Negotiated procedure for a low value contract: Expert input on artificial intelligence (AI) and fundamental rights assessment

FRA has been working in the area of artificial intelligence (AI) for several years, publishing reports on AI and fundamental rights and bias in algorithms, as well as focus papers on selected AI issues. Its upcoming reports, to be published in late 2025 and early 2026, will look into the assessment of high-risk AI systems, the use of remote biometric identification systems for law enforcement purposes as well as the use of AI in the justice field.
Based on its expertise, FRA contributes to the implementation of the AI Act in a variety of ways. FRA has been assigned a role under the AI Act as a permanent member of the Advisory Forum (Article 67 of the AI Act), which has yet to be established. FRA is also an observer in two sub-groups of the AI Board, established under Article 65 of the AI Act, namely on high-risk AI systems and prohibited AI practices. In addition, FRA provides input to the AI Office for the development of a fundamental rights impact assessment (FRIA) under Article 27 of the AI Act. FRA is also in the process of cooperating with European standardisation organisations, including those that are tasked with developing standards under the AI Act.
FRA is also regularly engaged with existing EU networks on AI topics, notably the EU Innovation Hub for Internal Security’s AI cluster and other EU agencies’ networks that also deal with the topic of AI. In addition, FRA is engaged with the work of the Council of Europe in relation to AI topics (among others), including the Council of Europe’s Committee on Artificial Intelligence (CAI).
This contract aims to support FRA’s work in the area of AI and fundamental rights with expertise and background research. The work under this contract will support FRA with necessary expertise and background research to strengthen FRA’s outputs and contribution to policy processes. The expertise and background research should reflect on both the legal and technical aspects of AI and support FRA in preparing guidance on the practical implementation of fundamental rights safeguards when using AI.
The duration of the contract will be eleven months.
Technical and professional capacity
The contractor shall propose one or more experts meeting at least the minimum selection criteria below:
- The expert team members should meet the following profiles (both profiles 1 and 2 can be covered by one expert) – which will be assessed based on the information provided in the CV:
- Expert on fundamental rights and technology:
- University degree in law, social science or other relevant area related to the activities assigned under this contract.
- Knowledge and experience on fundamental rights in the context of technology, proven by one publication or one completed project that includes a fundamental rights analysis of technology related aspects.
- Excellent knowledge of English (Common European Framework of Reference (CEF) level C1)
- Expert on technology risk assessment:
- University degree in law, social science or technology field
- Experience in the area of technology risk assessment/management and/or artificial intelligence risk assessment/management, both from a legal/ethical and technical perspective, proven by one project or publication completed in the past 3 years
- Experience working with potential providers and/or deployers of AI systems, proven by one project or publication in the past 3 years.
- Excellent knowledge of English (Common European Framework of Reference (CEF) level C1)
- Expert on fundamental rights and technology:
No documents proving the fulfilment of these criteria are requested at this stage. Participation in this negotiated procedure for a low value contract is open to natural and legal persons falling within the scope of the EU Treaties (this includes all economic operators established in the European Union) and to all natural and legal persons established in a third country which has a special agreement with the Union in the field of public procurement on the conditions laid down in that agreement. FRA is not part of the Agreement on Government Procurement (GPA) concluded within the World Trade Organisation. Therefore, the procurement procedure is not open to candidates from GPA countries.
