Член 52 - Обхват и тълкуване на правата и принципите

  1. Всяко ограничаване на упражняването на правата и свободите, признати от настоящата Харта, трябва да бъде предвидено в закон и да зачита основното съдържание на същите права и свободи. При спазване на принципа на пропорционалност ограничения могат да бъдат налагани, само ако са необходими и ако действително отговарят на признати от Съюза цели от общ интерес или на необходимостта да се защитят правата и свободите на други хора.
  2. Признатите от настоящата Харта права, които са предмет на разпоредби на Договорите, се упражняват при определените в тях условия и граници.
  3. Доколкото настоящата Харта съдържа права, съответстващи на права, гарантирани от Европейската конвенция за защита на правата на човека и основните свободи, техният смисъл и обхват са същите като дадените им в посочената Конвенция. Тази разпоредба не пречи правото на Съюза да предоставя по-широка защита.
  4. Доколкото настоящата Харта признава основни права, които произтичат от общите за държавите-членки конституционните традиции, тези права трябва да бъдат тълкувани в хармония с тези традиции.
  5. Разпоредбите на настоящата Харта, които съдържат принципи, могат да бъдат прилагани чрез законодателни и изпълнителни актове, приети от институциите, органите, службите и агенциите на Съюза, както и чрез актове на държавите-членки, когато те прилагат правото на Съюза при упражняване на съответните им компетенции. Позоваването на тези принципи пред съд е допустимо само за тълкуване и проверка на законността на такива актове.
  6. Националните законодателства и практики трябва да бъдат взети предвид в тяхната цялост, както е посочено в настоящата Харта.
  7. Разясненията, изготвени за да направляват тълкуването на настоящата Харта, се вземат надлежно под внимание от юрисдикциите на Съюза и на държавите-членки.

    Целта на член 52 е да установи обхвата на правата и принципите на Хартата и да определи правила за тяхното тълкуване. Параграф 1 се отнася за режима на ограничаване на правата. Използваният текст се ръководи от практиката на Съда: „...съгласно трайната практика на Съда върху упражняването на основните права могат да се налагат ограничения , по-специално в рамките на една обща организация на пазара, само при условие че тези ограничения наистина отговорят на преследвани от Общността цели от общ интерес и по отношение на преследваната цел не представляват непропорционална и неоснователна намеса, която би накърнила самата същност на тези права.“ (решение от 13 април 2000 г. по дело C-292/97, точка 45). Посочването на признатите от Съюза общи интереси, обхваща както целите, посочени в член 3 от Договора за Европейския съюз, така и други интереси, защитени в специфичните разпоредби на Договорите, като например член 4, параграф 1 от Договора за Европейския съюз, член 35, параграф 3 и членове 36 и 346 от Договора за функционирането на Европейския съюз.
    Параграф 2 се отнася до правата, които вече са изрично гарантирани от Договора за създаване на Европейската общност, признати в Хартата и вече се съдържат в Договорите (по-специално правата, произтичащи от гражданството на Съюза). Така става ясно, че тези права продължават да бъдат подчинени на условия и ограничения, приложими към правото на Съюза, на което те се основават, и които са предвидени в Договорите. Хартата не изменя режима на правата, предоставени от Договора за ЕО и включени в Договорите.
    Параграф 3 има за цел да осигури необходимата последователност между Хартата и ЕКПЧ като установява правилото, че доколкото правата в настоящата Харта съответстват на гарантирани от ЕКПЧ права, смисъла и обхвата на тези права, включително допустимите ограничения, съответстват на предвидените от ЕКПЧ. От това следва в частност, че при определянето на ограничения на тези права законодателят трябва да съблюдава същите норми, както определените в предвидената в ЕКПЧ подробна правна уредба на ограниченията, които следователно стават приложими към правата, обхванати от този параграф, без това да засяга автономността на правото на Съюза и на Съда на Европейския съюз.
    Позоваването на ЕКПЧ обхваща както Конвенцията, така и протоколите към нея. Съдържанието и обхватът на гарантираните права се определят не само от текста на тези правни инструменти, но и от практиката на Европейския съд по правата на човека и от Съда на Европейския съюз. Последното изречение от параграфа има за цел за позволи на Съюза да гарантира една по-широка защита. Във всички случаи предоставеното от Хартата ниво на защита не може никога да бъде по-ниско от гарантираното от ЕКПЧ.
    Хартата не пречи на държавите-членки да се позовават на член 15 от ЕКПЧ, която допуска дерогации от предвидените от нея права в случай на война или други обществени опасности, застрашаващи съществуването на нацията, когато предприемат мерки в сферата на националната отбрана в случай на война, и за поддържане на обществения ред в съответствие с техните отговорности, признати в член 4, параграф 1 от Договора за Европейския съюз и членове 72 и 347 от Договора за функционирането на Европейския съюз.
    Списъкът на правата, които понастоящем могат да се разглеждат като съответстващи на права от ЕКПЧ по смисъла на настоящия параграф, без това да изключва развитието на правото, на законодателството и на Договорите, е представен по-долу: Този списък не включва правата, допълващи тези от ЕКПЧ.

    1. Членове от Хартата, чийто смисъл и обхват са същите, както съответните членове от ЕКПЧ:
      • член 2 съответства на член 2 от ЕКПЧ;
      • член 4 съответства на член 3 от ЕКПЧ;
      • член 5, параграфи 1 и 2, съответства на член 4 от ЕКПЧ;
      • член 6 съответства на член 5 от ЕКПЧ;
      • член 7 съответства на член 8 от ЕКПЧ;
      • член 10, параграф 1 съответства на член 9 от ЕКПЧ;
      • член 11 съответства на член 10 от ЕКПЧ, без да се засягат ограниченията, които правото на Съюза може да наложи върху правото на държавите-членки да установяват разрешителните режими, посочени в член 10, точка 1, трето изречение от ЕКПЧ;
      • член 17 съответства на член 1 от Допълнителния протокол към ЕКПЧ;
      • член 19, параграф 1 съответства на член 4 от Допълнителен протокол № 4;
      • член 19, параграф 2 съответства на член 3 от ЕКПЧ, по начина, по който той се тълкува от Европейския съд по правата на човека;
      • член 48 съответства на член 6, точки 2 и 3 от ЕКПЧ;
      • член 49, параграфи 1 (с изключение на последното изречение) и 2, съответства на член 7 от ЕКПЧ;
    2. Членове, които имат същия смисъл както съответните членове от ЕКПЧ, но чийто обхват е по-широк:
      • член 9 обхваща приложното поле на член 12 от ЕКПЧ, но неговото приложно поле може да бъде разширено към други форми на брак, при положение че националното законодателство ги е учредило;
      • член 12, параграф 1, съответства на член 11 от ЕКПЧ, но неговото приложно поле е разширено до равнището на Европейския съюз;
      • член 14, параграф 1, съответства на член 2 от Допълнителния протокол към ЕКПЧ, но неговото приложно поле е разширено до достъпа до професионално и продължаващо обучение;
      • член 14, параграф 3 съответства на член 2 от Допълнителния протокол към ЕКПЧ по отношение на правата на родителите;
      • член 47, параграфи 2 и 3, съответства на член 6, параграф 1 от ЕКПЧ, но ограничението до спорове по граждански права и задължения или по наказателни обвинения не се прилага по отношение на правото на Съюза и неговото прилагане;
      • член 50 съответства на член 4 от Протокол № 7 към ЕКПЧ, но неговият обхват е разширен до равнището на Европейския съюз между съдилищата на държавите членки;
      • на последно място, в приложното поле на правото на Съюза гражданите на Европейския съюз не могат да бъдат считани за чужденци поради забраната на всяка дискриминация, основана на гражданството. Предвидените в член 16 от ЕКПЧ ограничения по отношение на правата на чужденците следователно не се прилагат за тях в този контекст.

    Правилото за тълкуване, посочено в параграф 4, се основава на текста на член 6, параграф 3 от Договора за Европейския съюз и отчита надлежно следвания от Съда подход по отношение на общите конституционни традиции (напр. Решение от 13 декември 1979 г. по Дело 44/79 Hauer, ССП 1979 г., стр. 3727; Решение от 18 май 1982 г. по Дело 155/79 AM&S, , ССП 1982 г., стр. 1575). Съгласно това правило, вместо да се следва строгия подход на „най-малкия общ знаменател“, е уместно въпросните права от Хартата да се тълкуват по начин, който осигурява високо ниво на защита, съобразен е с правото на Съюза и е в съзвучие с общите конституционни традиции.
    Параграф 5 пояснява направеното в Хартата разграничаване между „права“ и „принципи“. Съгласно това разграничаване субективните права трябва да бъдат зачитани, докато принципите трябва да бъдат спазвани (член 51, параграф 1). Принципите могат да бъдат приложени чрез законодателни или изпълнителни актове (приети от Съюза в рамките на неговите области на компетентност и от държавите-членки единствено при прилагане на правото на Съюза); следователно те придобиват особена важност за съдилищата, единствено когато тези актове се тълкуват или проверяват. Въпреки това те не пораждат непосредствени права за позитивно действие от страна на институциите на Съюза или на органите на държавите-членки, което съответства както на практиката на Съда (вж. по-специално съдебната практика относно „принципа на предпазливост“, посочен в член 191, параграф 2 от Договора за функционирането на Европейския съюз (решение на Първоинстанционния съд от 11 септември 2002 г. по Дело T-13/99 Pfizer с/у Съвета, с многобройни цитати от предходната съдебна практика и поредица от решения по член 33 (предишен член 39) относно принципите на селскостопанското право: например решение на Съда по Дело C-265/85 Van den Berg, ССП 1987, стр. 1155: оценка на принципа за стабилизация на пазара и на оправданите правни очаквания), така и на подхода, следван от конституционните системи на държавите-членки спрямо „принципите“, най-вече в областта на социалното право. За илюстрация могат да се посочат членове 25, 26 и 37, сред признатите в Хартата принципи. В определени случаи, член от Хартата може да съдържа елементи, отнасящи се до дадено право и принцип: например, членове 23, 33 и 34.
    Параграф 6 се позовава на различни членове от Хартата, в които в духа на принципа на субсидиарност се прави позоваване на националните законодателства и практики.

    Дадените по-долу разяснения бяха подготвени първоначално под ръководството на президиума на Конвента, който изработи Хартата на основните права на Европейския съюз. Те бяха актуализирани под ръководството на президиума на Европейския конвент в светлината на внесените от този Конвент изменения в текста на Хартата (по-специално в членове 51 и 52), както и на развитието на правото на Съюза. Въпреки че тези разяснения сами по себе си нямат юридическа сила, те представляват ценно средство за тълкуване, което е предназначено да изясни разпоредбите на Хартата.

    (24) Where an institution does not present an adequate recovery plan, competent authorities should be empowered to require that institution to take measures necessary to redress the material deficiencies of the plan. That requirement may affect the freedom to conduct a business as guaranteed by Article 16 of the Charter. The limitation of that fundamental right is however necessary to meet the objectives of financial stability. More specifically, such a limitation is necessary in order to strengthen the business of institutions and avoid institutions growing excessively or taking excessive risks without being able to tackle setbacks and losses and to restore their capital base. The limitation is proportionate because it permits preventative action to the extent that it is necessary to address the deficiencies and therefore complies with Article 52 of the Charter.

    (49) The limitations on the rights of shareholders and creditors should be in accordance with Article 52 of the Charter. The resolution tools should therefore be applied only to those institutions that are failing or likely to fail, and only when it is necessary to pursue the objective of financial stability in the general interest. In particular, resolution tools should be applied where the institution cannot be wound up under normal insolvency proceedings without destabilising the financial system and the measures are necessary in order to ensure the rapid transfer and continuation of systemically important functions and where there is no reasonable prospect for any alternative private solution, including any increase of capital by the existing shareholders or by any third party sufficient to restore the full viability of the institution. In addition, when applying resolutions tools and exercising resolution powers, the principle of proportionality and the particularities of the legal form of an institution should be taken into account.

    (88) In accordance with Article 47 of the Charter, the parties concerned have a right to due process and to an effective remedy against the measures affecting them. Therefore, the decisions taken by the resolution authorities should be subject to a right of appeal.

    Article 1

    Subject matter and scope

    1. This Regulation lays down temporary and strictly limited rules derogating from certain obligations laid down in Directive 2002/58/EC, with the sole objective of enabling providers of certain number-independent interpersonal communications services (‘providers’) to use, without prejudice to Regulation (EU) 2016/679, specific technologies for the processing of personal and other data to the extent strictly necessary to detect online child sexual abuse on their services and report it and to remove online child sexual abuse material from their services.

    2. This Regulation does not apply to the scanning of audio communications.

    Article 1

    Purpose

    This Directive aims to achieve a more balanced representation of women and men among the directors of listed companies by establishing effective measures that aim to accelerate progress towards gender balance, while allowing listed companies sufficient time to make the necessary arrangements for that purpose.

    (5) This Directive creates a legal framework to ensure freedom to provide electronic communications networks and services, subject only to the conditions laid down in this Directive and to any restrictions in accordance with Article 52(1) of the Treaty on the Functioning of the European Union (TFEU), in particular measures regarding public policy, public security and public health, and consistent with Article 52(1) of the Charter of Fundamental Rights of the European Union (the ‘Charter’).

    (6) This Directive is without prejudice to the possibility for each Member State to take the necessary measures to ensure the protection of its essential security interests, to safeguard public policy and public security, and to permit the investigation, detection and prosecution of criminal offences, taking into account that any limitation to the exercise of the rights and freedoms recognised by the Charter, in particular in Articles 7, 8 and 11 thereof, such as limitations regarding the processing of data, are to be provided for by law, respect the essence of those rights and freedoms and be subject to the principle of proportionality, in accordance with Article 52(1) of the Charter.
