Artikel 50 - Recht om niet tweemaal in een strafrechtelijke procedure voor hetzelfde delict te worden berecht of gestraft

Niemand wordt opnieuw berecht of gestraft in een strafrechtelijke procedure voor een strafbaar feit aarvoor hij in de Unie reeds onherroepelijk is vrijgesproken of veroordeeld overeenkomstig de wet.

    Artikel 4 van het Zevende Protocol bij het EVRM luidt als volgt:

    `1. Niemand wordt opnieuw berecht of gestraft in een strafrechtelijke procedure binnen de rechtsmacht van dezelfde staat voor een strafbaar feit waarvoor hij reeds onherroepelijk is vrijgesproken of veroordeeld overeenkomstig de wet en het strafprocesrecht van die staat.

    2. De bepalingen van het voorgaande lid beletten niet de heropening van de zaak overeenkomstig de wet en het strafprocesrecht van de betrokken staat, indien er aanwijzingen zijn van nieuwe of pas aan het licht gekomen feiten, of indien er sprake was van een fundamenteel gebrek in het vorige proces, die de uitkomst van de zaak zouden of zou kunnen beïnvloeden.

    3. Afwijking van dit artikel krachtens artikel 15 van het Verdrag is niet toegestaan.`.

    De regel `ne bis in idem` is van toepassing in het recht van de Unie (zie een groot aantal arresten, onder andere arrest van 5 mei 1966, Gutmann tegen Commissie, zaak 18/65 en 35/65, Jurispr. 1966, blz. 150, en in een recente zaak het arrest van het Gerecht van 20 april 1999, gevoegde zaken T-305/94 e.a., Limburgse Vinyl Maatschappij NV tegen Commissie, Jurispr. 1999, blz. II-931). Gepreciseerd zij dat het cumulatieverbod betrekking heeft op de cumulatie van twee sancties van dezelfde aard, met name strafrechtelijke sancties.

    Overeenkomstig artikel 50 is de regel `ne bis in idem` niet alleen van toepassing binnen de rechtsmacht van dezelfde staat maar ook in de onderlinge verhoudingen van de rechtsmacht van verschillende lidstaten. Dit stemt overeen met het acquis van het recht van de Unie: zie de artikelen 54 tot en met 58 van de Schengenuitvoeringsovereenkomst en het arrest van het Hof van Justitie van 11 februari 2003, zaak C-187/01, Gözütok Jurispr. 2003, blz. I-1345), artikel 7 van de Overeenkomst aangaande de bescherming van de financiële belangen van de Europese Gemeenschap, en artikel 10 van de Overeenkomst ter bestrijding van corruptie. De beperkte uitzonderingen waarmee het de lidstaten krachtens die overeenkomsten is toegestaan om af te wijken van de regel `ne bis in idem` vallen onder de horizontale beperkingsbepaling van artikel 52, lid 1. Wat de in artikel 4 van het Zevende Protocol bedoelde situaties betreft, namelijk de toepassing van het beginsel binnen de rechtsmacht van dezelfde lidstaat, heeft het gewaarborgde recht dezelfde inhoud en reikwijdte als het overeenkomstige recht van het EVRM.

    Preamble - Explanations relating to the Charter of Fundamental Rights:
    Deze toelichtingen werden oorspronkelijk opgesteld onder de verantwoordelijkheid van het praesidium van de Conventie die het Handvest van de grondrechten van de Europese Unie heeft opgesteld. Zij zijn bijgewerkt onder de verantwoordelijkheid van het praesidium van de Europese Conventie, in het licht van de wijzigingen die door laatstgenoemde Conventie in het Handvest zijn aangebracht (met name in artikel 51 en 52) en van verdere ontwikkelingen in het recht van de Unie. Hoewel zij op zich geen juridische waarde hebben, vormen zij een waardevol hulpmiddel voor de interpretatie, bedoeld om de bepalingen van het Handvest te verduidelijken.
