50. cikk - A kétszeres eljárás alá vonás és a kétszeres büntetés tilalma

Senki sem vonható büntetőeljárás alá és nem büntethető olyan bűncselekményért, amely miatt az Unióban a törvénynek megfelelően már jogerősen felmentették vagy elítélték.

    Az EJEE hetedik kiegészítő jegyzőkönyvének 4. cikke a következő:

    `1. Ha valakit egy állam büntető törvényének és büntető eljárási törvényének megfelelően egy bűncselekmény kapcsán már jogerősen felmentettek vagy elítéltek, e személlyel szemben ugyanennek az államnak az igazságszolgáltatási szervei ugyane bűncselekmény miatt nem folytathatnak büntető eljárást, és vele szemben abban büntetést nem szabhatnak ki.

    2. Az előző bekezdés rendelkezései nem képezik akadályát annak, hogy az adott állam büntető törvényeinek és büntető eljárási törvényeinek megfelelően az eljárást újból megindítsák, ha új, vagy újólag feltárt tények, vagy az eljárás alapvető hibái természetüknél fogva kihatással vannak a meghozott ítéletre.

    3. A jelen cikk rendelkezéseitől az Egyezmény 15. cikkére hivatkozással nem lehet eltérni`.

    Az uniós jog alkalmazza a non bis in idem elvét (számos precedens közül lásd: a Bíróságnak a 18/65 és 35/65. sz. Gutman kontra Bizottság ügyben 1996. május 5-én hozott ítéletét EHBT 1996., 103. o.], illetve egy későbbi ügyben az Elsőfokú Bíróságnak a T-305/94. sz. és más, Limburgse Vinyl Maatschappij NV kontra Bizottság egyesített ügyekben 1999. április 20-án hozott ítéletét [EHBT 1999., II-931. o.]). Az anyagi halmazatot tiltó szabály két azonos természetű, azaz büntetőjogi szankció halmazatára vonatkozik.

    Az 50. cikknek megfelelően a non bis in idem elve nem csak egy adott állam joghatóságán belül, hanem több tagállam joghatósága között is érvényesül. Ez megfelel az uniós jog vívmányainak; lásd a Schengeni Egyezmény 54. és 58. cikkét, a Bíróságnak a C-187/01. sz. Gözütok-ügyben 2003. február 11-én hozott ítéletét (EBHT 2003., I-1345. o.), valamint az Európai Közösségek pénzügyi érdekeinek védelméről szóló egyezmény 7. cikkét és a korrupcióellenes küzdelemről szóló egyezmény 10. cikkét. Az említett egyezményekben foglalt rendkívül korlátozott számú kivételt, amely lehetővé teszi a tagállamok számára a non bis in idem elvétől való eltérést, a Charta 52. cikke (1) bekezdésének korlátozásokra vonatkozó horizontális záradéka határozza meg. A hetedik kiegészítő jegyzőkönyv 4. cikkében említett helyzetet illetően, vagyis az elvnek ugyanazon tagállamon belüli alkalmazását illetően, a biztosított jognak az EJEE-ben foglalt megfelelő joggal azonos a tartalma és terjedelme.

    Az alábbi magyarázatok eredetileg az Európai Unió Alapjogi Chartáját kidolgozó Konvent elnökségének irányításával kerültek megfogalmazásra. A magyarázatok naprakésszé tétele az Európai Konvent elnökségének felelőssége mellett, az elnökségnek a Charta szövegéhez (nevezetesen az 51. és 52. cikkéhez) tett kiigazításainak megfogalmazása, valamint az uniós jog további fejlődése fényében történt. Bár a magyarázatok nem bírnak jogi erővel, az értelmezés értékes eszközei, amelyek célja a Charta rendelkezéseinek megvilágítása.
