Článok 54 - Zákaz zneužívania práv

Žiadne ustanovenie tejto charty sa nesmie vykladať tak, že zahŕňa právo vyvíjať činnosť alebo dopúšťať sa činov zameraných na poškodenie práv a slobôd uznaných v tejto charte alebo na ich obmedzenie vo väčšom rozsahu, ako je ustanovený v tejto charte..

    Tento článok zodpovedá článku 17 EDĽP:

    `Nič v tomto Dohovore sa nemôže vykladať tak, akoby dávalo štátu, skupine alebo jednotlivcovi akékoľvek právo vyvíjať činnosť alebo dopúšťať sa činov zameraných na zničenie ktoréhokoľvek z tu priznaných práv a slobôd alebo na obmedzovanie týchto práv a slobôd vo väčšom rozsahu, než to Dohovor ustanovuje.`

    Preamble - Explanations relating to the Charter of Fundamental Rights:
    Ďalej uvedené vysvetlivky boli pôvodne pripravené pod vedením predsedníctva konventu, ktorý vypracoval návrh Charty základných práv Európskej únie. Boli aktualizované pod vedením predsedníctva Európskeho konventu so zreteľom na úpravy, ktoré urobil tento konvent k textu charty (najmä k článkom 51 a 52), a vývoj práva Únie. Hoci tieto vysvetlivky nie sú ako také právne záväzné, predstavujú cenný nástroj výkladu, ktorý je určený na objasnenie ustanovení charty.

    Možno o nej povedať, že je to veľmi progresívny súbor ľudských práv zahŕňajúci množstvo práv, ktoré v iných zaužívaných listinách základných práv a slobôd chýbajú, a na papieri vyzerá skutočne dobre. Kto pozná základné zásady práva EÚ, dokáže väčšinou hneď vysypať z rukáva, že charta je vždy záväzná pre EÚ a pre členské štáty je záväzná výlučne vtedy, ak „vykonávajú právo EÚ“. Čo však tieto slová z článku 51 charty, ktoré tak často citujeme, reálne znamenajú?

Cieľom tejto príručky je ilustrovať, ako sa prostredníctvom európskych zákonov a judikatúry uspokojujú osobitné záujmy a potreby detí. Takisto ilustruje význam rodičov a poručníkov alebo iných zákonných zástupcov a v prípade potreby odkazuje na to, kde sú práva a povinnosti v najväčšej miere zverené opatrovateľom detí.

Its use keeps growing, presenting seemingly endless possibilities. But we need to make sure to fully uphold fundamental rights standards when using AI. This report presents concrete examples of how companies and public administrations in the EU are using, or trying to use, AI. It focuses on four core areas – social benefits, predictive policing, health services and targeted advertising.

    Vojenská agresia Ruska voči Ukrajine vyvolala situácie, ktoré Európa celé desaťročia nezažila. Odvtedy prináša smrť, spôsobuje rozsiahle ničenie a neopísateľné utrpenie. Vyvolala aj masový pohyb ľudí, ktorý od druhej svetovej vojny nemá obdobu. V záujme ich ochrany EÚ prvýkrát aktivovala smernicu o dočasnej ochrane. Všetky členské štáty EÚ sú teda povinné poskytnúť ochranu osobám vysídleným z Ukrajiny.

    Charta základných práv Európskej únie (ďalej len „Charta“) je listinou práv pre EÚ. Vždy je záväzná pre inštitúcie EÚ, ako aj pre členské štáty, keď konajú v rozsahu pôsobnosti právnych predpisov EÚ. Nie je však ani zďaleka jednoduché posúdiť, či konkrétny prípad patrí do pôsobnosti práva EÚ. Preto je potrebné poskytnúť odborníkom pracujúcim v oblasti práva odbornú prípravu a materiály na odbornú prípravu, aby porozumeli oblasti uplatňovania Charty tak, ako sa stanovuje v jej článku 51. Cieľom tejto príručky pre školiteľov je poskytnúť usmernenia o organizácii a realizácii takýchto školení na základe série prípadových štúdií, ktoré sa v budúcnosti rozšíria.

    This report presents findings from FRA’s 2021 survey on Roma in Croatia, Czechia, Greece, Hungary, Italy, Portugal, Romania and Spain, as well as in North Macedonia and Serbia. The survey includes interviews with more than 8,400 Roma, collecting information on more than 20,000 individuals living in their households. By focusing on Roma, the survey provides unique data and information that are not available from European general population surveys, which do not disaggregate on grounds of ethnic origin. The findings present a bleak but familiar picture of exclusion, deprivation, discrimination and racism.

    This report examines why victims do not report bias-motivated incidents and the barriers that they face when reporting incidents through national crime reporting systems. By mapping existing practices that have a bearing on the victim’s experiences when reporting bias-motivated violence and harassment, it aims to provide evidence to support national efforts to encourage and facilitate reporting – and ultimately assist Member States in delivering on their duties with regard to combating hate crime.
