Η ραγδαία ανάπτυξη της τεχνολογίας των πληροφοριών έχει επιτείνει την ανάγκη για ισχυρή προστασία των δεδομένων προσωπικού χαρακτήρα. Το δικαίωμα στην εν λόγω προστασία διασφαλίζεται μέσω νομικών πράξεων τόσο της Ευρωπαϊκής Ένωσης (ΕΕ), όσο και του Συμβουλίου της Ευρώπης. Η διασφάλιση του σημαντικού αυτού δικαιώματος συνεπάγεται νέες και σημαντικές προκλήσεις, καθώς οι τεχνολογικές εξελίξεις επεκτείνουν τα όρια πεδίων όπως η παρακολούθηση, η υποκλοπή επικοινωνιών και η αποθήκευση δεδομένων. Το παρόν εγχειρίδιο έχει σχεδιαστεί κατά τέτοιον τρόπο ώστε να βοηθήσει τους επαγγελματίες του νομικού κλάδου που δεν είναι ειδικευμένοι στον τομέα της προστασίας δεδομένων να εξοικειωθούν με το αναδυόμενο αυτό πεδίο του δικαίου.

Οι προκλήσεις που αντιμετωπίζουν οι οργανώσεις της κοινωνίας των πολιτών που δραστηριοποιούνται στον τομέα των ανθρωπίνων δικαιωμάτων στην ΕΕ - Σύνοψη

Οι οργανώσεις της κοινωνίας των πολιτών στην Ευρωπαϊκή Ένωση διαδραματίζουν σημαντικό ρόλο στην προαγωγή των θεμελιωδών δικαιωμάτων, όμως νομικοί και πρακτικοί
περιορισμοί δυσχεραίνουν την επίτευξη του στόχου αυτού. Μολονότι σε όλα τα κράτη μέλη της ΕΕ υφίστανται προκλήσεις, η ακριβής φύση και η έκτασή τους ποικίλλουν. Σε
γενικές γραμμές, για το θέμα αυτό δεν υφίστανται επαρκή στοιχεία ούτε επαρκής έρευνα –περιλαμβανομένης της συγκριτικής έρευνας.
Ως εκ τούτου, η έκθεση του FRA εξετάζει την τυπολογία και τα ιδιαίτερα χαρακτηριστικά των προκλήσεων που αντιμετωπίζουν οι οργανώσεις της κοινωνίας των πολιτών που δραστηριοποιούνται στον τομέα των ανθρωπίνων δικαιωμάτων στην ΕΕ. Επισημαίνει επίσης ελπιδοφόρες πρακτικές για την αντιμετώπιση των ανησυχητικών αυτών φαινομένων.

Παρακολούθηση από τις υπηρεσίες πληροφοριών: εγγυήσεις και μέσα έννομης προστασίας των θεμελιωδών δικαιωμάτων στην Ευρωπαϊκή Ένωση - Τόμος ΙΙ - Σύνοψη

Ενόψει των εντεινόμενων απειλών της τρομοκρατίας, των επιθέσεων στον κυβερνοχώρο και των εξελιγμένων διασυνοριακών εγκληματικών δικτύων, το έργο των υπηρεσιών πληροφοριών έχει αποκτήσει πιο επείγοντα, σύνθετο και διεθνή χαρακτήρα. Το έργο αυτό μπορεί να επέμβει σε μεγάλο βαθμό στα θεμελιώδη δικαιώματα, ιδίως στο δικαίωμα της ιδιωτικής ζωής και της προστασίας των δεδομένων. Αν και οι συνεχείς τεχνολογικές εξελίξεις πιθανώς επιδεινώνουν τον κίνδυνο τέτοιου είδους παρεμβάσεων, η ύπαρξη αποτελεσματικών μέσων εποπτείας και έννομης προστασίας μπορεί να περιορίσει την πιθανότητα παραβιάσεων.

This second volume, ‘Surveillance by intelligence services: fundamental rights safeguards and remedies in the EU’, explores legal changes since the first volume in 2015 and how these laws are applied in practice. It is based on data from all EU Member States on the legal framework governing surveillance and complemented by field research in seven Member States: Belgium, France, Germany, Italy, the Netherlands, Sweden and the UK. This involved more than 70 interviews with a range of stakeholders related to surveillance. These included overseers and controllers from the executive, indedepent expert bodies, parliamentary committees, the judiciary and actors from the civil society. Data retention across the EU

In 2006 the EU issued its Data Retention Directive. According to the Directive, EU Member States had to store electronic telecommunications data for at least six months and at most 24 months for investigating, detecting and prosecuting serious crime. In 2016, with an EU legal framework on data retention still lacking, the CJEU further clarified what safeguards are required for data retention to be lawful.This paper looks at amendments to national data retention laws in 2016 after the Digital Rights Ireland judgment.

Scope of the principle of non-refoulement in contemporary border management: evolving areas of law

EU Member States are increasingly involved in border management activities on the high seas, within – or i cooperation with – third countries, and at the EU’s borders. Such activities entail risks of violating the principle of non-refoulement, the cornerstone of the international legal regime for the protection of refugees, which prohibits returning individuals to a risk of persecution. This report aims to encourage fundamental-rights compliant approaches to border management, including by highlighting potential grey areas.
