    Key facts of the case: 

    The case concerns a petition for cassation before the Grand Chamber of the Court of Auditors against a decision issued by one of its Chambers. The decision validated an administrative act which ordered the petitioner to return to the State the amount of 66.230,10 Euros (plus 12.373,74 Euros in interest), a portion of the funding he received from the European Structural and Investment Funds – Regional Operational Programme for the South Aegean (2000-2006) to implement his investment plan titled “Furnished touristic residences complex and agrotourism activities”.

    The funds concerned nine (9) invoices issued to the petitioner by a private enterprise which was found to be “operationally non-existent” (it had never engaged any staff, submitted VAT or other relevant declarations, etc.). The Financial Crime Investigation Unit which performed an audit at the premises of said enterprise, concluded that the transactions described in the invoices never took place and declared the invoices as false. The audit also concluded that the petitioner was in bad faith when receiving the invoices.

    In between the Chamber’s decision and the discussion of the petition for cassation at the Grand Chamber, a decision was issued by a criminal court (rendered final by the time of the Grand Chamber’s deliberation), acquitting the petitioner of the crime of aggravated fraud against the Greek State and against the European Union.  

     

    Key legal question raised by the Court: 

    The key legal question raised was whether the Court of Auditors should take into account the criminal court’s acquitting decision, in light of the fact that it was issued after the publication of the Chamber decision complained against.

     

    Outcome of the case: 

    The Court first observed that the addressing the presumption of innocence issue raised by the petitioner was a matter of substance. Therefore, in accordance with the Court of Auditors statute, it could not be examined by the Grand Chamber when adjudicating a petition for cassation, which only deals with matters of interpretation and application of the law. It, therefore, found this claim to be inadmissible.

    Nevertheless, the Court underscored that it had obligation to interpret and apply domestic rules in a manner which safeguards the effectiveness of EU law and the direct effect of the parties’ rights as established in it. To resolve this apparent conflict, the Court decided to interpret the ground for cassation in question as a ground for revision, another remedy which allows for the revision of chamber decisions on substantive grounds occurring after a decision is issued. The Court found that this interpretation adequately guaranteed the rights of the petitioner and safeguarded the effectiveness of EU law. It thus reverted the case to the Chamber to rule on the petitioner’s presumption of innocence.

    It should be noted that there also was a strong dissent, expressing the view that the relevant ground should have been examined as part of the cassation proceedings, in contravention to the letter of the domestic law, and not as part of separate review procedure. The dissenting Judges found that this path would best safeguard the rights enshrined in art. 6.2 ECHR and 20 of the Greek Constitution.

    40. Article 6 TFEU provides that '1. The Union recognizes the rights, freedoms and principles contained in the Charter of Fundamental Rights of the European Union of 7 December 2000, as amended on 12 December 2007, in Strasbourg, which has the same legal force as the Treaties. (...) 3. Fundamental rights, as enshrined in the European Convention for the Protection of Human Rights and Fundamental Freedoms and as a result of the common constitutional traditions of the Member States, are part of the general principles of Union law. " .

    41. In addition, Article 48 (1) of the Charter of Fundamental Rights of the European Union states: "Every accused person shall be presumed innocent until proved guilty according to law." Furthermore, article 51 par. 1 of the Charter stipulates: “1. The provisions of this Charter are addressed to the institutions and bodies of the Union as well as to the Member States, only when they apply Union law. Consequently, they respect the rights, respect the principles and promote their implementation in accordance with their respective competences and within the limits of the competences of the Union, as conferred by the Treaties. (.) ». Article 52 of the Charter provides: '1. Any restriction on the exercise of the rights and freedoms recognized in this Charter must be provided for by law and respect the basic content of those rights and freedoms. Subject to the principle of proportionality, restrictions may be imposed only if they are necessary and in fact meet objectives of general interest recognized by the Union or the need to protect the rights of third parties. 2. The rights recognized by this Charter which are the subject of the provisions of the Treaties shall be exercised under the conditions and within the limits set out therein. 3. To the extent that this Charter includes rights corresponding to rights guaranteed in the European Convention for the Protection of Human Rights and Fundamental Freedoms, their meaning and scope shall be the same as those conferred on them by this Convention. This provision does not preclude Union law from providing wider protection. (.) ». Finally, the Charter in Article 53 reads as follows: “No provision of this Charter shall be construed as limiting or prejudicial to the human rights and fundamental freedoms recognized in the respective fields of application of Union law, international law and from the international conventions to which the Union or all the Member States are parties, and in particular from the European Convention for the Protection of Human Rights and Fundamental Freedoms, as well as from the Constitutions of the Member States ". It follows from the above provisions that when a legal relationship or situation falls within the scope of EU law then the fundamental rights enshrined in the Charter must be respected (CJEU decision of 8.5.2019, C-230/2018, PI, p. 63 , CJEU decision of 21.12.2016, C-201/2015, AGET Iraklis, sk, 62, CJEU decision of 26.2.2013, C-617/2010, Hans Akerberg Fransson, sk. 19-23, CJEU decision of 15.11.2011 , C-256/2011, Murat Dereci, p. 71).

    43. It follows from the provisions set out in paragraphs 40 to 42 that the presumption of innocence enshrined in Article 48 (1) of the Charter of Fundamental Rights of the European Union and Article 6 (2) of the European Convention for the Protection of Human Rights Human Rights and Fundamental Freedoms, demands that the acquittal of the accused by an irrevocable decision be respected in any subsequent court proceedings, criminal or not, which is relevant or ancillary to the criminal trial (ELS Ol. 271/2019 sk. 6, 124/2017 sk. 4 and 6). Therefore, reasons of a later court decision with which the acquittal result is questioned, violate the presumption of innocence (decision of the ECtHR of 27.9.2007, Vassilios Stavropoulos v. Greece, p. 35, decision of the ECtHR of 30.4.2015, Kapetanios etc. Hellas, p. 85, cf. CJEU decision of 20.3.2018, C-596/2016, Enzo di Puma, p. 42-44). The mere expression of suspicion in the ancillary proceedings concerning the guilt of the irrevocably acquitted infringes Article 6 .2 2 of the ECHR United Kingdom, fig. 19).

    40. Στο άρθρο 6 ΣΛΕΕ ορίζεται: «1. Η ένωση αναγνωρίζει τα δικαιώματα, τις ελευθερίες και τις αρχές που περιέχονται στον Χάρτη των Θεμελιωδών Δικαιωμάτων της Ευρωπαϊκής Ένωσης της 7ης Δεκεμβρίου 2000, όπως προσαρμόσθηκε στις 12 Δεκεμβρίου 2007, στο Στρασβούργο, ο οποίος έχει το ίδιο νομικό κύρος με τις Συνθήκες. (...) 3. Τα θεμελιώδη δικαιώματα, όπως κατοχυρώνονται από την Ευρωπαϊκή Σύμβαση για την Προάσπιση των Δικαιωμάτων του Ανθρώπου και των Θεμελιωδών Ελευθεριών και όπως απορρέουν από τις κοινές συνταγματικές παραδόσεις των κρατών μελών, αποτελούν μέρος των γενικών αρχών του δικαίου της Ένωσης».

    41. Εξ άλλου, στο άρθρο 48 παρ. 1 του Χάρτη των Θεμελιωδών Δικαιωμάτων της Ευρωπαϊκής Ένωσης ορίζεται: «Κάθε κατηγορούμενος τεκμαίρεται ότι είναι αθώος μέχρι αποδείξεως της ενοχής του σύμφωνα με τον νόμο». Περαιτέρω, στο άρθρο 51 παρ. 1 του Χάρτη ορίζεται: «1. Οι διατάξεις του παρόντος Χάρτη απευθύνονται στα θεσμικά και λοιπά όργανα και τους οργανισμούς της Ένωσης (.) καθώς και στα κράτη μέλη, μόνον όταν εφαρμόζουν το δίκαιο της Ένωσης. Κατά συνέπεια, οι ανωτέρω σέβονται τα δικαιώματα, τηρούν τις αρχές και προάγουν την εφαρμογή τους σύμφωνα με τις αντίστοιχες αρμοδιότητές τους και εντός των ορίων των αρμοδιοτήτων της Ένωσης, όπως απονέμονται από τις Συνθήκες. (.)». Στο άρθρο 52 του Χάρτη ορίζονται τα εξής: «1. Κάθε περιορισμός στην άσκηση των δικαιωμάτων και ελευθεριών που αναγνωρίζονται στον παρόντα Χάρτη πρέπει να προβλέπεται από τον νόμο και να σέβεται το βασικό περιεχόμενο των εν λόγω δικαιωμάτων και ελευθεριών. Τηρουμένης της αρχής της αναλογικότητας, περιορισμοί επιτρέπεται να επιβάλλονται μόνον εφόσον είναι αναγκαίοι και ανταποκρίνονται πραγματικά σε στόχους γενικού ενδιαφέροντος που αναγνωρίζει η Ένωση ή στην ανάγκη προστασίας των δικαιωμάτων των τρίτων. 2. Τα δικαιώματα που αναγνωρίζονται από τον παρόντα Χάρτη και τα οποία αποτελούν αντικείμενο διατάξεων των Συνθηκών ασκούνται υπό τους όρους και εντός των ορίων που καθορίζονται σε αυτές. 3. Στο βαθμό που ο παρών Χάρτης περιλαμβάνει δικαιώματα που αντιστοιχούν σε δικαιώματα τα οποία διασφαλίζονται στην Ευρωπαϊκή Σύμβαση για την Προάσπιση των Δικαιωμάτων του Ανθρώπου και των Θεμελιωδών Ελευθεριών, η έννοια και η εμβέλειά τους είναι ίδιες με εκείνες που τους αποδίδει η εν λόγω Σύμβαση. Η διάταξη αυτή δεν εμποδίζει το δίκαιο της Ένωσης να παρέχει ευρύτερη προστασία. (.)». Τέλος, ο Χάρτης στο άρθρο 53 διαλαμβάνει τα ακόλουθα: «Καμία διάταξη του παρόντος Χάρτη δεν πρέπει να ερμηνεύεται ως περιορίζουσα ή θίγουσα τα δικαιώματα του ανθρώπου και τις θεμελιώδεις ελευθερίες που αναγνωρίζονται στα αντίστοιχα πεδία εφαρμογής από το δίκαιο της Ένωσης, το διεθνές δίκαιο καθώς και από τις διεθνείς συμβάσεις, στις οποίες είναι μέρη η Ένωση ή όλα τα κράτη μέλη, και ιδίως από την Ευρωπαϊκή Σύμβαση για την Προάσπιση των Δικαιωμάτων του Ανθρώπου και των θεμελιωδών ελευθεριών, καθώς και από τα Συντάγματα των κρατών μελών». Από τις ανωτέρω διατάξεις συνάγεται ότι όταν μία έννομη σχέση ή κατάσταση εμπίπτει στο πεδίο εφαρμογής του ενωσιακού δικαίου τότε τα θεμελιώδη δικαιώματα που κατοχυρώνονται στον Χάρτη πρέπει να γίνονται σεβαστά (απόφαση ΔΕΕ της 8.5.2019, C-230/2018, PI, σκ. 63, απόφαση ΔΕΕ της 21.12.2016, C-201/2015, ΑΓΕΤ Ηρακλής, σκ, 62, απόφαση ΔΕΕ της 26.2.2013, C-617/2010, Hans Akerberg Fransson, σκ. 19¬23, απόφαση ΔΕΕ της 15.11.2011, C-256/2011, Murat Dereci, σκ. 71).

    43. Από τις διατάξεις που εκτέθηκαν στις σκέψεις 40 έως 42 συνάγεται ότι το τεκμήριο αθωότητας, που κατοχυρώνεται στο άρθρο 48 παρ. 1 του Χάρτη των Θεμελιωδών Δικαιωμάτων της Ευρωπαϊκής Ένωσης και το άρθρο 6 παρ. 2 της Ευρωπαϊκής Σύμβασης για την Προστασία των Δικαιωμάτων του Ανθρώπου και των Θεμελιωδών Ελευθεριών, αξιώνει όπως η αθώωση κατηγορουμένου με αμετάκλητη απόφαση γίνει σεβαστή σε κάθε μεταγενέστερη δικαστική διαδικασία, ποινική ή μη, η οποία είναι συναφής ή παρεπόμενη της ποινικής δίκης (ΕλΣ Ολ. 271/2019 σκ. 6, 124/2017 σκ. 4 και 6). Συνεπώς, αιτιολογίες μεταγενέστερης δικαστικής απόφασης με τις οποίες τίθεται εν αμφιβόλω το αθωωτικό αποτέλεσμα, παραβιάζουν το τεκμήριο αθωότητας (απόφαση ΕΔΔΑ της 27.9.2007, Βασίλειος Σταυρόπουλος κατά Ελλάδος, σκ. 35, απόφαση ΕΔΔΑ της 30.4.2015, Καπετάνιος κ.λπ. κατά Ελλάδος, σκ. 85, πρβ. απόφαση ΔΕΕ της 20.3.2018, C-596/2016, Enzo di Puma, σκ. 42-44). Η έκφραση απλώς και μόνον υποψίας στην παρεπόμενη δίκη σχετικά με την ενοχή του αμετακλήτως αθωωθέντος παραβιάζει το άρθρο 6 παρ.2 της ΕΣΔΑ (αποφάσεις ΕΔΔΑ, της 25.8.1993, Sekanina κατά Αυστρίας, σκ. 30 και της 7.3.2006, Yassar Hussain κατά Ηνωμένου Βασιλείου, σκ. 19).
