34 straipsnis - Socialinė apsauga ir socialinė parama

1. Sąjunga pripažįsta ir gerbia teisę gauti socialinio draudimo pašalpas ir naudotis socialinėmis paslaugomis, suteikiančiomis apsaugą pagal Sąjungos teisės ir nacionalinių teisės aktų nustatytas taisykles ir praktiką motinystės atveju, susirgus, patyrus nelaimingą atsitikimą darbe, esant išlaikytiniu ar sulaukus senatvės, taip pat netekus darbo.
2. Kiekvienas Sąjungoje teisėtai gyvenantis ir teisėtai keičiantis gyvenamąją vietą asmuo turi teisę gauti socialines pašalpas ir naudotis socialinėmis lengvatomis pagal Sąjungos teisę ir nacionalinius teisės aktus ir praktiką.
3. Siekdama įveikti socialinę atskirtį ir skurdą, Sąjunga pripažįsta ir gerbia teisę į socialinę paramą ir paramą aprūpinant būstu, kad pagal Sąjungos teisės ir nacionalinių teisės aktų nustatytas taisykles bei praktiką būtų užtikrintos tinkamos gyvenimo sąlygos visiems neturintiems pakankamai lėšų.

    34 straipsnio 1 dalyje nustatytas principas grindžiamas Sutarties dėl Europos Sąjungos veikimo 153 ir 156 straipsniais, Europos socialinės chartijos 12 straipsniu ir Bendrijos darbuotojų teisių chartijos 10 punktu. Sąjunga privalo jo laikytis, naudodamasi jai Sutarties dėl Europos Sąjungos veikimo 153 ir 156 straipsniuose suteiktais įgaliojimais. Nuoroda į socialines paslaugas yra susijusi su atvejais, kuriais tokios paslaugos buvo įvestos, kad būtų suteiktos tam tikros lengvatos, tačiau ji nereiškia, kad tokios paslaugos turi būti sukurtos, kai jų nėra. `Motinystė` turi būti suprantama ta pačia prasme kaip ir pirmesniame straipsnyje.
    Antra dalis grindžiama Europos socialinės chartijos 12 straipsnio 4 dalimi ir 13 straipsnio 4 dalimi bei Bendrijos darbuotojų pagrindinių socialinių teisių chartijos 2 punktu ir atspindi iš Reglamento Nr. 1408/71/EEB ir Reglamento Nr. 1612/68/EEB atsirandančias taisykles.

    Trečia dalis remiasi Europos socialinės chartijos 13 straipsniu, peržiūrėtos Socialinės chartijos 30 ir 31 straipsniais bei Bendrijos chartijos 10 punktu. Sąjunga privalo jos laikytis vykdydama Sutarties dėl Europos Sąjungos veikimo 153 straipsniu grindžiamą politiką.

    Preamble - Explanations relating to the Charter of Fundamental Rights:
    Šie išaiškinimai buvo pirmą kartą parengti prižiūrint Europos Sąjungos pagrindinių teisių chartiją rengusio Konvento prezidiumui. Jie buvo atnaujinti Europos konvento prezidiumo atsakomybe, atsižvelgiant į Konvento įvestas Chartijos teksto projekto pataisas (ypač 51 ir 52 straipsnių) ir kitus Sąjungos teisės pakeitimus. Nors išaiškinimai neturi teisinės galios, jie yra svarbi Chartijos nuostatoms išaiškinti skirta aiškinimo priemonė.

    XIX. cikk (SZABADSÁG ÉS FELELŐSSÉG) (1) Magyarország arra törekszik, hogy minden állampolgárának szociális biztonságot nyújtson. Anyaság, betegség, rokkantság, fogyatékosság, özvegység, árvaság és önhibáján kívül bekövetkezett munkanélküliség esetén minden magyar állampolgár törvényben meghatározott támogatásra jogosult.
    (2) Magyarország a szociális biztonságot az (1) bekezdés szerinti és más rászorulók esetében a szociális intézmények és intézkedések rendszerével valósítja meg.
    (3) Törvény a szociális intézkedések jellegét és mértékét a szociális intézkedést igénybe vevő személynek a közösség számára hasznos tevékenységéhez igazodóan is megállapíthatja.
    (4) Magyarország az időskori megélhetés biztosítását a társadalmi szolidaritáson alapuló egységes állami nyugdíjrendszer fenntartásával és önkéntesen létrehozott társadalmi intézmények működésének lehetővé tételével segíti elő. Törvény az állami nyugdíjra való jogosultság feltételeit a nők fokozott védelmének követelményére tekintettel is megállapíthatja.

    XXII. cikk (SZABADSÁG ÉS FELELŐSSÉG) (1) Magyarország törekszik arra, hogy az emberhez méltó lakhatás feltételeit és a közszolgáltatásokhoz való hozzáférést mindenki számára biztosítsa.
    (2) Az emberhez méltó lakhatás feltételeinek a megteremtését az állam és a helyi önkormányzatok azzal is segítik, hogy törekszenek valamennyi hajlék nélkül élő személy számára szállást biztosítani.
    (3) Törvény vagy helyi önkormányzat rendelete a közrend, a közbiztonság, a közegészség és a kulturális értékek védelme érdekében, a közterület meghatározott részére vonatkozóan jogellenessé minősítheti az életvitelszerűen megvalósuló közterületi tartózkodást.

    Article XIX (Freedom and Responsibility) (1) Hungary shall strive to provide social security to all of its citizens. Every Hungarian citizen shall be entitled to assistance in the case of maternity, illness, invalidity, disability, widowhood, orphanage and unemployment for reasons outside of his or her control, as provided for by an Act.
    (2) Hungary shall implement social security for the persons referred to in Paragraph (1) and for others in need through a system of social institutions and measures.
    (3) The nature and extent of social measures may be determined in an Act in accordance with the usefulness to the community of the beneficiary’s activity.
    (4) Hungary shall contribute to ensuring a life of dignity for the elderly by maintaining a
    general state pension system based on social solidarity and by allowing for the operation of voluntarily established social institutions. An Act may lay down the conditions for entitlement to state pension also with regard to the requirement for stronger protection for women.

    Article XXII (Freedom and Responsibility) (1) Hungary shall strive to ensure decent housing conditions and access to public services for everyone.
    (2) The State and local governments shall also contribute to creating decent housing conditions by striving to ensure accommodation for all persons without a dwelling.
    (3) In order to protect public order, public safety, public health and cultural artefacts, an Act or a local government decree may, with respect to a specific part of public space, provide that using a public space as a habitual dwelling shall be illegal.
