Preambule

Národy Evropy, vytvářejíce mezi sebou stále těsnější unii, se rozhodly sdílet mírovou budoucnost založenou na společných hodnotách.

Unie, vědoma si svého duchovního a morálního dědictví, se zakládá na nedělitelných a všeobecných hodnotách lidské důstojnosti, svobody, rovnosti a solidarity; spočívá na zásadách demokracie a právního státu. Do středu své činnosti staví jednotlivce tím, že zavádí občanství Unie a vytváří prostor svobody, bezpečnosti a práva.
Unie přispívá k zachování a rozvíjení těchto společných hodnot při současném respektování rozmanitosti kultur a tradic národů Evropy, národní identity členských států a uspořádání jejich veřejné moci na státní, regionální a místní úrovni; usiluje o podporu vyváženého a udržitelného rozvoje a zajišťuje volný pohyb osob, služeb, zboží a kapitálu, jakož i svobodu usazování.
K tomuto účelu je nezbytné posílit ochranu základních práv s ohledem na společenský vývoj, sociální pokrok a vědeckotechnologický rozvoj zřetelnějším vyjádřením těchto práv v podobě listiny.
Při respektování pravomocí a úkolů Unie i zásady subsidiarity potvrzuje tato listina práva, která vyplývají především z ústavních tradic a mezinárodních závazků společných členským státům, z Evropské úmluvy o ochraně lidských práv a základních svobod, ze sociálních chart přijatých Unií a Radou Evropy a z judikatury Soudního dvora Evropské unie a Evropského soudu pro lidská práva. Tuto listinu budou v této souvislosti soudy Unie a členských států vykládat s náležitým zřetelem na vysvětlení vyhotovená pod vedením prezídia Konventu, jež vypracovalo tuto listinu, a doplněná pod vedením prezídia Evropského konventu.
Uplatňování těchto práv s sebou nese odpovědnost a povinnosti, jak ve vztahu k druhým, tak ve vztahu k lidskému společenství a budoucím generacím.
V důsledku toho uznává Unie práva, svobody a zásady, které jsou vyhlášeny níže.

Since 2020, the European Union Agency for Fundamental Rights (FRA) has been tracking the accreditation status and mandates of NHRIs across the EU. The 2025 annual update continues this work. These updates examine whether NHRIs are involved in monitoring compliance with fundamental rights in the use of EU funds, and how they use the EU Charter of Fundamental Rights when advising governments or carrying out education, training, and awareness-raising activities.

    In recent years, the EU has taken steps to improve child protection, yet some Member States do not have an integrated approach. FRA first produced an overview of child protection systems in the EU in 2014, and an update in 2023. The data is published in FRA’s ‘Mapping of Child Protection Systems in the EU – Update 2023’. This report completements the 2023 update with comparative analysis and provides greater detail on children in vulnerable situations, care and the participation of children in matters affecting them. It also offers guidance on creating comprehensive frameworks that ensure that children’s rights are respected.

    This FRA Position Paper outlines the Agency’s position on the creation of 'return hubs' in non-EU countries for migrants who have been ordered to leave the EU. Considering the serious fundamental rights risks connected with running return hubs, this legal analysis presents the conditions that would have to be met for return hubs to respect fundamental rights and comply with EU law. These include setting up agreements with the host countries and creating independent human rights monitoring mechanisms. The position paper does not examine centres in third countries that process asylum applications.
