52. cikk - A jogok és elvek hatálya és értelmezése

(1) Az e Chartában elismert jogok és szabadságok gyakorlása csak a törvény által, és e jogok lényeges tartalmának tiszteletben tartásával korlátozható. Az arányosság elvére figyelemmel, korlátozásukra csak akkor és annyiban kerülhet sor, ha és amennyiben az elengedhetetlen és ténylegesen az Unió által elismert általános érdekű célkitűzéseket vagy mások jogainak és szabadságainak védelmét szolgálja. (2) A Charta által elismert, a Szerződések egyes rendelkezéseiben szabályozott jogok csak az ott meghatározott feltételek és korlátozások mellett gyakorolhatók. (3) Amennyiben e Charta olyan jogokat tartalmaz, amelyek megfelelnek az emberi jogok és alapvető szabadságok védelméről szóló európai egyezményben biztosított jogoknak, akkor e jogok tartalmát és terjedelmét azonosnak kell tekinteni azokéval, amelyek az említett egyezményben szerepelnek. Ez a rendelkezés nem akadályozza meg azt, hogy az Unió joga kiterjedtebb védelmet nyújtson. (4) Amennyiben e Charta a tagállamok közös alkotmányos hagyományaiból eredő alapvető jogokat ismer el, akkor ezeket a jogokat e hagyományokkal összhangban kell értelmezni. (5) Az ebben a Chartában foglalt, alapelveket megállapító rendelkezések a saját hatásköreik gyakorlása során az Unió intézményei, szervei és hivatalai által elfogadott jogalkotási és végrehajtási aktusok, illetve a tagállamok által elfogadott, az uniós jog végrehajtására irányuló jogi aktusok útján hajthatók végre. E rendelkezésekre bíróság előtt kizárólag az ilyen jogi aktusok értelmezése, illetve jogszerűségének megítélése tekintetében lehet hivatkozni. (6) A nemzeti jogszabályokat és gyakorlatot az ebben a Chartában meghatározottak szerint teljes mértékben figyelembe kell venni. (7) Az Unió és a tagállamok bíróságainak kellően figyelembe kell venniük e Charta értelmezésére vonatkozó iránymutatásként készült magyarázatokat.

    Az 52. cikk célja, hogy megállapítsa a Chartában foglalt jogok és elvek alkalmazási körét, illetve az azok értelmezésére vonatkozó szabályokat. Az (1) bekezdés a jogok korlátozására vonatkozó szabályokról szól. A szövegezés a Bíróság ítélkezési gyakorlatán alapul, amely kimondja: `… a már megszilárdult ítélkezési gyakorlat szerint az alapjogok gyakorlása korlátozható, különösen a piac közös szervezésének összefüggésében, feltéve, hogy ezen korlátozások megfelelnek a Közösség által kitűzött általános érdekű céloknak, és a kitűzött célra nézve nem jelentenek olyan aránytalan és indokolatlan beavatkozást, amely a jogok lényegi tartalmát veszélyeztetné` (a C-292/97. sz. ügyben 2000. április 13-án hozott ítélet, indokolás: 45. pont). Az Unió által elismert általános érdekekre tett hivatkozás mind az Európai Unióról szóló szerződés 3. cikkében említett célkitűzésekre, mind a Szerződések konkrét rendelkezései, úgy mint az Európai Unióról szóló szerződés 4. cikkének (1) bekezdése, az Európai Unió működéséről szóló szerződés 35. cikkének (3) bekezdése, valamint ez utóbbi szerződés 36. és a 346. cikke által védett más érdekekre is kiterjed.
    A (2) bekezdés olyan jogokra vonatkozik, amelyeket már az Európai Közösséget létrehozó szerződés is kifejezetten biztosított, illetve amelyeket a Charta is elismer, s amelyek mostantól megtalálhatók a Szerződésekben (nevezetesen az uniós polgárságból származó jogok). Világossá teszi, hogy ezek a jogok az alapul szolgáló uniós jog feltételeivel és korlátai között alkalmazhatók, amelyekről a Szerződések rendelkeznek. A Charta nem változtatja meg az EK-Szerződésben biztosított azon jogok rendszerét, amelyeket a Szerződések átvesznek.
    A (3) bekezdés célja a Charta és az EJEE közötti szükséges összhang biztosítása, annak a szabálynak a bevezetése által, hogy ameddig a Chartában foglalt jogok megfelelnek az EJEE által biztosított jogoknak, addig azok tartalma és terjedelme – az engedélyezett korlátozásokat beleértve – azonos az EJEE által meghatározottakkal. Ez különösen azt jelenti, hogy a jogalkotónak ezen jogok korlátozásainak meghatározásakor az EJEE által lefektetett részletes, korlátozásokra vonatkozó szabályokban foglalt előírásoknak megfelelően kell eljárnia, s ezeket az előírásokat így az e bekezdésben foglalt jogokra is alkalmazni kell, anélkül, hogy mindez hátrányosan befolyásolná az uniós jognak és az Európai Unió Bíróságának az autonómiáját.
    Az EJEE-re történő hivatkozás mind az egyezményre magára, mind pedig az ahhoz csatolt kiegészítő jegyzőkönyvekre vonatkozik. A biztosított jogok tartalmát és terjedelmét nem csak ezen dokumentumok szövege határozza meg, hanem az Emberi Jogok Európai Bíróságának, valamint az Európai Unió Bíróságának esetjoga is. A bekezdés utolsó mondatának célja, hogy lehetőséget nyújtson az Uniónak a szélesebb körű védelem biztosítására. A Charta által nyújtott védelem szintje semmilyen esetben sem lehet alacsonyabb az EJEE által biztosított védelem szintjénél.
    A Charta nem akadályozza a tagállamokat abban, hogy alkalmazzák az EJEE 15. cikkét – amely háború vagy más, a nemzet létét fenyegető közveszély esetén lehetővé teszi az EJEE-ben biztosított jogoktól való eltérést –, amikor a tagállamok az Európai Unióról szóló szerződés 4. cikkének (1) bekezdésében és az Európai Unió működéséről szóló szerződés 72., illetve 347. cikkében elismert feladataiknak megfelelően tesznek lépéseket háború esetén a nemzeti védelem területén, illetőleg a rendfenntartás érdekében.
    Az alábbiakban található azon jogok listája, amelyek e bekezdés értelmében a jelen pillanatban megfeleltethetők az EJEE-ben biztosított jogoknak anélkül, hogy az kizárná a jog, a jogszabályok és a Szerződések változásának lehetőségét. A lista az EJEE-ben foglalt jogokon kívül nem tartalmaz más jogot.
    1. A Charta azon cikkei, melyeknek mind tartalma, mind alkalmazási köre megegyezik az EJEE megfelelő cikkeivel, a következők:
    - a 2. cikk megfelel az EJEE 2. cikkének;
    - a 4. cikk megfelel az EJEE 3. cikkének;
    - az 5. cikk (1) és (2) bekezdése megfelel az EJEE 4. cikkének;
    - a 6. cikk megfelel az EJEE 5. cikkének;
    - a 7. cikk megfelel az EJEE 8. cikkének;
    - a 10. cikk (1) bekezdése megfelel az EJEE 9. cikkének;
    - a 11. cikk megfelel az EJEE 10. cikkének, nem érintve azokat a korlátozásokat, amelyeknek az uniós jog alávetheti a tagállamoknak az engedélyezési szabályok bevezetésére vonatkozó, az EJEE 10. cikk (1) bekezdésének harmadik mondatában említett jogát;
    - a 17. cikk megfelel az EJEE kiegészítő jegyzőkönyve 1. cikkének;
    - a 19. cikk (1) bekezdése megfelel az EJEE negyedik kiegészítő jegyzőkönyve 4. cikkének;
    - a 19. cikk (2) bekezdése megfelel az EJEE 3. cikkének, az Emberi Jogok Európai Bíróságának értelmezése szerint;
    - a 48. cikk megfelel az EJEE 6. cikke (2) és (3) bekezdésének;
    - a 49. cikk (1) bekezdése (az utolsó mondat kivételével) és (2) bekezdése megfelel az EJEE 7. cikkének.
    2. Azok a cikkek, amelyek tartalma azonos az EJEE megfelelő cikkeinek tartalmával, de amelyeknek alkalmazási köre szélesebb azokénál, a követezők:
    - a 9 cikk az EJEE 12. cikkével azonos területre vonatkozik, de alkalmazási körét a házasság más formáira is ki lehet terjeszteni, amennyiben azokat a nemzeti jog hozta létre;
    - a 12. cikk (1) bekezdése megfelel az EJEE 11. cikkének, de alkalmazási köre európai uniós szintre is kiterjed;
    - a 14. cikk (1) bekezdése megfelel az EJEE kiegészítő jegyzőkönyve 2. cikkének, de alkalmazási köre a szakképzésre és a továbbképzésre is kiterjed;
    - a 14. cikk (3) bekezdése megfelel az EJEE kiegészítő jegyzőkönyve 2. cikkének a szülők jogainak vonatkozásában;
    - a 47. cikk második és harmadik bekezdése megfelel az EJEE 6. cikke (1) bekezdésének, de a polgári jogi jogokra és kötelezettségekre vagy büntetőjogi vádakra vonatkozó korlátozás az uniós jog és annak alkalmazása tekintetében nem alkalmazható;
    - az 50. cikk megfelel az EJEE hetedik kiegészítő jegyzőkönyve 4. cikkének, de alkalmazási köre kiterjed az Európai Unió szintjére a tagállamok bíróságai között;
    - végül, az Európai Unió polgárai – az állampolgárság alapján történő megkülönböztetés tilalma miatt – nem tekinthetők külföldinek az uniós jog alkalmazási körében. Az EJEE 16. cikkének a külföldiek jogaira vonatkozó korlátozásai tehát ebben az összefüggésben rájuk nem vonatkoznak.
    A (4) bekezdésben található értelmezési szabály az Európai Unióról szóló szerződés 6. cikke (3) bekezdésének szövegén alapul és kellően figyelembe veszi a Bíróság által a közös alkotmányos hagyományok tekintetében alkalmazott megközelítést (pl. a 44/79. sz. Hauer-ügyben 1979. december 13-án hozott ítélet [EBHT 1979., 3727. o.]; a 155/79. sz. AM&S-ügyben 1982. május 18-án hozott ítélet [EBHT 1982., 1575. o.]). E szabály szerint a `legkisebb közös többszörös` elvén alapuló merev szemlélet követése helyett a Chartában foglalt vonatkozó jogokat olyan magas szintű védelmet biztosító módon kell értelmezni, amely megfelel az uniós jognak, és összhangban van a közös alkotmányos hagyományokkal.
    Az (5) bekezdés világosan meghatározza a Chartában megállapított `jogok` és `elvek` közötti különbséget. E különbség értelmében az alanyi jogokat tiszteletben kell tartani, míg az alapelveket be kell tartani (51. cikk, (1) bekezdés). Az alapelveket jogalkotási és végrehajtási aktusokkal lehet végrehajtani (amelyeket az Unió fogad el hatáskörével összhangban, illetve a tagállamok fogadnak el, kizárólag az uniós jog végrehajtása során); ennek megfelelően a bíróságok számára csak akkor bírnak jelentőséggel, amikor ezen aktusok értelmezésére vagy felülvizsgálatára kerül sor. Ezen aktusok ugyanakkor nem alapoznak meg semmilyen, az uniós intézmények vagy a tagállami hatóságok pozitív intézkedésére vonatkozó közvetlen igényt. Ezen aktusok ugyanakkor nem alapoznak meg semmilyen, az uniós intézmények vagy a tagállami hatóságok pozitív intézkedésére vonatkozó közvetlen igényt. Ez összhangban áll mind a Bíróság ítélkezési gyakorlatával (vö. nevezetesen az Európai Unió működéséről szóló szerződés 191. cikke (2) bekezdésében foglalt `elővigyázatosság elvére` vonatkozó ítélkezési gyakorlattal: az Elsőfokú Bíróságnak a T-13/99. sz. Pfizer kontra Tanács ügyben 2002. szeptember 11-én hozott ítéletével, amely számos előző jogesetre tesz utalást; valamint az agrárjog elveit illetően a 33. cikkre [korábbi 39. cikk] vonatkozó ítéletek sorával, pl. a Bíróságnak a 265/85. sz. Van den Berg-ügyben hozott ítéletével [EBHT 1987., 1155. o.]: a piac stabilizálása elvének és a jogos elvárás elvének vizsgálata), mind pedig a tagállamok alkotmányos berendezkedéseinek az `elvekhez` való hozzáállásával, különösen a szociális jog területén. A fentiek érzékeltetésére a Charta által elismert elvekre példaként említhető a 25., 26. és 37. cikk. Egyes esetekben a Charta valamely cikke egy jogra és egy elvre vonatkozó elemet egyaránt tartalmazhat: pl. 23., 33. és 34. cikk.
    A 6. bekezdés a Charta több olyan cikkére utal, amelyek a szubszidiaritás elvének értelmében a nemzeti jogokra és gyakorlatokra hivatkoznak.

Government Decrees concerning provisional exceptions shall without delay be submitted to the Parliament for consideration. The Parliament may decide on the validity of the Decrees.

    (24) Where an institution does not present an adequate recovery plan, competent authorities should be empowered to require that institution to take measures necessary to redress the material deficiencies of the plan. That requirement may affect the freedom to conduct a business as guaranteed by Article 16 of the Charter. The limitation of that fundamental right is however necessary to meet the objectives of financial stability. More specifically, such a limitation is necessary in order to strengthen the business of institutions and avoid institutions growing excessively or taking excessive risks without being able to tackle setbacks and losses and to restore their capital base. The limitation is proportionate because it permits preventative action to the extent that it is necessary to address the deficiencies and therefore complies with Article 52 of the Charter.

    (49) The limitations on the rights of shareholders and creditors should be in accordance with Article 52 of the Charter. The resolution tools should therefore be applied only to those institutions that are failing or likely to fail, and only when it is necessary to pursue the objective of financial stability in the general interest. In particular, resolution tools should be applied where the institution cannot be wound up under normal insolvency proceedings without destabilising the financial system and the measures are necessary in order to ensure the rapid transfer and continuation of systemically important functions and where there is no reasonable prospect for any alternative private solution, including any increase of capital by the existing shareholders or by any third party sufficient to restore the full viability of the institution. In addition, when applying resolutions tools and exercising resolution powers, the principle of proportionality and the particularities of the legal form of an institution should be taken into account.

    (88) In accordance with Article 47 of the Charter, the parties concerned have a right to due process and to an effective remedy against the measures affecting them. Therefore, the decisions taken by the resolution authorities should be subject to a right of appeal.

    Subject matter and scope

    1. This Regulation lays down temporary and strictly limited rules derogating from certain obligations laid down in Directive 2002/58/EC, with the sole objective of enabling providers of certain number-independent interpersonal communications services (‘providers’) to use, without prejudice to Regulation (EU) 2016/679, specific technologies for the processing of personal and other data to the extent strictly necessary to detect online child sexual abuse on their services and report it and to remove online child sexual abuse material from their services.

    2. This Regulation does not apply to the scanning of audio communications.

    Purpose

    This Directive aims to achieve a more balanced representation of women and men among the directors of listed companies by establishing effective measures that aim to accelerate progress towards gender balance, while allowing listed companies sufficient time to make the necessary arrangements for that purpose.

    (6) This Directive is without prejudice to the possibility for each Member State to take the necessary measures to ensure the protection of its essential security interests, to safeguard public policy and public security, and to permit the investigation, detection and prosecution of criminal offences, taking into account that any limitation to the exercise of the rights and freedoms recognised by the Charter, in particular in Articles 7, 8 and 11 thereof, such as limitations regarding the processing of data, are to be provided for by law, respect the essence of those rights and freedoms and be subject to the principle of proportionality, in accordance with Article 52(1) of the Charter.
