Artikkel 5 - Orjapidamise ja sunniviisilise töö keeld

1. Kedagi ei tohi pidada orjuses ega sunduses.

2. Kelleltki ei tohi nõuda sunniviisilist või kohustuslikku töötamist.

3. Inimkaubandus on keelatud.

    1. Artikli 5 lõigetes 1 ja 2 sisalduv õigus vastab Euroopa inimõiguste ja põhivabaduste kaitse konventsiooni artikli 4 lõigetele 1 ja 2, millel on sama sõnastus. Harta artikli 52 lõike 3 kohaselt on nimetatud artiklil sama tähendus ja ulatus kui Euroopa inimõiguste ja põhivabaduste kaitse konventsiooni artiklil. Järelikult:
    - ükski piirang ei tohi lõikes 1 sätestatud õigust mõjutada;
    - lõikes 2 tuleks `sunniviisilist või kohustuslikku töötamist` mõista Euroopa inimõiguste ja põhivabaduste kaitse konventsiooni artikli 4 lõikes 3 sisalduvate `negatiivsete` määratluste valguses:
    `Käesoleva artikli järgi mõiste `sunniviisiline või kohustuslik töötamine` ei hõlma:
    a) töid, mida harilikult vastavalt käesoleva konventsiooni artikli 5 sätetele nõutakse kinnipidamisel või selliselt kinnipidamiselt tingimisi vabastamise korral;
    b) sõjalist laadi teenistust või kohustusliku sõjaväeteenistuse asendusteenistust süümelistel kaalutlustel riikides, kus seda kasutatakse;
    c) teenistust, mida nõutakse elu või ühiskonna heaolu ohustavate eriolukordade või õnnetuste korral;
    d) tööd või teenistust tavalise kodanikukohustuse osana.`
    2. Lõige 3 tuleneb otseselt inimväärikusest ning võtab arvesse hiljutisi arengunähtusi organiseeritud kuritegevuse valdkonnas, näiteks tulutoova ebaseadusliku sisserände või seksuaalse ekspluateerimise korraldamine. Europoli konventsiooni lisa sisaldab järgmist määratlust, mis viitab inimkaubandusele seksuaalse ekspluateerimise eesmärgil: `inimkaubandus: – isiku allutamine teiste isikute tõelisele ja ebaseaduslikule tahtele vägivalla, ähvarduse, pettuse või sõltuvuse ärakasutamise abil, eelkõige järgmistel eesmärkidel: prostitutsioonile kallutamine, alaealiste ärakasutamine, alaealiste vägistamine või hüljatud lastega kauplemine`. Schengeni lepingu rakendamise konventsiooni VI peatükk, mis on integreeritud liidu acquis'sse, milles Ühendkuningriigid ja Iirimaa osalevad, sisaldab artikli 27 lõikes 1 ebaseaduslikule sisserändele viitavat järgmist sõnastust: `Konventsiooniosalised kohustuvad kehtestama asjakohaseid sanktsioone iga isiku suhtes, kes majandusliku kasu nimel aitab või püüab aidata välismaalasel siseneda ühe konventsiooniosalise territooriumile või elada seal, rikkudes selle konventsiooniosalise õigusakte välismaalaste sisenemise ja elamise kohta.` 19. juulil 2002 võttis nõukogu vastu raamotsuse 2002/629/JSK inimkaubanduse vastu võitlemise kohta (EÜT L 203, 1.8.2002, lk 1), mille artikkel 1 määratleb üksikasjalikult kuriteod, mis on seotud inimkaubandusega tööalase või seksuaalse ekspluateerimise eesmärgil ning mille liikmesriik peab nimetatud raamotsuse kohaselt muutma karistatavaks.

    Käesolevad selgitused valmistati algselt ette Euroopa Liidu põhiõiguste harta koostanud konvendi presiidiumi juhtimisel. Selgitusi ajakohastati Euroopa Konvendi presiidiumi vastutusel, pidades silmas nimetatud konvendi poolt harta tekstis (eelkõige artiklites 51 ja 52) tehtud kohandusi ning liidu õiguse arengut. Kuigi selgitustel endil pole õigusjõudu, on nad harta tõlgendamisel väärtuslikuks vahendiks, mille eesmärk on selgitada harta sätteid.

    (1)A person commits an offence if—
    (a)the person holds another person in slavery or servitude and the circumstances are such that the person knows or ought to know that the other person is held in slavery or servitude, or
    (b)the person requires another person to perform forced or compulsory labour and the circumstances are such that the person knows or ought to know that the other person is being required to perform forced or compulsory labour.
    (2)In subsection (1) the references to holding a person in slavery or servitude or requiring a person to perform forced or compulsory labour are to be construed in accordance with Article 4 of the Human Rights Convention.
    (3)In determining whether a person is being held in slavery or servitude or required to perform forced or compulsory labour, regard may be had to all the circumstances.
    (4)For example, regard may be had—
    (a)to any of the person’s personal circumstances (such as the person being a child, the person’s family relationships, and any mental or physical illness) which may make the person more vulnerable than other persons;
    (b)to any work or services provided by the person, including work or services provided in circumstances which constitute exploitation within section 3(3) to (6).
    (5)The consent of a person (whether an adult or a child) to any of the acts alleged to constitute holding the person in slavery or servitude, or requiring the person to perform forced or compulsory labour, does not preclude a determination that the person is being held in slavery or servitude, or required to perform forced or compulsory labour.

    ‘trafficking in human beings’ means the recruitment, transportation, transfer, harbouring or receipt of persons, by means of the threat or use of force or other forms of coercion, of abduction, of fraud, of deception, of the abuse of power or of a position of vulnerability or of the giving or receiving of payments or benefits to achieve the consent of a person having control over another person, for the purpose of exploitation. Exploitation shall include, as a minimum, the exploitation of the prostitution of others or other forms of sexual exploitation, the production, sale or distribution of child-pornography material, forced labour or services, slavery or practices similar to slavery, servitude or the removal of organs;

  • European Convention on Human Rights - Article 4

    Article 4 – Prohibition of slavery and forced labour

    1 No one shall be held in slavery or servitude.

    2 No one shall be required to perform forced or compulsory labour.

    3 For the purpose of this article the term "forced or compulsory labour" shall not include:

    a any work required to be done in the ordinary course of detention imposed according to the provisions of Article 5 of this Convention or during conditional release from such detention;

    b any service of a military character or, in case of conscientious objectors in countries where they are recognised, service exacted instead of compulsory military service;

    c any service exacted in case of an emergency or calamity threatening the life or wellbeing of the community;

    d any work or service which forms part of normal civic obligations.

    Article 8

    1. No one shall be held in slavery; slavery and the slave-trade in all their forms shall be prohibited.

    2. No one shall be held in servitude.

    3.

    (a) No one shall be required to perform forced or compulsory labour;

    (b) Paragraph 3 (a) shall not be held to preclude, in countries where imprisonment with hard labour may be imposed as a punishment for a crime, the performance of hard labour in pursuance of a sentence to such punishment by a competent court;

    (c) For the purpose of this paragraph the term "forced or compulsory labour" shall not include:

    (i) Any work or service, not referred to in subparagraph (b), normally required of a person who is under detention in consequence of a lawful order of a court, or of a person during conditional release from such detention;

    (ii) Any service of a military character and, in countries where conscientious objection is recognized, any national service required by law of conscientious objectors;

    (iii) Any service exacted in cases of emergency or calamity threatening the life or well-being of the community;

    (iv) Any work or service which forms part of normal civil obligations.
