Artikel 30 - Skydd mot uppsägning utan saklig grund

Varje arbetstagare har rätt till skydd mot uppsägning utan saklig grund, i enlighet med unionsrätten samt nationell lagstiftning och praxis.

      Denna artikel har inspirerats av artikel 24 i den reviderade sociala stadgan. Se även direktiven 2001/23/EG om skydd för arbetstagares rättigheter vid överlåtelse av företag och 80/987/EEG om skydd för arbetstagarna vid arbetsgivarens insolvens, ändrat genom direktiv 2002/74/EG.

      Preamble - Explanations relating to the Charter of Fundamental Rights:
      Förklaringarna utarbetades ursprungligen på initiativ av presidiet för det konvent som utarbetade Europeiska unionens stadga om de grundläggande rättigheterna. De har uppdaterats på initiativ av Europeiska konventets presidium mot bakgrund av de justeringar av stadgetexten som gjorts av det senare konventet (särskilt artiklarna 51 och 52) samt unionsrättens vidare utveckling. Även om förklaringarna inte i sig har rättslig status, utgör de ett värdefullt tolkningsverktyg avsett att klargöra stadgans bestämmelser.

      7. Information about employment conditions and protection in case of dismissals
      Workers have the right to be informed in writing at the start of employment about their rights and obligations resulting from the employment relationship, including on probation period.
      Prior to any dismissal, workers have the right to be informed of the reasons and be granted a reasonable period of notice. They have the right to access to effective and impartial dispute resolution and, in case of unjustified dismissal, a right to redress, including adequate compensation.
