Artikel 31 - Rechtvaardige en billijke arbeidsomstandigheden en -voorwaarden

1. Iedere werknemer heeft recht op gezonde, veilige en waardige arbeidsomstandigheden.
2. Iedere werknemer heeft recht op een beperking van de maximumarbeidsduur en op dagelijkse en wekelijkse rusttijden, alsmede op een jaarlijkse vakantie met behoud van loon.

    1. Lid 1 van dit artikel steunt op Richtlijn 89/391/EEG betreffende de tenuitvoerlegging van maatregelen ter bevordering van de verbetering van de veiligheid en de gezondheid van de werknemers op het werk. Het is ook geïnspireerd op artikel 3 van het Europees Sociaal Handvest en op punt 19 van het Gemeenschapshandvest van de sociale grondrechten van de werknemers, alsmede, wat het recht op waardigheid in het werk betreft, op artikel 26 van het herzien Europees Sociaal Handvest. Het begrip `arbeidsvoorwaarden` moet worden uitgelegd als in artikel 156 van het Verdrag betreffende de werking van de Europese Unie.

    2. Lid 2 is gebaseerd op Richtlijn 93/104/EG betreffende een aantal aspecten van de organisatie van de arbeidstijd en op artikel 2 van het Europees Sociaal Handvest en punt 8 van het Gemeenschapshandvest van de sociale grondrechten van de werknemers.

    Preamble - Explanations relating to the Charter of Fundamental Rights:
    Deze toelichtingen werden oorspronkelijk opgesteld onder de verantwoordelijkheid van het praesidium van de Conventie die het Handvest van de grondrechten van de Europese Unie heeft opgesteld. Zij zijn bijgewerkt onder de verantwoordelijkheid van het praesidium van de Europese Conventie, in het licht van de wijzigingen die door laatstgenoemde Conventie in het Handvest zijn aangebracht (met name in artikel 51 en 52) en van verdere ontwikkelingen in het recht van de Unie. Hoewel zij op zich geen juridische waarde hebben, vormen zij een waardevol hulpmiddel voor de interpretatie, bedoeld om de bepalingen van het Handvest te verduidelijken.
