The European Union Agency for Fundamental Rights (FRA or the Agency) is looking to identify economic operators for the provision of stationery and office supplies to the Agency.

The procedure will result in the conclusion of multiple framework contracts in cascade with 3 contractors at most provided that there are enough tenderers that have access to the procurement,  are not excluded, satisfy the selection and award criteria, and comply with the Tender specifications.

The indicative volume of the contract has been estimated at 110,000.00 EUR for four years excluding VAT.

These volumes are estimates only and there is no commitment as to the exact quantities to be ordered. The actual volumes will depend on the quantities which the Agency will order through specific contracts. In any case the framework contract ceiling, i.e. the maximum amount to be spent under the framework contract, shall not be exceeded.

Economic and financial capacity

Candidates must have the necessary economic and financial capacity to perform this contract until its end. In order to prove their capacity, candidates must comply with the following selection criteria:

(a)  Copy of the financial statements (balance sheets, and profit and loss accounts) for the last two (2) financial years for which accounts have been closed. In case of a consortium, each consortium member shall present their own financial statements.

(b)  A statement of the annual average turnover for the last two (2) financial years for which accounts have been closed. The minimum average annual turnover of the tenderer shall be of 55,000.00 EUR. In case of a consortium, the annual average turnover for each of the partners shall be presented. The sum of the annual average turnovers of each partner will be taken into account to reach the minimum annual average turnover of 55,000.00 EUR.

Technical and professional capacity

Candidates (in case of a joint tender the combined capacity of all members of the group and identified subcontractors) must comply with the criteria listed below: 

(a)      A list of the principal services provided in the past three (3) years. Tenderers are required to prove that they have provided similar services to at least three clients of an amount/nature or scope similar to the services to be carried out under this contract.

In case the contract is awarded to the candidate, the Contracting authority may request, before contract signature, statements issued by the clients as supporting documents for each project reference.

An economic operator may, where appropriate and for a particular contract, rely on the technical and professional capacities of other entities, regardless of the legal nature of the links it has with them. It must in that case prove to the contracting authority that it will have at its disposal the resources necessary for the performance of the contract, for example by producing a commitment by those entities to that effect.

No documents proving the fulfilment of these criteria are requested at this stage.

Participation in this negotiated procedure for a middle value contract is open to natural and legal persons falling within the scope of the EU Treaties (this includes all economic operators established in the European Union) and to all natural and legal persons established in a third country which has a special agreement with the Union in the field of public procurement on the conditions laid down in that agreement. FRA is not part of the Agreement on Government Procurement (GPA) concluded within the World Trade Organisation. Therefore, the procurement procedure is not open to candidates from GPA countries.
