Artículo 54 - Prohibición del abuso de derecho

Ninguna de las disposiciones de la presente Carta podrá ser interpretada en el sentido de que implique un derecho cualquiera a dedicarse a una actividad o a realizar un acto tendente a la destrucción de los derechos o libertades reconocidos en la presente Carta o a limitaciones más amplias de estos derechos y libertades que las previstas en la presente Carta..

    Este artículo corresponde al artículo 17 del CEDH, que reza lo siguiente:

    `Ninguna de las disposiciones del presente Convenio podrá ser interpretada en el sentido de que implique para un Estado, grupo o individuo, un derecho cualquiera a dedicarse a una actividad o a realizar un acto tendente a la destrucción de los derechos o libertades reconocidos en el presente Convenio o a limitaciones más amplias de estos derechos y libertades que las previstas en el mismo.`

    Preamble - Explanations relating to the Charter of Fundamental Rights:
    Las presentes explicaciones fueron elaboradas inicialmente bajo la responsabilidad del Praesidium de la Convención que redactó la Carta de los Derechos Fundamentales de la Unión Europea. Han sido actualizadas bajo la responsabilidad del Praesidium de la Convención Europea, a la vista de las adaptaciones de la redacción del texto de la Carta realizadas por la Convención (en particular, los artículos 51 y 52) y de la evolución del Derecho de la Unión. Si bien no tienen por sí mismas valor jurídico, constituyen un valioso instrumento de interpretación con objeto de aclarar las disposiciones de la Carta.

Its use keeps growing, presenting seemingly endless possibilities. But we need to make sure to fully uphold fundamental rights standards when using AI. This report presents concrete examples of how companies and public administrations in the EU are using, or trying to use, AI. It focuses on four core areas – social benefits, predictive policing, health services and targeted advertising.

    La Carta de los Derechos Fundamentales de la Unión Europea (CDFUE) equivale a la Declaración de derechos de la UE. Es siempre vinculante para las instituciones de la UE y los Estados miembros cuando actúan dentro del ámbito de aplicación del Derecho de la Unión. Ahora bien, no es en absoluto fácil determinar si un caso concreto entra dentro del ámbito de aplicación del Derecho de la Unión. Por ello, es necesario impartir formación y material didáctico a los profesionales del Derecho a fin de que puedan comprender el ámbito de aplicación de la Carta, tal como se establece en su artículo 51. Este manual del formador tiene por objeto ofrecer orientación tanto sobre la organización como sobre la realización de dichas formaciones tomando como base una serie de estudios de caso, que se ampliarán en el futuro.

    This report presents findings from FRA’s 2021 survey on Roma in Croatia, Czechia, Greece, Hungary, Italy, Portugal, Romania and Spain, as well as in North Macedonia and Serbia. The survey includes interviews with more than 8,400 Roma, collecting information on more than 20,000 individuals living in their households. By focusing on Roma, the survey provides unique data and information that are not available from European general population surveys, which do not disaggregate on grounds of ethnic origin. The findings present a bleak but familiar picture of exclusion, deprivation, discrimination and racism.

    This report examines why victims do not report bias-motivated incidents and the barriers that they face when reporting incidents through national crime reporting systems. By mapping existing practices that have a bearing on the victim’s experiences when reporting bias-motivated violence and harassment, it aims to provide evidence to support national efforts to encourage and facilitate reporting – and ultimately assist Member States in delivering on their duties with regard to combating hate crime.
