Mr K. appealed the decision of the lower administrative court, by which his motion to nullify a decision by the Commission, proclaiming his affliations to state security services, was rejected.

Outcome of the case: 

The Court rejected Mr K’s appeal against the decision of the lower court and thus the decision of the commission remained in force. Mr K’s motion for a request for preliminary ruling was also rejected as the affiliations to security services did not fall under the powers of the Union and thus such a preliminary ruling would be outside the competence of the ECJ.
