Negotiated procedure for the low value contract - Drafting of a Handbook on Access to Justice in Europe


Negotiated procedure
In the framework of a Joint Project between the European Commission for the Efficiency of Justice (CEPEJ), European Court of Human Rights and the EU Agency for Fundamental Rights (thereafter "the Agency"), the Agency intends to launch a negotiated procedure for the drafting of a Handbook on Access to Justice in Europe, which should be a practical guide for judges, prosecutors, legal practitioners involved in litigation as well as NGOs and other bodies involved in assisting victims in accessing justice.

The handbook should analyse key principles of access to justice embodied in the relevant EU and Council of Europe instruments and as developed primarily by the Court of Justice of the European Union and the European Court of Human Rights, as well as eventual relevant national case law.

The handbook (of around 100-120 pages) is to be written in English and finalised during the second quarter of 2015. Samples of Handbooks previously published by the Agency can be found at:

Technical and professional capacity

Candidates must be able to propose an expert meeting the following minimum selection criteria:

  • Advanced university degree in law
  • ­Proven professional experience of at least three (3) years in the areas of human rights law and access to justice.
  • Proven experience in research in the field of access to justice supported by at least three (3) relevant publications in the human rights and/or access to justice field
  • Excellent knowledge of English (Common European Framework of Reference (CEF) level C1)

No documents proving the fulfilment of these criteria are requested at this stage.

Participation in this negotiated procedure for a low value contract is open to natural and legal persons falling within the scope of the EU Treaties (this includes all economic operators registered in the European Union and all European Union citizens) and to all natural and legal persons in a third country which has a special agreement with the Union in the field of public procurement on the conditions laid down in that agreement. The FRA is not part of the Agreement on Government Procurement (GPA) concluded within the World Trade Organisation. Therefore, FRA’s procurement procedures are not open to tenderers from GPA countries.

This negotiated procedure is launched with a suspension clause. The award of the low value contract will be subject to the approval of the Agency’s 2015 budget.
