Article 16 - Liberté d'entreprise

La liberté d'entreprise est reconnue conformément au droit de l'Union et aux législations et pratiques nationales.

    Cet article se fonde sur la jurisprudence de la Cour de justice, qui a reconnu la liberté d'exercer une activité économique ou commerciale (voir les arrêts du 14 mai 1974, aff. 4/73, Nold, rec. 1974, p. 491, point 14; et du 27 septembre 1979, aff. 230/78, SpA Eridania et autres, rec. 1979, p. 2749, points 20 et 31) et la liberté contractuelle (voir, entre autres, les arrêts Sukkerfabriken Nykoebing, aff. 151/78, rec. 1979, p. 1, point 19; 5 octobre 1999, Espagne c. Commission, C-240/97, rec. 1999, p. I-6571, point 99 des motifs), ainsi que sur l'article 119, paragraphes 1 et 3 du traité sur le fonctionnement de l'Union européenne, qui reconnaît la concurrence libre. Ce droit s'exerce bien entendu dans le respect du droit de l'Union et des législations nationales. Il peut être soumis aux limitations prévues à l'article 52, paragraphe 1, de la Charte.

    Les explications qui figurent ci-après ont été établies initialement sous la responsabilité du praesidium de la Convention qui a élaboré la Charte des droits fondamentaux de l'Union européenne. Elles ont été mises à jour sous la responsabilité du praesidium de la Convention européenne, compte tenu des adaptations apportées au texte de la Charte par ladite Convention (notamment aux articles 51 et 52) et de l'évolution du droit de l'Union. Bien que ces explications n'aient pas en soi de valeur juridique, elles constituent un outil d'interprétation précieux destiné à éclairer les dispositions de la Charte.

    Članak 49.
    Poduzetnička i tržišna sloboda temelj su gospodarskog ustroja Republike Hrvatske.
    Država osigurava svim poduzetnicima jednak pravni položaj na tržištu. Zabranjena je zlouporaba monopolskog položaja određenog zakonom.
    Država potiče gospodarski napredak i socijalno blagostanje građana i brine se za gospodarski razvitak svih svojih krajeva.
    Prava stečena ulaganjem kapitala ne mogu se umanjiti zakonom niti drugim pravnim aktom.
    Inozemnom ulagaču jamči se slobodno iznošenje dobiti i uloženog kapitala.

    Članak 50.
    (2)Poduzetnička se sloboda i vlasnička prava mogu iznimno ograničiti zakonom radi zaštite interesa i sigurnosti Republike Hrvatske, prirode, ljudskog okoliša i zdravlja ljudi.

    Article 19 (1) The economy of the Republic of Bulgaria shall be based on free economic initiative.
    (2) The State shall establish and guarantee equal legal conditions for economic activity to all citizens and legal entities by preventing any abuse of a monopoly status and unfair competition, and by protecting the consumer.
    (3) All investments and economic activity by citizens and legal entities shall enjoy the protection of the law. (4) The law shall establish conditions conducive to the setting up of cooperatives and other forms of association of citizens and legal entities in the pursuit of economic and social prosperity.

    (3) Инвестициите и стопанската дейност на български и чуждестранни граждани и юридически лица се закрилят от закона. (4) Законът създава условия за коопериране и други форми на сдружаване на гражданите и юридическите лица за постигане на стопански и социален напредък.
