Artikel 33 - Familien- und Berufsleben

(1) Der rechtliche, wirtschaftliche und soziale Schutz der Familie wird gewährleistet.
(2) Um Familien- und Berufsleben miteinander in Einklang bringen zu können, hat jeder Mensch das Recht auf Schutz vor Entlassung aus einem mit der Mutterschaft zusammenhängenden Grund sowie den Anspruch auf einen bezahlten Mutterschaftsurlaub und auf einen Elternurlaub nach der Geburt oder Adoption eines Kindes.

    Artikel 33 Absatz 1 stützt sich auf Artikel 16 der Europäischen Sozialcharta.

    Absatz 2 lehnt sich an die Richtlinie 92/85/EWG über die Durchführung von Maßnahmen zur Verbesserung der Sicherheit und des Gesundheitsschutzes von schwangeren Arbeitnehmerinnen, Wöchnerinnen und stillenden Arbeitnehmerinnen am Arbeitsplatz und an die Richtlinie 96/34/EG zu der von UNICE, CEEP und EGB geschlossenen Rahmenvereinbarung über Elternurlaub an. Er stützt sich ferner auf Artikel 8 (Mutterschutz) der Europäischen Sozialcharta und lehnt sich an Artikel 27 (Recht der Arbeitnehmer mit Familienpflichten auf Chancengleichheit und Gleichbehandlung) der revidierten Sozialcharta an. Der Begriff `Mutterschaft` deckt den Zeitraum von der Zeugung bis zum Stillen des Kindes ab.

    Preamble - Explanations relating to the Charter of Fundamental Rights:
    Die Erläuterungen wurden ursprünglich unter der Verantwortung des Präsidiums des Konvents, der die Charta der Grundrechte der Europäischen Union ausgearbeitet hat, formuliert. Sie wurden unter der Verantwortung des Präsidiums des Europäischen Konvents aufgrund der von diesem Konvent vorgenommenen Anpassungen des Wortlauts der Charta (insbesondere der Artikel 51 und 52) und der Fortentwicklung des Unionsrechts aktualisiert. Diese Erläuterungen haben als solche keinen rechtlichen Status, stellen jedoch eine nützliche Interpretationshilfe dar, die dazu dient, die Bestimmungen der Charta zu verdeutlichen.
