Artikel 50 - Rätt att inte bli dömd eller straffad två gånger för samma brott

Ingen får lagföras eller straffas på nytt för en lagöverträdelse för vilken han eller hon redan har blivit frikänd eller dömd i unionen genom en lagakraftvunnen brottmålsdom i enlighet med lagen.

      Artikel 4 i protokoll nr 7 till Europakonventionen har följande lydelse:

      1. Ingen får lagföras eller straffas på nytt i en brottmålsrättegång i samma stat för ett brott för vilket han redan blivit slutligt frikänd eller dömd i enlighet med lagen och rättegångsordningen i denna stat.

      2. Bestämmelserna i föregående punkt skall inte utgöra hinder för att målet tas upp på nytt i enlighet med lagen och rättegångsordningen i den berörda staten om det föreligger bevis om nya eller nyuppdagade omständigheter eller om ett grovt fel begåtts i det tidigare rättegångsförfarandet vilket kan ha påverkat utgången i målet.

      3. Avvikelse får inte ske från denna artikel med stöd av artikel 15 i konventionen.`

      Regeln om att ingen får dömas två gånger för samma brott (`non bis in idem`) tillämpas i unionsrätten (bland en omfattande rättspraxis, se dom av den 5 maj 1966, Gutmann mot kommissionen, mål 18/65 och 35/65, Rec. 1966, s. 150, och bland senare mål förstainstansrättens dom av den 20 april 1999, förenade mål T-305/94 m.fl., Limburgse Vinyl Maatschappij NV mot kommissionen, REG 1999, s. II-931). Det bör påpekas att den `icke-kumulativa` regeln avser kumulering av två påföljder av samma typ – här straffrättsliga.

      Enligt artikel 50 ska `non bis in idem`-regeln gälla inte endast i fråga om en och samma stats behörighet utan även mellan flera medlemsstaters behörigheter. Detta motsvarar unionens regelverk – se artiklarna 54–58 i konventionen om tillämpning av Schengenavtalet och domstolens dom av den 11 februari 2003 i mål C-187/01, Gözütok, (Rec. 2003, s. I-1345), artikel 7 i konventionen om skydd av Europeiska gemenskapernas finansiella intressen samt artikel 10 i konventionen om kamp mot korruption. De starkt begränsade undantag som finns och som innebär att medlemsstaterna enligt dessa konventioner får göra avsteg från `non bis in idem`-regeln omfattas av den övergripande klausulen i artikel 52.1 om begränsningar. När det gäller de situationer som avses i artikel 4 i protokoll nr 7, nämligen tillämpningen av denna princip inom en och samma medlemsstat, har den rättighet som garanteras samma innebörd och räckvidd som motsvarande rättighet i Europakonventionen.

      Preamble - Explanations relating to the Charter of Fundamental Rights:
      Förklaringarna utarbetades ursprungligen på initiativ av presidiet för det konvent som utarbetade Europeiska unionens stadga om de grundläggande rättigheterna. De har uppdaterats på initiativ av Europeiska konventets presidium mot bakgrund av de justeringar av stadgetexten som gjorts av det senare konventet (särskilt artiklarna 51 och 52) samt unionsrättens vidare utveckling. Även om förklaringarna inte i sig har rättslig status, utgör de ett värdefullt tolkningsverktyg avsett att klargöra stadgans bestämmelser.
