Articolo 24 - Diritti del minore

1. I minori hanno diritto alla protezione e alle cure necessarie per il loro benessere. Essi possono esprimere liberamente la propria opinione. Questa viene presa in considerazione sulle questioni che li riguardano in funzione della loro età e della loro maturità.
2. In tutti gli atti relativi ai minori, siano essi compiuti da autorità pubbliche o da istituzioni private, l'interesse superiore del minore deve essere considerato preminente.
3. Il minore ha diritto di intrattenere regolarmente relazioni personali e contatti diretti con i due genitori, salvo qualora ciò sia contrario al suo interesse.

    Questo articolo si basa sulla convenzione di New York sui diritti del fanciullo, firmata il 20 novembre 1989 e ratificata da tutti gli Stati membri, e in particolare, sugli articoli 3, 9, 12 e 13 di detta convenzione.

    Il paragrafo 3 tiene conto del fatto che, nell’ambito della creazione di uno spazio di libertà, sicurezza e giustizia, la normativa dell’Unione nelle materie civili che presentano implicazioni transnazionali, per cui la competenza è conferita dall’articolo 81 del trattato sul funzionamento dell'Unione europea, può comprendere tra l’altro i diritti di visita che consentono ai figli di intrattenere regolarmente relazioni personali e contatti diretti con entrambi i genitori.

    Le presenti spiegazioni erano state elaborate, nella versione iniziale, sotto l'autorità del praesidium della Convenzione che aveva redatto la Carta dei diritti fondamentali dell’Unione europea e sono ora state aggiornate sotto la responsabilità del praesidium della Convenzione europea, sulla scorta degli adeguamenti redazionali che quest’ultima Convenzione ha apportato al testo della Carta (in particolare agli articoli 51 e 52) e dell’evoluzione del diritto dell’Unione. Benché non abbiano di per sé status di legge, esse rappresentano un prezioso strumento d’interpretazione destinato a chiarire le disposizioni della Carta.
