Artykuł 40 - Prawo głosowania i kandydowania w wyborach lokalnych
Każdy obywatel Unii ma prawo głosowania i kandydowania w wyborach do władz lokalnych w Państwie Członkowskim, w którym ma miejsce zamieszkania, na takich samych warunkach jak obywatele tego państwa.
Artykuł ten odpowiada prawu zagwarantowanemu na mocy artykułu 20 ustęp 2 Traktatu o funkcjonowaniu Unii Europejskiej (zob. także podstawa prawna w artykule 22 Traktatu o funkcjonowaniu Unii Europejskiej dla przyjęcia ustaleń dotyczących wykonywania tego prawa). Zgodnie z artykułem 52 ustęp 2 Karty prawo to ma zastosowanie na warunkach określonych w tych artykułach Traktatów.
Artikel 130 De wet kan het recht de leden van de gemeenteraad te kiezen en het recht lid van de gemeenteraad te zijn toekennen aan ingezetenen, die geen Nederlander zijn, mits zij tenminste voldoen aan de vereisten die gelden voor ingezetenen die tevens Nederlander zijn.
Article 21 (1) Citizens have the right to participate in the administration of public affairs either directly or through the free election of their representatives. (2) Elections must be held within terms not exceeding the regular electoral terms provided for by law. (3) The right to vote is universal and equal, and shall be exercised by secret ballot. The conditions for exercising the right to vote shall be provided for by law. (4) Citizens shall have access, on an equal basis, to any elective and other public office.
Článek 21 (1) Občané mají právo podílet se na správě veřejných věcí přímo nebo svobodnou volbou svých zástupců. (2) Volby se musí konat ve lhůtách nepřesahujících pravidelná volební období stanovená zákonem. (3) Volební právo je všeobecné a rovné a vykonává se tajným hlasováním. Podmínky výkonu volebního práva stanoví zákon. (4) Občané mají za rovných podmínek přístup k voleným a jiným veřejným funkcím.
Section 1 Parliamentary electors. (1)A person is entitled to vote as an elector at a parliamentary election in any constituency if on the date of the poll he— (a)is registered in the register of parliamentary electors for that constituency; (b)is not subject to any legal incapacity to vote (age apart); (c)is either a Commonwealth citizen or a citizen of the Republic of Ireland; and (d)is of voting age (that is, 18 years or over). (2)A person is not entitled to vote as an elector— (a)more than once in the same constituency at any parliamentary election; or (b)in more than one constituency at a general election.
Section 2 Local government electors. (1)A person is entitled to vote as an elector at a local government election in any electoral area if on the date of the poll he— (a)is registered in the register of local government electors for that area; (b)is not subject to any legal incapacity to vote (age apart); (c)is a Commonwealth citizen, a citizen of the Republic of Ireland or a relevant citizen of the Union; and (d)is of voting age (that is, 18 years or over). (2)A person is not entitled to vote as an elector— (a)more than once in the same electoral area at any local government election; or (b)in more than one electoral area at an ordinary election for a local government area which is not a single electoral area.
Articulo 23 1. Los ciudadanos tienen el derecho a participar en los asuntos públicos, directamente o por medio de representantes, libremente elegidos en elecciones periódicas por sufragio universal.
2. Asimismo, tienen derecho a acceder en condiciones de igualdad a las funciones y cargos públicos, con los requisitos que señalen las leyes.
Articulo 13 (2) 2. Solamente los españoles serán titulares de los derechos reconocidos en el artículo 23, salvo lo que, atendiendo a criterios de reciprocidad, pueda establecerse por tratado o ley para el derecho de sufragio activo y pasivo en las elecciones municipales. Articulo 23 1. Los ciudadanos tienen el derecho a participar en los asuntos públicos, directamente o por medio de representantes, libremente elegidos en elecciones periódicas por sufragio universal. 2. Asimismo, tienen derecho a acceder en condiciones de igualdad a las funciones y cargos públicos, con los requisitos que señalen las leyes.
Article 23 1. Citizens have the right to participate in public affairs, directly or through representatives freely elected in periodic elections by universal suffrage.2. They also have the right to accede under conditions of equality to public functions and positions, in accordance with the requirements laid down by the law.
Article 13 Only Spaniards shall have the rights recognised in section 23, except in cases which may be established by treaty or by law concerning the right to vote and the right to be elected in municipal elections, and subject to the principle of reciprocity. (This text includes the first constitutional reform adopted on 27/08/1992; which added the words «and the right to be elected» to the paragraph).

Čl. 30 (1) Občania majú právo zúčastňovať sa na správe verejných vecí priamo alebo slobodnou voľbou svojich zástupcov. Cudzinci s trvalým pobytom na území Slovenskej republiky majú právo voliť a byť volení do orgánov samosprávy obcí a do orgánov samosprávy vyšších územných celkov.(2) Voľby sa musia konať v lehotách nepresahujúcich pravidelné volebné obdobie ustanovené zákonom. (3)Volebné právo je všeobecné, rovné a priame a vykonáva sa tajným hlasovaním. Podmienky výkonu volebného práva ustanoví zákon. (4) Občania majú za rovnakých podmienok prístup k voleným a iným verejným funkciám.
rticle 30 (1) Citizens have the right to participate in the administration of public affairs either directly or through the free election of their representatives. Foreigners with a permanent residence on the territory of the Slovak Republic have the right to vote and be elected in the self-administration bodies of municipalities and self-administration bodies of superior territorial units. (2) Elections must be held within deadlines not exceeding the regular electoral period as laid down by law. (3) The right to vote is universal, equal, and direct and is exercised by means of secret ballot. Conditions for exercising the right to vote shall be laid down by law.(4) Citizens have access to elected and other public posts under equal conditions.
Articolul 36(1) Cetatenii au drept de vot de la vârsta de 18 ani, împliniti pâna în ziua alegerilor inclusiv.(2) Nu au drept de vot debilii sau alienatii mintal, pusi sub interdictie, si nici persoanele condamnate, prin hotarâre judecatoreasca definitiva, la pierderea drepturilor electorale.Articolul 37 (1) Au dreptul de a fi alesi cetatenii cu drept de vot care îndeplinesc conditiile prevazute în articolul 16 alineatul (3), daca nu le este interzisa asocierea în partide politice, potrivit articolului 40 alineatul (3). (2) Candidatii trebuie sa fi împlinit, pâna în ziua alegerilor inclusiv, vârsta de cel putin 23 de ani pentru a fi alesi în Camera Deputatilor sau în organele administratiei publice locale, vârsta de cel putin 33 de ani pentru a fi alesi în Senat si vârsta de cel putin 35 de ani pentru a fi alesi în functia de Presedinte al României.Articolul 38În conditiile aderarii României la Uniunea Europeana, cetatenii români au dreptul de a alege si de a fi alesi în Parlamentul European.Articolul 62(1) Camera Deputatilor si Senatul sunt alese prin vot universal, egal, direct, secret si liber exprimat, potrivit legii electorale. (2) Organizatiile cetatenilor apartinând minoritatilor nationale, care nu întrunesc în alegeri numarul de voturi pentru a fi reprezentate în Parlament, au dreptul la câte un loc de deputat, în conditiile legii electorale. Cetatenii unei minoritati nationale pot fi reprezentati numai de o singura organizatie. (3) Numarul deputatilor si al senatorilor se stabileste prin legea electorala, în raport cu populatia tarii.Articolul 81(1) Presedintele României este ales prin vot universal, egal, direct, secret si liber exprimat.(2) Este declarat ales candidatul care a întrunit, în primul tur de scrutin, majoritatea de voturi ale alegatorilor înscrisi în listele electorale. (3) În cazul în care nici unul dintre candidati nu a întrunit aceasta majoritate, se organizeaza al doilea tur de scrutin, între primii doi candidati stabiliti în ordinea numarului de voturi obtinute în primul tur. Este declarat ales candidatul care a obtinut cel mai mare numar de voturi. (4) Nici o persoana nu poate îndeplini functia de Presedinte al României decât pentru cel mult doua mandate. Acestea pot fi si succesive.
Article 36(1) Every citizen having turned eighteen up to or on the election day shall have the right to vote. (2) The mentally deficient or alienated persons, laid under interdiction, as well as the persons disenfranchised by a final decision of the court cannot vote.Article 37(1) Eligibility is granted to all citizens having the right to vote, who meet the requirements in Article 16 (3), unless they are forbidden to join a political party, in accordance with Article 40 (3).(2) Candidates must have turned, up to or on the election day, at least twenty-three in order to be elected to the Chamber of Deputies or the bodies of local public administration, at least thirty-three in order to be elected to the Senate, and at least thirty-five in order to be elected to the office of President of Romania.Article 38After Romania's accession to the European Union, Romanian citizens shall have the right to elect and be elected to the European Parliament.Article 62(1) The Chamber of Deputies and the Senate shall be elected by universal, equal, direct, secret and free suffrage, in accordance with the electoral law. (2) Organizations of citizens belonging to national minorities, which fail to obtain the number of votes for representation in Parliament, have the right to one Deputy seat each, under the terms of the electoral law. Citizens of a national minority are entitled to be represented by one organization only.(3) The number of Deputies and Senators shall be established by the electoral law, in proportion to the population of Romania.Article 81(1) The President of Romania shall be elected by universal, equal, direct, secret an free suffrage.(2) The candidate who, in the first ballot, obtained a majority of votes of the electors entered on the electoral lists shall be declared elected. (3) In case no candidate has obtained such a majority, a second ballot shall be held between the first two candidates highest in the order of the number of votes cast for them in the first ballot. The candidate having the greatest number of votes shall be declared elected.(4) No one may hold the office of President of Romania but for two terms of office at the most, that can also be consecutive.
Artigo 15.º (Estrangeiros, apátridas, cidadãos europeus) 4. A lei pode atribuir a estrangeiros residentes no território nacional, em condições de reciprocidade, capacidade eleitoral activa e passiva para a eleição dos titulares de órgãos de autarquias locais. 5. A lei pode ainda atribuir, em condições de reciprocidade, aos cidadãos dos Estados-membros da União Europeia residentes em Portugal o direito de elegerem e serem eleitos Deputados ao Parlamento Europeu. Artigo 49.º (Direito de sufrágio) 1. Têm direito de sufrágio todos os cidadãos maiores de dezoito anos, ressalvadas as incapacidades previstas na lei geral. 2. O exercício do direito de sufrágio é pessoal e constitui um dever cívico. Artigo 50.º (Direito de acesso a cargos públicos) 1. Todos os cidadãos têm o direito de acesso, em condições de igualdade e liberdade, aos cargos públicos. 2. Ninguém pode ser prejudicado na sua colocação, no seu emprego, na sua carreira profissional ou nos benefícios sociais a que tenha direito, em virtude do exercício de direitos políticos ou do desempenho de cargos públicos. 3. No acesso a cargos electivos a lei só pode estabelecer as inelegibilidades necessárias para garantir a liberdade de escolha dos eleitores e a isenção e independência do exercício dos respectivos cargos. Artigo 109.º (Participação política dos cidadãos) A participação directa e activa de homens e mulheres na vida política constitui condição e instrumento fundamental de consolidação do sistema democrático, devendo a lei promover a igualdade no exercício dos direitos cívicos e políticos e a não discriminação em função do sexo no acesso a cargos políticos. Artigo 113.º (Princípios gerais de direito eleitoral) 1. O sufrágio directo, secreto e periódico constitui a regra geral de designação dos titulares dos órgãos electivos da soberania, das regiões autónomas e do poder local.
Article 15 (Foreigners, stateless persons, European citizens) (4) Under reciprocal terms, the law may accord foreigners who reside in Portugal the eligibility to vote for and stand for election as officeholders of local authority organs. (5) Under reciprocal terms, the law may also accord citizens of European Union Member States who reside in Portugal the eligibility to vote for and stand for election as Members of the European Parliament. Article 49 (Right to vote) (1) Every citizen who has attained the age of eighteen years has the right to vote, subject to the incapacities provided for in the general law. (2) The right to vote shall be exercised personally and constitutes a civic duty. Article 50 (Right of access to public office) (1) Every citizen has the right of access to public office under equal and free conditions. (2) No one may be prejudiced in his appointments, job or professional career or the social benefits to which he is entitled, due to the exercise of political rights or of public office. (3) In governing the right of access to elected office, the law may only lay down the ineligibilities needed to guarantee both the electors’ freedom of choice, and independence and absence of bias in the exercise of the offices in question. Article 109 (Citizens’ participation in politics) The direct and active participation in political life by men and women is a condition for and a fundamental instrument in the consolidation of the democratic system, and the law must promote both equality in the exercise of civic and political rights and the absence of gender-based discrimination in access to political office. Article 113 (General principles of electoral law) (1) Direct, secret and periodic suffrage is the general rule for the appointment of the officeholders of the elected entities that exercise sovereignty, elected organs of autonomous regions and elected local government organs.
Article 621. If, no later than on the day of vote, he has attained 18 years of age, Polish citizen shall have the right to participate in a referendum and the right to vote for the President of the Republic of Poland as well as representatives to the Sejm and Senate and organs of local government. 2. Persons who, by a final judgment of a court, have been subjected to legal incapacitation or deprived of public or electoral rights, shall have no right to participate in a referendum nor a right to vote.Article 991. Every citizen having the right to vote, who, no later than on the day of the elections, has attained the age of 21 years, shall be eligible to be elected to the Sejm.2. Every citizen having the right to vote, who, no later than on the day of the elections, has attained the age of 30 years, shall be eligible to be elected to the Senate.3. No person sentenced to imprisonment by a final judgment for an intentional indictable offence may be elected to the Sejm or the Senate.

Obywatel polski ma prawo udziału w referendum oraz prawo wybierania Prezydenta Rzeczypospolitej, posłów, senatorów i przedstawicieli do organów samorządu terytorialnego, jeżeli najpóźniej w dniu głosowania kończy 18 lat.2. Prawo udziału w referendum oraz prawo wybierania nie przysługuje osobom, które prawomocnym orzeczeniem sądowym są ubezwłasnowolnione lub pozbawione praw publicznych albo wyborczych.Art. 99.1. Wybrany do Sejmu może być obywatel polski mający prawo wybierania, który najpóźniej w dniu wyborów kończy 21 lat.2. Wybrany do Senatu może być obywatel polski mający prawo wybierania, który najpóźniej w dniu wyborów kończy 30 lat.3. Wybraną do Sejmu lub do Senatu nie może być osoba skazana prawomocnym wyrokiem na karę pozbawienia wolności za przestępstwo umyślne ścigane z oskarżenia publicznego.
Article 57 Subject to the provisions of article 58 of this Constitution, a person shall be qualified to be registered as a voter for the election of members of the House of Representatives if, and shall not be qualified to be so registered unless -(a) he is a citizen of Malta;(b) he has attained the age of eighteen years; and(c) he is resident in Malta and has during the eighteen months immediately preceding his registration been a resident for a continuous period of six months or for periods amounting in the aggregate to six months: Provided that this paragraph shall not apply to a person who is ordinarily resident in Malta but has not been resident in Malta as required by this paragraph by reason of service abroad in the public service, including service in the offices referred to in subarticle (3) of article 124 of this Constitution, or by reason of service abroad in, or as a member of, a disciplined force as defined in article 47 of this Constitution.58. No person shall be qualified to be registered as a voter for the election of members of the House of Representatives if -(a) he is interdicted or incapacitated for any mental infirmity by a court in Malta or is otherwise determined in Malta to be of unsound mind;(b) he is under sentence of death imposed on him by any court in Malta or is serving a sentence of imprisonment (by whatever name called) exceeding twelve months imposed on him by such a court or substituted by competent authority for some other sentence imposed on him by such a court, or is under such a sentence of imprisonment the execution of which has been suspended; or(c) he is disqualified for registration as a voter by or under any law for the time being in force in Malta by reason of his having been convicted of any offence connected with the election of members of the House of Representatives.
Article 9. (…) la loi peut conférer l’exercice de droits politiques à des non-Luxembourgeois. Article 107.(2) Il y a dans chaque commune un conseil communal élu directement par les habitants de la commune; les conditions pour être électeur ou éligible sont réglées par la loi.
