Articolul 53 - Nivelul de protecție

Nici una dintre dispozițiile prezentei carte nu poate fi interpretată ca restrângând sau aducând atingere drepturilor omului și libertăților fundamentale recunoscute, în domeniile de aplicare corespunzătoare, de dreptul Uniunii și dreptul internațional, precum și de convențiile internaționale la care Uniunea sau toate statele membre sunt părți, și în special Convenția europeană pentru apărarea drepturilor omului și a libertăților fundamentale, precum și prin constituțiile statelor membre..

  • Text:

    Această dispoziţie are ca scop menţinerea nivelului de protecţie oferit în prezent, în domeniile lor de aplicare respective, de dreptul Uniunii, dreptul statelor membre şi dreptul internaţional. În funcţie de importanţa sa, menţionarea este făcută de către CEDO.

    Preamble - Explanations relating to the Charter of Fundamental Rights:
    Explicaţiile redate în continuare au fost redactate iniţial sub autoritatea prezidiului Convenţiei care a elaborat Carta drepturilor fundamentale a Uniunii Europene. Acestea au fost actualizate sub autoritatea prezidiului Convenţiei Europene, având în vedere adaptarea de către respectiva Convenţie a textului cartei (în special la articolele 51 şi 52), precum şi evoluţia dreptului Uniunii. Cu toate că aceste explicaţii nu au valoare juridică în sine, acestea constituie un preţios instrument de interpretare destinat clarificării dispoziţiilor cartei.

Masura trebuie sa fie proportionala cu situatia care a determinat-o, sa fie aplicata în mod nediscriminatoriu si fara a aduce atingere existentei dreptului sau a libertatii.
