The European Union Agency for Fundamental Rights (FRA) is looking to contract the services of a natural or legal person to conduct research aiming at providing an update of the Handbook on European data protection law.

In 2014 FRA, in close cooperation with the Council of Europe (CoE), published the Handbook on European data protection law. The Handbook, which synthesised European and national law and case-law in the field of data protection, was very successful.

Since 2014, European law in the field of data protection has been greatly modified by several reforms, both within the EU and CoE legal frameworks.

The update foreseen in this contract should cover relevant law (including amendments to existing laws) of the European Union and the Council of Europe in light of recent adoptions. These include: the General Data Protection Regulation (EU)2016/679 (GDPR) and the Directive for the police and criminal justice sector (EU) 2016/680 (Police Directive) and the modernisation of the Convention for the Protection of Individuals with regard to Automatic Processing of Personal Data (ETS 108) and its additional Protocol regarding supervisory authorities and transborder data flows (ETS 181). The update should also cover up-to-date case law of the Court of Justice of the European Union (CJEU) and European Court of Human Rights (ECtHR).

Main tasks of the selected candidate: Preparing a draft updated and expanded Handbook on European data protection law based on desk research.

Technical and professional capacity

Candidates must be able to meet the following minimum selection criteria:

  • Advanced university degree in law (Master or equivalent and above);
  • Proven professional and/or academic experience of at least three (3) years in the area of data protection law;
  • Proven experience in research in the field of data protection law, supported by at least three (3) relevant publications in the human rights field and/or European data protection law;
  • Excellent knowledge of English (Common European Framework of Reference - CEF - level C1)

No documents proving the fulfilment of these criteria are requested at this stage.

Participation in this negotiated procedure for a low value contract is open to natural and legal persons falling within the scope of the EU Treaties (this includes all economic operators established in the European Union) and to all natural and legal persons in a third country which has a special agreement with the Union in the field of public procurement on the conditions laid down in that agreement. FRA is not part of the Agreement on Government Procurement (GPA) concluded within the World Trade Organisation. Therefore, FRA’s procurement procedures are not open to tenderers from GPA countries.
