă Instanţă din 6 decembrie 1994, T-450/93, Lisrestal, Rec. 1994, p. II-1177; din 18 septembrie 1995, T-167/94, Nöelle, Rec. 1995, p. II-2589) şi, în ceea ce priveşte obligaţia de a-şi motiva deciziile, din articolul 296 din Tratatul privind funcţionarea Uniunii Europene (a se vedea şi temeiul legal de la articolul 298 din Tratatul privind funcţionarea Uniunii Europene pentru adoptarea actelor legislative în vederea asigurării unei administraţii europene deschise, eficiente şi independente).

    Alineatul (3) reia dreptul garantat de acum înainte la articolul 340 din Tratatul privind funcţionarea Uniunii Europene. Alineatul (4) reia dreptul garantat de acum înainte la articolul 20 alineatul (2) litera (d) şi la articolul 25 din Tratatul privind funcţionarea Uniunii Europene. În conformitate cu articolul 52 alineatul (2), aceste drepturi se aplică în condiţiile şi în limitele definite în tratate.

    Dreptul efectiv la acţiune în justiţie, care constituie un aspect important al acestei probleme, este garantat la articolul 47 din prezenta cartă.

    Explicaţiile redate în continuare au fost redactate iniţial sub autoritatea prezidiului Convenţiei care a elaborat Carta drepturilor fundamentale a Uniunii Europene. Acestea au fost actualizate sub autoritatea prezidiului Convenţiei Europene, având în vedere adaptarea de către respectiva Convenţie a textului cartei (în special la articolele 51 şi 52), precum şi evoluţia dreptului Uniunii. Cu toate că aceste explicaţii nu au valoare juridică în sine, acestea constituie un preţios instrument de interpretare destinat clarificării dispoziţiilor cartei.

    Unless otherwise provided by law, citizens of foreign states and stateless persons in Estonia enjoy the rights specified in paragraphs two and three of this section equally with citizens of Estonia.
    Article 46. Everyone has the right to address informational letters and petitions to government agencies, local authorities, and their officials. The procedure for responding to such letters and petitions is provided by law.

Tryb udzielania informacji, o których mowa w ust. 1 i 2, określają ustawy, a w odniesieniu do Sejmu i Senatu ich regulaminy. Art. 63. Article 271 (Liability of public sector staff and agents) (1) The staff and agents of the state and of other public entities are civilly and criminally liable and subject to disciplinary proceedings for their actions and omissions in the exercise of their functions, and for any such exercise that leads to a breach of those citizens’ rights or interests that are protected by law, and no phase of any action or proceedings shall be dependent on authorisation by higher authority.
