    Key facts of the case: 

    The applicant requested the annulment of joint ministerial decision Υ4α/οικ.80672/27.8.2013 (OG Β/2123/28.8.2013) of the Minister of Administrative Reform and e Governance and the Minister of Health and any other relevant adimistrative action or omission. The Ministerial Decision in question abolished 1.665 positions of nursing, administrative, technical and medical staff of units in three health regions of the country. The applicants claimed that the decision was issued without respect for due process provided for by the law which required the prior evaluation of structures and staffing plans. 

    Outcome of the case: 

    The Court rejected the application decidinf that the abolition of staff positions is not contrary to national and European law. The Courtdecided that in the redistribution of positions and staff otganisational and functional needs of the administrative units (health regions) were taken into account.

    14… the abolition of staff positions in nursing units is not contrary to the constitutional provisions brought forward by the applicant (art. 5 par. 5 and 21 par. 3), the law of the European Union (art. 9 and 168 of the Treaty on the Functioning of the European Union – former art. 3 and 152 of the Treaty establishing the European Economic Community – art. 35 of the Charter of Fundamental Rights) and the European Convention of Human Rights (art. 2). The provision in question is not contrary to the other international texts and provisions that the applicants refer to (art. 11 and 13 of the European Social Charter ratified by law 1426/1984, OG Α' 32, art. 25 par. 1 of the Universal Declaration of Human Rifhts of the United Nations of 1948), independently of the legal and binding nature of each of these provisions, that is, if they are binding rules to be directly applied by national courts.

    14… η επίμαχη κατάργηση θέσεων προσωπικού νοσηλευτικών μονάδων δεν αντίκειται στις επικαλούμενες από την αιτούσα διατάξεις του Συντάγματος (άρθρα 5 παρ. 5 και 21 παρ. 3), του δικαίου της Ευρωπαϊκής Ένωσης (άρθρα 9 και 168 της Συνθήκης για τη Λειτουργία της Ευρωπαϊκής Ένωσης - πρώην άρθρα 3 και 152 της Συνθήκης για την ίδρυση της Ευρωπαϊκής Κοινότητας -, άρθρο 35 του Χάρτη των Θεμελιωδών Δικαιωμάτων) και της Ευρωπαϊκής Συμβάσεως «διά την προάσπισιν των δικαιωμάτων του ανθρώπου και των θεμελιωδών ελευθεριών» (άρθρο 2 Ε.Σ.Δ.Α). Ούτε προσκρούει η επίμαχη ρύθμιση στα λοιπά διεθνή κείμενα και διατάξεις, που επίσης επικαλείται η αιτούσα (άρθρα 11 και 13 του κυρωθέντος με τον ν. 1426/1984, Α' 32, Ευρωπαϊκού Κοινωνικού Χάρτη, άρθρο 25 παρ. 1 της Οικουμενικής Διακήρυξης των δικαιωμάτων του ανθρώπου του Οργανισμού Ηνωμένων Εθνών του 1948), ανεξαρτήτως της νομικής φύσεως και της δεσμευτικότητας εκάστου, αν δηλαδή πρόκειται για υποχρεωτικούς κανόνες δεκτικούς αμέσου εφαρμογής από τα εθνικά δικαστήρια.
