54 straipsnis - Draudimas piktnaudžiauti teisėmis

Jokia šios Chartijos nuostata negali būti aiškinama kaip suteikianti teisę pradėti veiklą ar atlikti veiksmą siekiant panaikinti bet kurią šioje Chartijoje pripažįstamą teisę ar laisvę arba apriboti ją labiau, negu numatyta šioje Chartijoje..

    Šis straipsnis atitinka EŽTK 17 straipsnį: `Jokia šios Konvencijos nuostata negali būti aiškinama kaip suteikianti kuriai nors valstybei, grupei ar asmeniui teisę vykdyti kokią nors veiklą ar atlikti kokį nors veiksmą, kuriais siekiama panaikinti kokias nors šioje Konvencijoje numatytas teises ir laisves ar jas apriboti daugiau, nei nustatyta šioje Konvencijoje.`

    Preamble - Explanations relating to the Charter of Fundamental Rights:
    Šie išaiškinimai buvo pirmą kartą parengti prižiūrint Europos Sąjungos pagrindinių teisių chartiją rengusio Konvento prezidiumui. Jie buvo atnaujinti Europos konvento prezidiumo atsakomybe, atsižvelgiant į Konvento įvestas Chartijos teksto projekto pataisas (ypač 51 ir 52 straipsnių) ir kitus Sąjungos teisės pakeitimus. Nors išaiškinimai neturi teisinės galios, jie yra svarbi Chartijos nuostatoms išaiškinti skirta aiškinimo priemonė.

    Chartija, kaip labai šiuolaikiškas žmogaus teisių katalogas, į kurį įtraukta daug teisių, kurių nėra įtvirtintuose teisių aktuose, popieriuje atrodo išties gerai. Išmanantieji pagrindinius ES teisės principus paprastai greitai nurodo, kad Chartija yra visada privaloma Europos Sąjungai, bet valstybėms narėms tik tada, kai jos „įgyvendina ES teisę“. Tačiau ką iš tiesų reiškia šis dažnai cituojamas Chartijos 51 straipsnis?

Šiame vadove siekiama parodyti, kaip pagal Europos teisę ir teismų praktiką paisoma konkrečių vaikų interesų ir poreikių. Jame taip pat parodyta vaikų tėvų ir globėjų arba kitų teisinių atstovų svarba ir, jei būtina, nurodyta, kada teisės ir atsakomybė aiškiausiai perduodamos vaikais besirūpinantiems asmenims.

    Artificial intelligence (AI) already plays a role in deciding what unemployment benefits someone gets, where a burglary is likely to take place, whether someone is at risk of cancer, or who sees that catchy advertisement for low mortgage rates. Its use keeps growing, presenting seemingly endless possibilities. But we need to make sure to fully uphold fundamental rights standards when using AI. This report presents concrete examples of how companies and public administrations in the EU are using, or trying to use, AI. It focuses on four core areas – social benefits, predictive policing, health services and targeted advertising.

    Russia’s military aggression against Ukraine triggered scenes not seen in Europe for decades. It has since caused death, immense destruction, and unspeakable suffering. It also set in motion a mass movement of people not seen since World War II. To protect them, the EU activated the Temporary Protection Directive for the first time. In doing so, all EU Member States must offer protection to those displaced from Ukraine.

    Europos Sąjungos pagrindinių teisių chartija (ESPTC) – tai ES žmogaus teisių
    aktas. Jos visada privalo laikytis ES institucijos ir valstybės narės,
    veikdamos ES teisės taikymo srityje. Tačiau įvertinti, ar konkretus atvejis
    patenka į ES teisės taikymo sritį, toli gražu nėra paprasta. Todėl būtina
    rengti mokymus ir teikti mokymo medžiagą teisės specialistams, kad jie
    galėtų suprasti Chartijos taikymo sritį, kaip nustatyta jos 51 straipsnyje.
    Šio instruktoriaus vadovo tikslas – pateikti rekomendacijas dėl tokių
    mokymų organizavimo ir vykdymo, remiantis kelių bylų analizėmis, kurių
    ateityje gali būti įtraukta daugiau.

    ir duomenų saugojimas, ribos. Šis vadovas parengtas siekiant supažindinti teisės specialistus, kurie neturi
    itin daug žinių apie duomenų apsaugą, su šia naujai besiformuojančia teisės sritimi.

    This report presents findings from FRA’s 2021 survey on Roma in Croatia, Czechia, Greece, Hungary, Italy, Portugal, Romania and Spain, as well as in North Macedonia and Serbia. The survey includes interviews with more than 8,400 Roma, collecting information on more than 20,000 individuals living in their households. By focusing on Roma, the survey provides unique data and information that are not available from European general population surveys, which do not disaggregate on grounds of ethnic origin. The findings present a bleak but familiar picture of exclusion, deprivation, discrimination and racism.

    This report examines why victims do not report bias-motivated incidents and the barriers that they face when reporting incidents through national crime reporting systems. By mapping existing practices that have a bearing on the victim’s experiences when reporting bias-motivated violence and harassment, it aims to provide evidence to support national efforts to encourage and facilitate reporting – and ultimately assist Member States in delivering on their duties with regard to combating hate crime.
