Negotiated procedure for a middle value contract: Provision of medical services by a medical advisor

Negotiated procedure
The European Union Agency for Fundamental Rights (FRA or the Agency) is looking to conclude a framework contract in cascade for the provision of medical services by a Medical Advisor to provide the Agency the following services (the list below is not exhaustive):

  • Based on the results of pre-employment medical screening of candidates to be employed by the Agency, the Medical Advisor will pronounce the aptitude or non-aptitude of the candidate for the proposed job.
  • The Medical Advisor will analyse the results of the staff members’ annual medical examination and consult accordingly the staff member concerned.
  • The Medical Advisor will be involved:
    • where FRA needs advice of the application of the Staff Regulations relating to sickness and associated absence or underperformance,
    • where Staff members who are on sick-leave may be required to undergo a medical examination with the Medical Advisor arranged by FRA,
    • where, for medical reasons, staff members need to be gradually reintegrated into the working routine (i.e. occupational health review).
  • The Medical Advisor might be required to give his/her advice regarding:
    • Staff members’ request to travel outside the place of employment for medical examinations or medical treatment,
    • requests of staff members on sick-leave, who wish to spend this leave in a place other than their place of employment,
    • requests of the Agency to perform an occupational health review,
    • the results of staff members’ Health Screening Examinations (early detection of diseases) in relation to the discovered health problems. 
  • The Medical Advisor of the FRA may be requested to participate in the Invalidity Committee, which is responsible of giving recommendations where staff has serious performance or attendance problems associated with illness.
  • The Medical Advisor should organise periodic information campaigns (e.g. information sessions, emails, etc.)
  • The Medical Advisor will have to maintain the medical records of the FRA staff.
  • The Medical Advisor may be required to go on mission to represent FRA at the Inter-Institutional Medical College of the European Communities.

Selection criteria:

Candidates will be required to provide evidence that they possess the minimum economic and financial capacity and the professional capacity to perform the contract:

1. Evidence of economic and financial capacity

Candidates will be required to provide evidence of a professional risk indemnity insurance for a minimum coverage of 2,000,000 EUR.

2. Evidence of professional capacity

Candidates will be required to propose a  medical professional to carry out the tasks of the Medical Advisor of FRA meeting the following minimum educational and professional qualifications:

  • A degree in Medicine recognised in one of the EU member states or equivalent qualification;
  • S/he must be registered as general practitioner or as medical specialist in occupational health issues with a Medical Association authorising the practice of Medicine in Austria at the set deadline for submitting the offer. 
  • S/he must have at least 3 years of professional experience as general practitioner or as medical specialist in occupational health issues
  • Good knowledge of written/spoken English (minimum level B2 based on the Common European Framework of Reference (CEF))

No documents proving the fulfilment of these criteria are requested at this stage.

Participation in this negotiated procedure for a middle value contract is open to natural and legal persons falling within the scope of the EU Treaties (this includes all economic operators established in the European Union), and to all natural and legal persons established in a third country which has a special agreement with the Union in the field of public procurement on the conditions laid down in that agreement. FRA is not part of the Agreement on Government Procurement (GPA) concluded within the World Trade Organisation. Therefore, the procurement procedure is not open to candidates from GPA countries.
