Artikel 34 - Soziale Sicherheit und soziale Unterstützung

(1) Die Union anerkennt und achtet das Recht auf Zugang zu den Leistungen der sozialen Sicherheit und zu den sozialen Diensten, die in Fällen wie Mutterschaft, Krankheit, Arbeitsunfall, Pflegebedürftigkeit oder im Alter sowie bei Verlust des Arbeitsplatzes Schutz gewährleisten, nach Maßgabe des Unionsrechts und der einzelstaatlichen Rechtsvorschriften und Gepflogenheiten.
(2) Jeder Mensch, der in der Union seinen rechtmäßigen Wohnsitz hat und seinen Aufenthalt rechtmäßig wechselt, hat Anspruch auf die Leistungen der sozialen Sicherheit und die sozialen Vergünstigungen nach dem Unionsrecht und den einzelstaatlichen Rechtsvorschriften und Gepflogenheiten.
(3) Um die soziale Ausgrenzung und die Armut zu bekämpfen, anerkennt und achtet die Union das Recht auf eine soziale Unterstützung und eine Unterstützung für die Wohnung, die allen, die nicht über ausreichende Mittel verfügen, ein menschenwürdiges Dasein sicherstellen sollen, nach Maßgabe des Unionsrechts und der einzelstaatlichen Rechtsvorschriften und Gepflogenheiten.

    Der in Artikel 34 Absatz 1 aufgeführte Grundsatz stützt sich auf die Artikel 153 und 156 des Vertrags über die Arbeitsweise der Europäischen Union sowie auf Artikel 12 der Europäischen Sozialcharta und auf Nummer 10 der Gemeinschaftscharta der Arbeitnehmerrechte. Er ist von der Union zu wahren, wenn sie im Rahmen ihrer Zuständigkeiten nach den Artikeln 153 und 156 des Vertrags über die Arbeitsweise der Europäischen Union tätig wird. Durch den Hinweis auf die sozialen Dienste sollen die Fälle erfasst werden, in denen derartige Dienste eingerichtet wurden, um bestimmte Leistungen sicherzustellen; dies bedeutet aber keineswegs, dass solche Dienste eingerichtet werden müssen, wo sie nicht bestehen. Der Begriff `Mutterschaft` ist im Sinne des vorangehenden Artikels zu verstehen.
    Absatz 2 stützt sich auf Artikel 12 Absatz 4 und Artikel 13 Absatz 4 der Europäischen Sozialcharta sowie auf Nummer 2 der Gemeinschaftscharta der sozialen Grundrechte der Arbeitnehmer und spiegelt die Regeln wider, die sich aus den Verordnungen (EWG) Nr. 1408/71 und (EWG) Nr. 1612/68 ergeben.

    Absatz 3 lehnt sich an Artikel 13 der Europäischen Sozialcharta und die Artikel 30 und 31 der revidierten Sozialcharta sowie an Nummer 10 der Gemeinschaftscharta an. Er ist von der Union im Rahmen der Politiken zu wahren, die auf Artikel 153 des Vertrags über die Arbeitsweise der Europäischen Union beruhen.

    Die Erläuterungen wurden ursprünglich unter der Verantwortung des Präsidiums des Konvents, der die Charta der Grundrechte der Europäischen Union ausgearbeitet hat, formuliert. Sie wurden unter der Verantwortung des Präsidiums des Europäischen Konvents aufgrund der von diesem Konvent vorgenommenen Anpassungen des Wortlauts der Charta (insbesondere der Artikel 51 und 52) und der Fortentwicklung des Unionsrechts aktualisiert. Diese Erläuterungen haben als solche keinen rechtlichen Status, stellen jedoch eine nützliche Interpretationshilfe dar, die dazu dient, die Bestimmungen der Charta zu verdeutlichen.

    XIX. cikk (SZABADSÁG ÉS FELELŐSSÉG) (1) Magyarország arra törekszik, hogy minden állampolgárának szociális biztonságot nyújtson. Anyaság, betegség, rokkantság, fogyatékosság, özvegység, árvaság és önhibáján kívül bekövetkezett munkanélküliség esetén minden magyar állampolgár törvényben meghatározott támogatásra jogosult.
    (2) Magyarország a szociális biztonságot az (1) bekezdés szerinti és más rászorulók esetében a szociális intézmények és intézkedések rendszerével valósítja meg.
    (3) Törvény a szociális intézkedések jellegét és mértékét a szociális intézkedést igénybe vevő személynek a közösség számára hasznos tevékenységéhez igazodóan is megállapíthatja.
    (4) Magyarország az időskori megélhetés biztosítását a társadalmi szolidaritáson alapuló egységes állami nyugdíjrendszer fenntartásával és önkéntesen létrehozott társadalmi intézmények működésének lehetővé tételével segíti elő. Törvény az állami nyugdíjra való jogosultság feltételeit a nők fokozott védelmének követelményére tekintettel is megállapíthatja.

    XXII. cikk (SZABADSÁG ÉS FELELŐSSÉG) (1) Magyarország törekszik arra, hogy az emberhez méltó lakhatás feltételeit és a közszolgáltatásokhoz való hozzáférést mindenki számára biztosítsa.
    (2) Az emberhez méltó lakhatás feltételeinek a megteremtését az állam és a helyi önkormányzatok azzal is segítik, hogy törekszenek valamennyi hajlék nélkül élő személy számára szállást biztosítani.
    (3) Törvény vagy helyi önkormányzat rendelete a közrend, a közbiztonság, a közegészség és a kulturális értékek védelme érdekében, a közterület meghatározott részére vonatkozóan jogellenessé minősítheti az életvitelszerűen megvalósuló közterületi tartózkodást.

    Article XIX (Freedom and Responsibility) (1) Hungary shall strive to provide social security to all of its citizens. Every Hungarian citizen shall be entitled to assistance in the case of maternity, illness, invalidity, disability, widowhood, orphanage and unemployment for reasons outside of his or her control, as provided for by an Act.
    (2) Hungary shall implement social security for the persons referred to in Paragraph (1) and for others in need through a system of social institutions and measures.
    (3) The nature and extent of social measures may be determined in an Act in accordance with the usefulness to the community of the beneficiary’s activity.
    (4) Hungary shall contribute to ensuring a life of dignity for the elderly by maintaining a
    general state pension system based on social solidarity and by allowing for the operation of voluntarily established social institutions. An Act may lay down the conditions for entitlement to state pension also with regard to the requirement for stronger protection for women.

    Article XXII (Freedom and Responsibility) (1) Hungary shall strive to ensure decent housing conditions and access to public services for everyone.
    (2) The State and local governments shall also contribute to creating decent housing conditions by striving to ensure accommodation for all persons without a dwelling.
    (3) In order to protect public order, public safety, public health and cultural artefacts, an Act or a local government decree may, with respect to a specific part of public space, provide that using a public space as a habitual dwelling shall be illegal.
