Artikkel 31 - Head ja õiglased töötingimused

1. Igal töötajal on õigus töötingimustele, mis on tema tervise, ohutuse ja väärikuse kohased.

2. Igal töötajal on õigus maksimaalse tööaja piirangule ning igapäevastele ja -nädalastele puhkeaegadele ja iga-aastasele tasulisele puhkusele.

      1. Käesoleva artikli lõige 1 põhineb direktiivil 89/391/EMÜ töötajate tööohutuse ja töötervishoiu parandamist soodustavate meetmete kehtestamise kohta. Samuti toetub see sotsiaalharta artiklile 3 ja töötajate sotsiaalseid põhiõigusi käsitleva ühenduse harta punktile 19 ning, inimväärikuse kaitse osas, täiendatud ja parandatud sotsiaalharta artiklile 26. Väljendit `töötingimused` mõistetakse Euroopa Liidu toimimise lepingu artikli 156 tähenduses.

      2. Lõige 2 põhineb direktiivil 93/104/EÜ, mis käsitleb tööaja korralduse teatavaid aspekte, Euroopa sotsiaalharta artiklil 2 ning töötajate sotsiaalseid põhiõigusi käsitleva ühenduse harta punktil 8.

      Preamble - Explanations relating to the Charter of Fundamental Rights:
      Käesolevad selgitused valmistati algselt ette Euroopa Liidu põhiõiguste harta koostanud konvendi presiidiumi juhtimisel. Selgitusi ajakohastati Euroopa Konvendi presiidiumi vastutusel, pidades silmas nimetatud konvendi poolt harta tekstis (eelkõige artiklites 51 ja 52) tehtud kohandusi ning liidu õiguse arengut. Kuigi selgitustel endil pole õigusjõudu, on nad harta tõlgendamisel väärtuslikuks vahendiks, mille eesmärk on selgitada harta sätteid.
