15 straipsnis - Laisvė pasirinkti profesiją ir teisė dirbti

1. Kiekvienas turi teisę į darbą ir užsiimti laisvai pasirinkta profesija ar veikla.
2. Kiekvienas Sąjungos pilietis turi laisvę ieškoti darbo, dirbti, pasinaudoti įsisteigimo teise ir teikti paslaugas bet kurioje valstybėje narėje.
3. Trečiųjų šalių piliečiai, kuriems leista dirbti valstybių narių teritorijose, turi teisę į tokias pačias darbo sąlygas kaip ir Sąjungos piliečiai.

    15 straipsnio 1 dalyje įtvirtinta laisvė pasirinkti profesiją pripažįstama Teisingumo Teismo teisminėje praktikoje (žr., inter alia, 1974 m. gegužės 14 d. sprendimo Nold, 4/73, Rink. 1974, p. 491, 12–14 punktus; 1979 m. gruodžio 13 d. sprendimą Hauer, 44/79, Rink. 1979, p. 3727; 1968 m. spalio 8 d. sprendimo Keller, 234/85, Rink. 1986, p. 2879, 8 punktą).
    Ši dalis taip pat remiasi Europos socialinės chartijos, kuri buvo pasirašyta 1961 m. spalio 18 d. ir kurią ratifikavo visos valstybės narės, 1 straipsnio 2 dalimi bei 1989 m. gruodžio 9 d. Bendrijos darbuotojų pagrindinių socialinių teisių chartijos 4 punktu. Žodžiai `darbo sąlygos` turi būti suprantami Sutarties dėl Europos Sąjungos veikimo 156 straipsnyje apibrėžta prasme.
    Antroje dalyje aptariamos trys Sutarties dėl Europos Sąjungos veikimo 26 ir 45, 49 ir 56 straipsniuose garantuojamos laisvės, t.y. darbuotojų judėjimo laisvė, įsisteigimo laisvė ir laisvė teikti paslaugas.
    Trečioji dalis grindžiama Sutarties dėl Europos Sąjungos veikimo 153 straipsnio 1 dalies g punktu ir 1961 m. spalio 18 d. pasirašytos ir visų valstybių narių ratifikuotos Europos socialinės chartijos 19 straipsnio 4 dalimi. Todėl yra taikoma Chartijos 52 straipsnio 2 dalis. Trečiųjų šalių pilietybę turinčių jūreivių samdymo dirbti su Sąjungos valstybės narės vėliava plaukiojančių laivų įgulose klausimą reglamentuoja Sąjungos teisė bei nacionalinės teisės aktai ir praktika.

    Preamble - Explanations relating to the Charter of Fundamental Rights:
    Šie išaiškinimai buvo pirmą kartą parengti prižiūrint Europos Sąjungos pagrindinių teisių chartiją rengusio Konvento prezidiumui. Jie buvo atnaujinti Europos konvento prezidiumo atsakomybe, atsižvelgiant į Konvento įvestas Chartijos teksto projekto pataisas (ypač 51 ir 52 straipsnių) ir kitus Sąjungos teisės pakeitimus. Nors išaiškinimai neturi teisinės galios, jie yra svarbi Chartijos nuostatoms išaiškinti skirta aiškinimo priemonė.

    106. Everyone has the right to freely choose their employment and workplace according to their abilities and qualifications. Forced labour is prohibited. Participation in the relief of disasters and their effects, and work pursuant to a court order shall not be deemed forced labour. 116. The rights of persons set out in Articles ninety-six, ninety-seven, ninety-eight, one hundred, one hundred and two, one hundred and three, one hundred and six, and one hundred and eight of the Constitution may be subject to restrictions in circumstances provided for by law in order to protect the rights of other people, the democratic structure of the State, and public safety, welfare and morals. On the basis of the conditions set forth in this Article, restrictions may also be imposed on the expression of religious beliefs.

Uz šajā pantā minēto nosacījumu pamata var ierobežot arī reliģiskās pārliecības paušanu.

Vor Eintritt des Verteidigungsfalles gilt Absatz 5 Satz 1 entsprechend.

    The national government organises vocational training and assists persons who seek employment in finding work.
    Working conditions are overseen by the national government.
    Everyone is free to belong to unions and federations of employees and employers. Unions and federations of employees and employers may assert their rights and lawful interests by means which are not prohibited by law. The conditions and procedure for the exercise of the right to strike are provided by law.
    The procedure for resolution of labour disputes is provided by law.

Töötajate ja tööandjate ühingud ja liidud võivad oma õiguste ja seaduslike huvide eest seista vahenditega, mida seadus ei keela. Streigiõiguse kasutamise tingimused ja korra sätestab seadus. Töövaidluste lahendamise korra sätestab seadus.

    3. As an exception to the aforesaid provisions of this Article a law may provide, if it is in the public interest, that certain enterprises of the nature of an essential public service or relating to the exploitation of sources of energy or other natural resources shall be carried out exclusively by the Republic or a municipal corporation or by a public corporate body created for the purpose by such law and administered under the control of the Republic, and having a capital which may be derived from public and private funds or from either such source only:
    Provided that where such enterprise has been carried out by any person, other than a municipal corporation or a public corporate body, the installations used for such enterprise shall, at the request of such person, be acquired on payment of a just price, by the Republic or such municipal corporation or such public corporate body, as the case may be.
