Članak 54 - Zabrana zlouporabe prava

Nijedna odredba ove Povelje ne smije se tumačiti kao da podrazumijeva pravo na poduzimanje bilo kakvoga djelovanja ili izvršavanja bilo kakvog djela čiji je cilj naškoditi bilo kojemu od prava i sloboda priznatih ovom Poveljom ili njihovo ograničavanje više nego što je predviñeno Poveljom.

    nisu ukljucena u postojece povelje o pravima, što Povelju cini vrlo dojmljivom na
    papiru. Oni upuceni u glavna nacela prava EU-a obicno mogu brzo izreci da je Povelja
    uvijek obvezujuca za EU, a za države clanice obvezujuca je samo kad „provode zakonodavstvo
    EU-a”. No što ta cesto citirana formulacija iz clanka 51. Povelje zapravo znaci?

    Djeca su punopravni nosioci prava. Ona su nositelji svih ljudskih i temeljnih prava te osobe za koje vrijede posebni propisi zbog njihovih specifičnih osobina. Ovim se Priručnikom nastojalo opisati način na koji europski zakoni i sudska praksa odgovaraju na posebne interese i potrebe djece. Njime se prikazuje važnost roditelja i skrbnika ili drugih zakonskih zastupnika te se, gdje je to primjenjivo, navode upućivanja na prava i odgovornosti koji se primarno dodjeljuju skrbnicima djece.

    Artificial intelligence (AI) already plays a role in deciding what unemployment benefits someone gets, where a burglary is likely to take place, whether someone is at risk of cancer, or who sees that catchy advertisement for low mortgage rates. Its use keeps growing, presenting seemingly endless possibilities. But we need to make sure to fully uphold fundamental rights standards when using AI. This report presents concrete examples of how companies and public administrations in the EU are using, or trying to use, AI. It focuses on four core areas – social benefits, predictive policing, health services and targeted advertising.

    Russia’s military aggression against Ukraine triggered scenes not seen in Europe for decades. It has since caused death, immense destruction, and unspeakable suffering. It also set in motion a mass movement of people not seen since World War II. To protect them, the EU activated the Temporary Protection Directive for the first time. In doing so, all EU Member States must offer protection to those displaced from Ukraine.

    Povelja Europske unije o temeljnim pravima predstavlja zbirku najvažnijih prava EU-a. Uvijek obvezuje institucije Europske unije i države članice kada djeluju unutar područja primjene prava EU-a. Međutim, nije lako procijeniti je li konkretan slučaj obuhvaćen područjem primjene prava EU-a. Stoga je pravnim stručnjacima potrebno omogućiti osposobljavanje i materijale za osposobljavanje kako bi razumjeli područje primjene Povelje kako je navedeno u njezinu članku 51. Cilj je ovog priručnika za instruktore pružiti smjernice i za organizaciju i provedbu takvog osposobljavanja na temelju niza studija slučajeva, koji će se u budućnosti proširiti.

    komunikacija i pohrane podataka. Ovaj je priručnik namijenjen pravnicima koji nisu specijalizirani u području
    zaštite podataka kako bi se upoznali s ovim novim područjem prava.

    This report presents findings from FRA’s 2021 survey on Roma in Croatia, Czechia, Greece, Hungary, Italy, Portugal, Romania and Spain, as well as in North Macedonia and Serbia. The survey includes interviews with more than 8,400 Roma, collecting information on more than 20,000 individuals living in their households. By focusing on Roma, the survey provides unique data and information that are not available from European general population surveys, which do not disaggregate on grounds of ethnic origin. The findings present a bleak but familiar picture of exclusion, deprivation, discrimination and racism.

    Godina 2021. donijela je i napredak i prepreke u pogledu zaštite temeljnih prava. U FRA-inu Izvješću o temeljnim pravima 2022. daje se pregled važnih promjena i postignuća u tom području te se ističu područja koja još izazivaju zabrinutost. U ovoj publikaciji navode se mišljenja FRA-e o glavnim promjenama u obuhvaćenim tematskim područjima te se ukratko iznose dokazi kojima se potkrjepljuju ta mišljenja. Na taj se način pruža sažet i informativan pregled glavnih pitanja povezanih s temeljnim pravima s kojima se suočavaju EU i njegove države članice.

    This report examines why victims do not report bias-motivated incidents and the barriers that they face when reporting incidents through national crime reporting systems. By mapping existing practices that have a bearing on the victim’s experiences when reporting bias-motivated violence and harassment, it aims to provide evidence to support national efforts to encourage and facilitate reporting – and ultimately assist Member States in delivering on their duties with regard to combating hate crime.
