Negotiated procedure
The European Union Agency for Fundamental Rights (FRA or the Agency) is looking to contract the research and in-depth analysis on the key legal and jurisprudential principles of European law relating to cybercrime and electronic evidence. The objective of this contract is to provide FRA with a Handbook on European law relating to cybercrime and fundamental rights, based on relevant law of the EU and the Council of Europe (CoE), in particular the relevant case law of the Court of Justice of the European Union (CJEU) and European Court of Human Rights (ECtHR).

This handbook will highlight the key fundamental rights challenges linked to cybercrime and electronic evidence. It will address investigating and prosecuting cybercrime and map the positive obligations of States to safeguard the fundamental rights of victims of cybercrime, including victims in vulnerable situations.

The required service consists of the development of a draft handbook in English of approximately 80,000 words, following the style and structure of other FRA/CoE Handbooks:

Technical and professional capacity

The contractor shall propose one or more experts meeting at least the minimum criteria below:

  • Advanced university degree in law (Master or equivalent and above)
  • ­Proven professional experience (after the completion of the Master’s degree) of at least three (3) years in the areas of human rights law of which at least one (1) year in cybercrime or criminal justice;
  • Proven experience in research supported by at least three (3) relevant publications in the fundamental rights areas of criminal law and procedure or information technology law out of which at least one (1) should be in the cybercrime field
  • Excellent knowledge of English (Common European Framework of Reference (CEF) level C1).

No documents proving the fulfilment of these criteria are requested at this stage.

Participation in this negotiated procedure for a low value contract is open to natural and legal persons falling within the scope of the EU Treaties (this includes all economic operators established in the European Union) and to all natural and legal persons established in a third country which has a special agreement with the Union in the field of public procurement on the conditions laid down in that agreement. FRA is not part of the Agreement on Government Procurement (GPA) concluded within the World Trade Organisation. Therefore, the procurement procedure is not open to candidates from GPA countries.
