Artículo 16 - Libertad de empresa
Se reconoce la libertad de empresa de conformidad con el Derecho de la Unión y con las legislaciones y prácticas nacionales.

Este artículo se basa en la jurisprudencia del Tribunal de Justicia por la que se ha reconocido la libertad de ejercer una actividad económica o mercantil (véanse las sentencias de 14 de mayo de 1974, asunto 4/73, Nold, Rec. 1974, p. 491, apartado 14; y de 27 de septiembre de 1979, asunto 230/78, SpA Eridania y otros, Rec. 1979, p. 2749, apartados 20 y 31) y la libertad contractual (véanse, entre otras, las sentencias Sukkerfabriken Nykoebing, asunto 151/78, Rec. 1979, p. 1, apartado 19; y la de 5 de octubre de 1999, España c. Comisión, C-240/97, Rec. 1999, p. I-6571, apartado 99), así como en los apartados 1 y 3 del artículo 119 del Tratado de Funcionamiento de la Unión Europea, que reconoce la libre competencia. Este derecho se ejercerá, naturalmente, dentro del respeto del Derecho de la Unión y de las legislaciones nacionales. Podrá someterse a las limitaciones previstas en el apartado 1 del artículo 52 de la Carta.

Si bien no tienen por sí mismas valor jurídico, constituyen un valioso instrumento de interpretación con objeto de aclarar las disposiciones de la Carta.

Članak 49.
Poduzetnička i tržišna sloboda temelj su gospodarskog ustroja Republike Hrvatske.
Država osigurava svim poduzetnicima jednak pravni položaj na tržištu. Zabranjena je zlouporaba monopolskog položaja određenog zakonom.
Država potiče gospodarski napredak i socijalno blagostanje građana i brine se za gospodarski razvitak svih svojih krajeva.
Prava stečena ulaganjem kapitala ne mogu se umanjiti zakonom niti drugim pravnim aktom.
Inozemnom ulagaču jamči se slobodno iznošenje dobiti i uloženog kapitala.Članak 50.
(2)Poduzetnička se sloboda i vlasnička prava mogu iznimno ograničiti zakonom radi zaštite interesa i sigurnosti Republike Hrvatske, prirode, ljudskog okoliša i zdravlja ljudi. - Constitution of the Republic of BulgariaPaís:Bulgaria
Article 19 (1) The economy of the Republic of Bulgaria shall be based on free economic initiative.

(3) All investments and economic activity by citizens and legal entities shall enjoy the protection of the law. (3) Инвестициите и стопанската дейност на български и чуждестранни граждани и юридически лица се закрилят от закона. (4) Законът създава условия за коопериране и други форми на сдружаване на гражданите и юридическите лица за постигане на стопански и социален напредък.
