Artikel 41 - Rätt till god förvaltning

1. Var och en har rätt att få sina angelägenheter behandlade opartiskt, rättvist och inom skälig tid av unionens institutioner, organ och byråer. 2. Denna rättighet innebär bl.a. att a) var och en har rätt att bli hörd innan en enskild åtgärd som skulle beröra honom eller henne negativt vidtas mot honom eller henne, b) var och en ska ha tillgång till de akter som berör honom eller henne, med förbehåll för berättigade intressen vad avser sekretess, tystnadsplikt och affärshemlighet, c) förvaltningen är skyldig att motivera sina beslut. 3. Var och en har rätt att få ersättning av unionen för skador som har orsakats av dess institutioner eller dess tjänstemän under deras tjänsteutövning, enligt de allmänna gemensamma principerna i medlemsstaternas lagstiftning. 4. Var och en ska kunna vända sig till unionens institutioner på något av fördragens språk och ska få svar på samma språk.

    Artikel 41 grundas på unionen som en rättsgemenskap som har vuxit fram ur rättspraxisen, där bland annat god förvaltning slagits fast som en allmän rättsprincip (se bl.a. domstolens dom av den 31 mars 1992, C-255/90 P, Burban, Rec. 1992, s. I-2253, och förstainstansrättens domar av den 18 september 1995, T-167/94, Nölle, REG 1995, s. II-2589; den 9 juli 1999, T-231/97, New Europe Consulting m.fl. REG, s. II-2403. Den formulering som denna rättighet ges i de två första punkterna är en följd av rättspraxisen (domstolens domar av den 15 oktober 1987, mål 222/86, Heylens, Rec. 1987, s. 4097, punkt 15; den 18 oktober 1989, mål 374/87, Orkem, Rec. 1989, s. 3283; den 21 november 1991, C-269/90, TU München, Rec. 1991, s. I-5469, och förstainstansrättens domar av den 6 december 1994, T-450/93, Lisrestal, Rec. 1994, s. II-1177; den 18 september 1995, T-167/94, Nölle, REG 1995, s. II-2589) samt, när det gäller skyldigheten att ge en motivering, artikel 296 i fördraget om Europeiska unionens funktionssätt (jfr också den rättsliga grunden i artikel 298 i fördraget om Europeiska unionens funktionssätt för antagande av lagstiftningsakter som främjar en öppen, effektiv och oberoende europeisk administration).

    I punkt 3 återges den rättighet som nu garanteras i artikel 340 i fördraget om Europeiska unionens funktionssätt. I punkt 4 återges den rättighet som nu garanteras i artikel 20.2 d och artikel 25 i fördraget om Europeiska unionens funktionssätt. Enligt artikel 52.2 ska dessa rättigheter gälla på de villkor och med de begränsningar som fastställs i fördragen.

    Rätten till ett effektivt rättsmedel, som utgör en viktig aspekt av denna fråga, garanteras genom artikel 47 i denna stadga.

    Preamble - Explanations relating to the Charter of Fundamental Rights:
    Förklaringarna utarbetades ursprungligen på initiativ av presidiet för det konvent som utarbetade Europeiska unionens stadga om de grundläggande rättigheterna. De har uppdaterats på initiativ av Europeiska konventets presidium mot bakgrund av de justeringar av stadgetexten som gjorts av det senare konventet (särskilt artiklarna 51 och 52) samt unionsrättens vidare utveckling. Även om förklaringarna inte i sig har rättslig status, utgör de ett värdefullt tolkningsverktyg avsett att klargöra stadgans bestämmelser.

Viittomakieltä käyttävien sekä vammaisuuden vuoksi tulkitsemis- ja käännösapua tarvitsevien oikeudet turvataan lailla. 21 § Oikeusturva Jokaisella on oikeus saada asiansa käsitellyksi asianmukaisesti ja ilman aiheetonta viivytystä lain mukaan toimivaltaisessa tuomioistuimessa tai muussa viranomaisessa sekä oikeus saada oikeuksiaan ja velvollisuuksiaan koskeva päätös tuomioistuimen tai muun riippumattoman lainkäyttöelimen käsiteltäväksi. Käsittelyn julkisuus sekä oikeus tulla kuulluksi, saada perusteltu päätös ja hakea muutosta samoin kuin muut oikeudenmukaisen oikeudenkäynnin ja hyvän hallinnon takeet turvataan lailla.

This right may be circumscribed pursuant to law to protect the rights and freedoms of others, to protect the confidentiality of a child’s filiation, and in the interests of preventing a criminal offence, apprehending the offender, or of ascertaining the truth in a criminal case.
    Unless otherwise provided by law, citizens of foreign states and stateless persons in Estonia enjoy the rights specified in paragraphs two and three of this section equally with citizens of Estonia.
    Article 46. Everyone has the right to address informational letters and petitions to government agencies, local authorities, and their officials. The procedure for responding to such letters and petitions is provided by law.

Η απόφασις της αρχής ταύτης, δεόντως ητιολογημένη, γνωστοποιείται εγγράφως αμέσως εις τον υποβαλόντα την αίτησιν ή τα παράπονα εν πάση περιπτώσει ενός προθεσμίας μη υπερβαινούσης τας τριάκοντα ημέρας.
    2. Εφ’ όσον ο ενδιαφερόμενος δεν ικανοποιείται εκ της αποφάσεως ή οσάκις ουδεμία απόφασις γνωστοποιήται προς αυτόν εντός της καθοριζομένης εν τη πρώτη παραγράφω του παρόντος άρθρου προθεσμίας δύναται ο ενδιαφερόμενος ν’ αγάγη ενώπιον αρμοδίου δικαστηρίου διά προσφυγής την υπόθεσιν, εις ην αφορά η αίτησις ή το παράπονον αυτού.
