28. cikk - A kollektív tárgyaláshoz és fellépéshez való jog
A munkavállalóknak és a munkaadóknak, illetőleg szervezeteiknek az uniós joggal, valamint a nemzeti jogszabályokkal és gyakorlattal összhangban joguk van arra, hogy megfelelő szinten kollektív tárgyalásokat folytassanak és kollektív szerződéseket kössenek, valamint hogy érdekütközés esetén érdekeik védelmében együttesen lépjenek fel, a sztrájkot is beleértve.
Ez a cikk az Európai Szociális Charta 6. cikkén és a munkavállalók alapvető szociális jogairól szóló közösségi chartán alapul (12–14. pont). A kollektív fellépéshez való jogot az Emberi Jogok Európai Bírósága az EJEE 11. cikke által lefektetett szakszervezeti jogok egyik elemeként ismerte el. A kollektív tárgyalás megfelelő szintjeit illetően lásd az előző cikkre vonatkozó magyarázatot. A kollektív fellépés gyakorlásának módjaira és korlátaira, a sztrájkot is beleértve a nemzeti jogszabályok és gyakorlatok az irányadók, beleértve a kollektív fellépés egyszerre több tagállamban való végrehajtásának kérdését is.
Artikel 23 Ieder heeft het recht een menswaardig leven te leiden. Daartoe waarborgen de wet, het decreet of de in artikel 134 bedoelde regel, rekening houdend met de overeenkomstige plichten, de economische, sociale en culturele rechten, waarvan ze de voorwaarden voor de uitoefening bepalen. Article 23Chacun a le droit de mener une vie conforme à la dignité humaine. A cette fin, la loi, le décret ou la règle visée à l'article 134 garantissent, en tenant compte des obligations correspondantes, les droits économiques, sociaux et culturels, et déterminent les conditions de leur exercice. Article 23 Everyone has the right to lead a life in keeping with human dignity. To this end, the laws, federate laws and rules referred to in Article 134 guarantee economic, social and cultural rights, taking into account corresponding obligations, and determine the conditions for exercising them. These rights include among others: 1° the right to employment and to the free choice of an occupation within the context of a general employment policy, aimed among others at ensuring a level of employment that is as stable and high as possible, the right to fair terms of employment and to fair remuneration, as well as the right to information, consultation and collective negotiation;(...)
Article 11
1 Everyone has the right to freedom of peaceful assembly and to freedom of association with others, including the right to form and to join trade unions for the protection of his interests.
2 No restrictions shall be placed on the exercise of these rights other than such as are prescribed by law and are necessary in a democratic society in the interests of national security or public safety, for the prevention of disorder or crime, for the protection of health or morals or for the protection of the rights and freedoms of others. This article shall not prevent the imposition of lawful restrictions on the exercise of these rights by members of the armed forces, of the police or of the administration of the State.
Artikel 11 (1) Alle Menschen haben das Recht, sich friedlich zu versammeln und sich frei mit anderen zusammenzuschließen, einschließlich des Rechts, zum Schutze ihrer Interessen Gewerkschaften zu bilden und diesen beizutreten.
