Článok 50 - Právo nebyť stíhaný alebo potrestaný v trestnom konaní dvakrát za ten istý trestný čin

Nikoho nemožno stíhať alebo potrestať v trestnom konaní za trestný čin, za ktorý už bol v rámci Únie oslobodený alebo odsúdený konečným rozsudkom v súlade so zákonom.

    Článok 4 Protokolu č. 7 k EDĽP znie:

    `1. Nikoho nemožno stíhať alebo potrestať v trestnom konaní podliehajúcom právomoci toho istého štátu za trestný čin, za ktorý už bol oslobodený alebo odsúdený konečným rozsudkom podľa zákona a trestného poriadku tohto štátu.

    2. Ustanovenia predchádzajúceho odseku nie sú na prekážku obnove konania podľa zákona a trestného poriadku príslušného štátu, ak nové alebo novoodhalené skutočnosti alebo podstatná chyba v predchádzajúcom konaní mohli ovplyvniť rozhodovanie vo veci.

    3. Od tohto článku nemožno odstúpiť podľa článku 15 Dohovoru.`

    Zásada `ne bis in idem` sa uplatňuje v práve Únie (spomedzi významnej judikatúry pozri rozsudok z 5. mája 1996, spojené veci 18/65 a 35/65 vo veci Gutmann/Komisia Zb. 1966, s. 150 a najnovšiu vec, rozsudok Súdu prvého stupňa z 20. apríla 1999, spojené veci T-305/94 a. i., Limburgse Vinyl Maatschappij NV/Komisia, Zb. 1999, s. II-931). Pravidlo zakazujúce kumuláciu odkazuje na kumuláciu dvoch sankcií rovnakej povahy, teda trestných sankcií.

    V súlade s článkom 50 sa zásada `ne bis in idem` uplatňuje nielen v rámci jurisdikcie jedného štátu, ale aj medzi jurisdikciami niekoľkých členských štátov. Toto zodpovedá acquis práva Únie; pozri články 54 až 58 Schengenského dohovoru a rozsudok Súdneho dvora z 11. februára 2003 vo veci C-187/01 Gözütok (Zb. 2003, s. I-1345), článok 7 Dohovoru o ochrane finančných záujmov Európskych spoločenstiev a článok 10 Dohovoru o boji proti korupcii. Veľmi obmedzené výnimky, v ktorých dohovory povoľujú členským štátom odchýliť sa od zásady `ne bis in idem` sú zahrnuté do horizontálnej doložky v článku 52 ods. 1 charty, ktorá sa týka obmedzení. Pokiaľ ide o situácie uvedené v článku 4 Protokolu č. 7 teda o uplatňovanie zásady v rámci toho istého členského štátu, zaručené právo má rovnaký význam a rozsah ako zodpovedajúce právo v EDĽP.

    Ďalej uvedené vysvetlivky boli pôvodne pripravené pod vedením predsedníctva konventu, ktorý vypracoval návrh Charty základných práv Európskej únie. Boli aktualizované pod vedením predsedníctva Európskeho konventu so zreteľom na úpravy, ktoré urobil tento konvent k textu charty (najmä k článkom 51 a 52), a vývoj práva Únie. Hoci tieto vysvetlivky nie sú ako také právne záväzné, predstavujú cenný nástroj výkladu, ktorý je určený na objasnenie ustanovení charty.
