    Key facts of the case:

    The applicant challenged the constitutionality of Articles 33 par. (2) and Art. 39 par. (2) of Government Emergency Ordinance no. 80/2013 on court stamp duties ( art. 33 alin. (2) și art. 39 alin. (2) teza întâi din Ordonanța de urgență a Guvernului nr. 80/2013 privind taxele judiciare de timbre) by which applicants are allowed to challenge stamp duties established by courts. If applicants want to challenge stamp duties the procedure by which they do this is not public, a judge decided upon this request in a procedure which is not public, without having to summon the parties to the case. The applicant claims this procedure is unconstitutional because it goes against the right to a fair trial.

    The case looks at whether the procedure by which an applicant contests the application of stamp duties be public, and should applicants be summoned and allowed to present their arguments in a confrontational manner.

    The Constitutional Court stated that the procedure by which applicants can challenge the application of stamp duties is constitutional even if it is not public.

    23. With regard to the questions of unconstitutionality in regards to the provisions of the Convention for the Protection of Human Rights and Fundamental Freedoms and to the Charter of Fundamental Rights of the European Union, the Constitutional Court, by Decision no. 276 of May 4, 2017, published in the Official Gazette of Romania, Part I, no. 660 of 10 August 2017, paragraphs 24 and 25, pointed out, in respect to the provisions of Art. 47 on the right to an effective remedy and a fair trial in the Charter of Fundamental Rights of the European Union, that in the case-law of the Court of Justice of the European Union, for example judgment of 22 December 2010 in Case C-279/09, DEB Deutsche Energiehandels und Beratungsgesellschaft mbH against the Bundesrepublik Deutschland, paragraph 35, it was stated that, according to Art. 52 par. (3) of the Charter, insofar as it contains rights corresponding to those guaranteed by the Convention for the Protection of Human Rights and Fundamental Freedoms, their meaning and scope are the same as those provided for in that Convention. According to the explanation of that provision, the meaning and extent of the rights guaranteed are established not only by the text of the Convention but also by the case law of the European Court of Human Rights. Art. 52 para. (3), the second sentence of the Charter provides that the first sentence of the same paragraph does not prevent Union law from granting broader protection. Therefore, as regards the content of the right to an effective remedy and to a fair trial under Art. 47 of the Charter, the Court of Justice held, in its judgment of 26 February 2013 in Case C-311/11 - Stefano Melloni v Ministerio Fiscal, paragraph 50, that it corresponds to the content recognized by the case-law of the European Court of Human Rights, rights guaranteed by art. 6 para. 1 and 3 of the Convention for the Protection of Human Rights and Fundamental Freedoms (see judgments of the European Court of Human Rights of 14 June 2001, 1 March 2006 and 24 April 2012 in Medenica v. Switzerland, paragraphs 56-59, Sejdovic v. Italy, paragraphs 84, 86 and 98, and Haralampiev v. Bulgaria, paragraphs 32 and 33). The Court has held that these considerations of principle are applicable to constitutional review insofar as it ensures, guarantees and develops constitutional provisions in the field of fundamental rights, in other words, to the extent that their level of protection is at least at constitutional level in human rights (see, in this respect, Decisions 872 and 874 of 25 June 2010, published in the Official Gazette of Romania, Part I, No 433 of 28 June 2010, and Decision No 4 of 18 January 2011, published in the Official Gazette of Romania, Part I, No. 194 of 21 March 2011). Consequently, in view of the above, as well as the fact that, according to art. 21 par. (3) of the Constitution, the national protection standard in the analysed matter is superior to that provided by art. 6 of the Convention for the Protection of Human Rights and Fundamental Freedoms, the Court, with reference to Art. 47 of the Charter, found that there was no reason to reconsider its conclusions regarding the constitutionality of the provisions of Art. 39 par. (2) of Government Emergency Ordinance no. 80/2013.

    23. Referitor la raportarea criticii de neconstituționalitate la prevederile Convenției pentru apărarea drepturilor omului și a libertăților fundamentale și la cele ale Cartei drepturilor fundamentale a Uniunii Europene, Curtea Constituțională, prin Decizia nr. 276 din 4 mai 2017, publicată în Monitorul Oficial al României, Partea I, nr. 660 din 10 august 2017, paragrafele 24 și 25, a arătat, în ceea ce privește invocarea prevederilor art. 47 privind dreptul la o cale de atac eficientă și la un proces echitabil din Carta drepturilor fundamentale a Uniunii Europene, că, în jurisprudența Curții de Justiție a Uniunii Europene, spre exemplu Hotărârea din 22 decembrie 2010, pronunțată în Cauza C-279/09 - DEB Deutsche Energiehandels und Beratungsgesellschaft mbH împotriva Bundesrepublik Deutschland, paragraful 35, s-a statuat că, potrivit art. 52 alin. (3) din Cartă, în măsura în care aceasta conține drepturi ce corespund celor garantate prin Convenția pentru apărarea drepturilor omului și a libertăților fundamentale, înțelesul și întinderea lor sunt aceleași ca și cele prevăzute de această convenție. Potrivit explicației aferente acestei dispoziții, înțelesul și întinderea drepturilor garantate sunt stabilite nu numai prin textul Convenției, ci și, în special, prin jurisprudența Curții Europene a Drepturilor Omului. Art. 52 alin. (3) teza a doua din Cartă prevede că prima teză a aceluiași alineat nu împiedică dreptul Uniunii să confere o protecție mai largă. Așadar, în ceea ce privește conținutul dreptului la o cale de atac efectivă și la un proces echitabil prevăzut de art. 47 din Cartă, Curtea de la Luxemburg a reținut, prin Hotărârea din 26 februarie 2013, pronunțată în Cauza C-311/11 - Stefano Melloni împotriva Ministerio Fiscal, paragraful 50, că acesta corespunde conținutului pe care jurisprudența Curții Europene a Drepturilor Omului îl recunoaște drepturilor garantate de art. 6 paragrafele 1 și 3 din Convenția pentru apărarea drepturilor omului și a libertăților fundamentale (a se vedea hotărârile Curții Europene a Dreptului Omului din 14 iunie 2001, 1 martie 2006 și 24 aprilie 2012, pronunțate în cauzele Medenica împotriva Elveției, paragrafele 56-59, Sejdovic împotriva Italiei, paragrafele 84, 86 și 98, și Haralampiev împotriva Bulgariei, paragrafele 32 și 33). Curtea a reținut că aceste considerente de principiu sunt aplicabile în controlul de constituționalitate în măsura în care asigură, garantează și dezvoltă prevederile constituționale în materia drepturilor fundamentale, cu alte cuvinte, în măsura în care nivelul lor de protecție este cel puțin la nivelul normelor constituționale în domeniul drepturilor omului (a se vedea în acest sens deciziile nr. 872 și 874 din 25 iunie 2010, publicate în Monitorul Oficial al României, Partea I, nr. 433 din 28 iunie 2010, și Decizia nr. 4 din 18 ianuarie 2011, publicată în Monitorul Oficial al României, Partea I, nr. 194 din 21 martie 2011). În consecință, având în vedere cele menționate mai sus, precum și faptul că, potrivit art. 21 alin. (3) din Constituție, standardul național de protecție în materia analizată este superior celui oferit de art. 6 din Convenția pentru apărarea drepturilor omului și a libertăților fundamentale, Curtea, cu referire la art. 47 din Cartă, a constatat că nu există motive pentru a reconsidera concluziile sale referitoare la constituționalitatea dispozițiilor art. 39 alin. (2) din Ordonanța de urgență a Guvernului nr. 80/2013.
