    Key facts of the case:

    The applicant was a branch of a credit institution established in Greece authorized in another EU Member State, subject to the supervision of the Bank. The infringements for which the fines at issue were imposed are governed by provisions of general public interest designed to protect investors in their dealings with credit institutions and it is unjustified that, in breach of an essential procedural requirement, the Bank of Greece did not comply with Article 65 L. 3601/2007. The Bank of Greece has been competent to impose sanctions for infringements committed before 1.11.2007 and has correctly applied the provisions of the Code of Conduct on Investment Firms that were in force at that time. Conditions for the application of Article 4 (1) of the 7th Protocol to the ECHR, which enshrines the ne bis in idem principle.

     

    The cumulative imposition on the applicant and other fines under consumer protection law and by the Securities and Exchange Commission does not violate the above principle. Imposition of a fine for failing to provide operators with clear information on the services covered by the United Kingdom Investment Guarantee Scheme.

    Key legal question raised by the Court:

    The application seeks the annulment of the decision of the Committee on Banking and Credit Affairs of the Banking and Credit Issuance Committee dated 290 / 11.11.2009 (issue 13th), imposing on the applicant four fines of a total of two hundred and fifty thousand euro for breaches of the provisions of the Bank of Greece Governor's Act 2501 / 31.10.2002 and the Presidential Decree of the Governor of ......... and of the Code of Conduct for the Investment Firms. It is argued that the contested decision was adopted by an incompetent body, otherwise in breach of an essential procedural requirement. In particular, it is argued that since the applicant was a credit institution which, in accordance with Article 13 of Law 3601/2007, had its registered office in the United Kingdom and a branch in Greece, the provisions of Article 65 of the above law and, therefore, prior to the imposition of the sanctions at issue, had to comply with the procedure and the conditions of this article. According to the applicant, the possibility of circumventing this procedure is not expressly provided for in Law 3601/2007, as provided for in Articles 32 (2), 61 (1) and 69 (1-2) of Law 3606/2007, and it is not sufficient to rely on the general interest clause, which, moreover, does not rely on the contested decision.

    Outcome of the case:

    The Court ruled that it is justified to impose fines for breaches of the Code of Conduct by reference to historical returns on securities, without pointing out that they do not ensure future prospects, as well as the assessment of investment advisory criteria when processing the questionnaire completed by the customers. For the purposes of setting fines, the legitimate criteria of Article 69 (1) of Law 3601/2007 have been taken into account and the principle of proportionality or the principles of good administration in general have not been violated. The application for annulement was rejected.

    Since Article 4 (1) of the 7th Protocol to the European Convention on Human Rights [ECHR] was ratified by the first article of Law 1705/1987 (A 89), states that no one can be persecuted or be convicted by the courts of the same State for an offense for which he has already been acquitted or convicted by a final judgment in accordance with the law and criminal procedure of that State. Article 50 of the Charter of Fundamental Rights of the European Union provides that such a provision is equivalent to the rule that no one is prosecuted or punished for an offense for which he has already been acquitted or convicted within the Union by a final judgment of a criminal court in accordance with the law. The above-mentioned provision of Article 7 of the ECHR Protocol, which enshrines the principle of ne bis in idem, has been consistently accepted by the European Court of Human Rights [ECHR], but also by the Court of Justice of the European Union which, prior to the explicit introduction of that principle in Article 50 of the Charter of Fundamental Rights, recognized it as a fundamental principle of Community law - applies not only to criminal penalties but also to cases where the relevant legislation provides for the imposition of serious administrative sanctions, such as high-level fines, if the criteria for classifying a case as a criminal offense under the ECHR are met (see ECHR, judgment of 8.6.1975, ......... in .........) first, the legal characterization of the infringement under national law, secondly the nature of the infringement and, thirdly, the nature and gravity of the penalty which may be imposed on the offender (see Case C-617/10 ECJ of 26.2.2015 of the Grand Chamber, C-489/10 ... of 5.6.2012). In particular, as regards the question of the amount of the penalty, account is taken of the maximum penalty provided for by the law, and not that imposed in the case in question (see judgment of 19.2.2013 of the ECHR of ...).

    According to the case law of the ECJ, this principle does not prevent the imposition, for the same infringement, in succession, of an administrative (fiscal) sanction and a criminal sanction, in so far as the first sanction is not criminal and has become immune, cumulation is intended to protect the financial interests of the Union (see the aforementioned decision of 26.2.2015 and CED 1741/2015 Ombudsman).

    Furthermore, that principle does not preclude the imposition of large administrative penalties on the part of the Community and national administrative bodies in cases where there is an identity of an offender and of fact, but a different legal interest or interest is protected (see CJU case C-17 / 10, ........ of 14.2.2012 of the Grand Chamber, case C-289/04, of 29.6.2006, case C-204/00 of 7.12.2004, case C-397/03, of 19.9.2003, and so on).

    Accordingly, it is also possible under national law to impose on the same offender and for the same facts two administrative sanctions by different administrative bodies or independent administrative authorities, since their enforcement is aimed at the protection of particularly important and different legal assets (cf. Council Directive 3345 / 2002 hectare). This is because any failure to impose one of the two administrative sanctions under the ne bis in idem principle if the other sanction has already been imposed and finalized would render ineffective the obligation on the part of the public authorities to protect the legally important ones goods.

    Επειδή, το άρθρο 4 παρ. 1 του 7ου Πρωτοκόλλου της Ευρωπαϊκής Σύμβασης των Δικαιωμάτων του Ανθρώπου [ΕΣΔΑ], το οποίο κυρώθηκε με το άρθρο πρώτο του ν. 1705/1987 (Α 89), ορίζει ότι κανένας δεν μπορεί να διωχθεί ή να καταδικασθεί ποινικά από τα δικαστήρια του ίδιου Κράτους για μία παράβαση για την οποία ήδη αθωώθηκε ή καταδικάσθηκε με αμετάκλητη απόφαση σύμφωνα με τον νόμο και την ποινική δικονομία του Κράτους αυτού. Αναλόγου περιεχομένου ρύθμιση προβλέπεται και στο άρθρο 50 του Χάρτη  Θεμελιωδών Δικαιωμάτων της Ευρωπαϊκής Ένωσης, σύμφωνα με το οποίο κανείς δεν διώκεται ούτε τιμωρείται ποινικά για αδίκημα για το οποίο έχει ήδη αθωωθεί ή καταδικασθεί εντός της Ένωσης με οριστική απόφαση ποινικού δικαστηρίου σύμφωνα με τον νόμο. Η ανωτέρω διάταξη του άρθρου 7ου Πρωτοκόλλου της ΕΣΔΑ, με την οποία κατοχυρώνεται η αρχή ne bis in idem, κατά τα παγίως γενόμενα δεκτά από το Ευρωπαϊκό Δικαστήριο Δικαιωμάτων του Ανθρώπου [ΕΔΔΑ], αλλά και από το Δικαστήριο της Ευρωπαϊκής Ένωσης [ΔΕΕ] -το οποίο, και προ της ρητής καθιερώσεως της αρχής αυτής με το άρθρο 50 του Χάρτη των Θεμελιωδών Δικαιωμάτων, την αναγνώριζε ως θεμελιώδη αρχή του κοινοτικού δικαίου- έχει εφαρμογή όχι μόνον επί ποινικών κυρώσεων, αλλά και σε περιπτώσεις που προβλέπεται από τη σχετική νομοθεσία η επιβολή σοβαρών διοικητικών κυρώσεων, όπως είναι τα πρόστιμα μεγάλου ύψους, εφόσον συντρέχουν τα κριτήρια χαρακτηρισμού μιας υποθέσεως ως ποινικής κατά την ΕΣΔΑ (βλ. ΕΔΔΑ, απόφαση της 8.6.1975, ......... κατά .........), ήτοι κατά πρώτον ο νομικός χαρακτηρισμός της παραβάσεως κατά το εσωτερικό δίκαιο, κατά δεύτερον η φύση της παραβάσεως και, κατά τρίτον, η φύση και η σοβαρότητα της κυρώσεως που ενδέχεται να επιβληθεί στον διαπράξαντα την παράβαση (βλ. ΔΕΕ υπόθεση C-617/10 .... της 26.2.2015 μείζονος συνθέσεως, C-489/10 ... της 5.6.2012). Ειδικότερα, ως προς το θέμα του ύψους της κυρώσεως λαμβάνεται υπόψη η μέγιστη προβλεπόμενη από τον νόμο κύρωση και όχι η επιβληθείσα στην συγκεκριμένη περίπτωση (βλ. ΕΔΔΑ απόφαση της 19.2.2013 .... κατά ....). Σύμφωνα δε με τη νομολογία του ΔΕΕ, η αρχή αυτή δεν εμποδίζει την επιβολή για την ίδια παράβαση, διαδοχικώς, μιας διοικητικής (φορολογικής) κυρώσεως και μιας ποινικής κυρώσεως, στον βαθμό που η πρώτη κύρωση δεν έχει ποινικό χαρακτήρα και έχει καταστεί απρόσβλητη, εφόσον η σώρευση αποβλέπει στην προστασία των οικονομικών συμφερόντων της Ενώσεως (βλ. προαναφερθείσα απόφαση ...της 26.2.2015 και ΣτΕ 1741/2015 Ολομ.). Περαιτέρω, η ίδια ως άνω αρχή δεν αποκλείει την επιβολή διοικητικών κυρώσεων μεγάλου ύψους εκ μέρους των κοινοτικών και εθνικών διοικητικών οργάνων και σε περιπτώσεις όπου υφίσταται μεν ταυτότητα παραβάτη και πραγματικών περιστατικών, αλλά προστατεύεται διαφορετικό έννομο αγαθό ή συμφέρον (βλ. ΔΕΕ υπόθεση C-17/10, ........ της 14.2.2012 μείζονος συνθέσεως, υπόθεση C-289/04, ....της 29.6.2006, υπόθεση C-204/00 .... της 7.12.2004, υπόθεση C-397/03, .... της 19.9-2003 κ.ά.). Αντιστοίχως, και στο εθνικό δίκαιο είναι δυνατή η επιβολή στον ίδιο παραβάτη και για τα ίδια πραγματικά περιστατικά δύο διοικητικών κυρώσεων από διαφορετικά διοικητικά όργανα ή ανεξάρτητες διοικητικές αρχές, εφόσον η επιβολή τους αποβλέπει στην προστασία ιδιαιτέρως σημαντικών και διαφορετικών εννόμων αγαθών (πρβλ. ΣτΕ 3345/2002 επτ.). Και τούτο διότι τυχόν αδυναμία επιβολής της μιας από τις δύο διοικητικές κυρώσεις κατ’ εφαρμογή της αρχής ne bis in idem, εφόσον έχει ήδη επιβληθεί και οριστικοποιηθεί η άλλη κύρωση, θα καθιστούσε ανενεργό την υποχρέωση που έχουν τα κρατικά όργανα να προστατεύουν τα θιγόμενα σημαντικά αυτά έννομα αγαθά. Διάφορο δε είναι το ζήτημα εάν, λόγω του ύψους των επαπειλουμένων κυρώσεων, τυχόν σωρευτική επιβολή τους παρίσταται υπέρμετρα επαχθής για τον παραβάτη, το οποίο αντιμετωπίζεται εκάστοτε με βάση την αρχή της αναλογικότητας.
