    Key facts of the case:

    The defendants are facing extradition proceedings following a request by the U.S. Government for their extradition under the US-Cyprus Extradition Treaty. In the course of the trial, the defendants asked for a referral to the CJEU for a preliminary ruling under article 267 of the TFEU on: 

    • Whether article 8(3) of the national law transposing article 3(2) of the Agreement on extradition between the European Union and the United States of America L.181 of 19/07/2003 (hereinafter “the EU-US Agreement”) complies with the aims of the EU-US Agreement. Article 8(3) of the national law provides that the extradition request must be supported by copies of the arrest warrant and of the charges, a statement of facts with a summary of the testimonies of witnesses, revealing the reasons for which it is reasonably believed that the wanted person has committed an offence. Article 8(3) expressly states that there is no need to send the sworn statements or the testimonies themselves;

    • Whether Article 8(3) of the national law is complaint with the right to an effective remedy and the proportionality principle under Charter Articles 47 and 52; 

    • Whether Article 6 of the TEU and Articles 7 and 8 of the Charter apply in relation to the execution by member states of the EU-US Agreement and in relation to the documents required under Article 3(2) of the EU-US Agreement.  

    Key legal question raised by the Court:

    The defendants argued that Article 8(3) of the national law, which restricts the documents required to be issued to a summary report of the testimony, even excluding the obligation to send affidavits or the testimony of witnesses, does not appear in the text of the EU-US Agreement. The CJEU must therefore provide guidance on its compatibility with Union law. 

    Outcome of the case:

    The District Court rejected the request for referral to the CJEU, on the ground that the CJEU is competent to decide on the interpretation of Union law and not on national law. The Court stated that a prerequisite for referring a question to the CJEU is that the Union law provision must be ambiguous and at the same time significant and necessary for the resolution of the case pending before the national court.  It is for the competent court to decide whether a Union law provision is ambiguous and should be the subject of a referral to the CJEU, and to exercise its discretion against the referral to the CJEU. The national court found that it is not empowered to review the findings of the issuing court or to interfere with the exercise of its discretion, provided that it has acted within the limits of its jurisdiction and within the limits of the law. The legislation governing the extradition of fugitives is based on trust and reciprocity, necessary to achieve the wider objective of combating international crime.

    The EU Charter of Fundamental Rights does not in itself create competence. Therefore, in order for a provision of the Charter to be invoked (and therefore for its interpretation to be sought), another provision of EU law must apply in the case in question.

    With regard to the applicants' first question in this case, namely whether the provisions of Article 8(3) of the instrument ratified by Law 8(III)/2008 provided for in Article 3(2) of the Agreement of 25 June 2003 between the European Union and the United States of America on extradition (OJ 2003 L 181, p. 27 ) are consistent and compatible with (a) the object and purpose of the EU-US Agreement and (b) the principles of effective judicial protection and proportionality, as general principles of European Union law and as principles deriving from Articles 47 and 52 respectively of the Charter of Fundamental Rights of the European Union, I consider that this cannot be the subject of an examination by the CJEU, and in that sense no answer will be given before this national court. I reiterate that it is not encouraged that the CJEU should deal with clear-cut issues and I think it is clear from the Community provision itself what is sought.

    Most of the issues commented on by the defendants and included their second question, whether Article 6 of the Treaty on European Union and Articles 7 and 8 of the Charter of Fundamental Rights of the European Union apply in the execution by Member States of the EU-US Agreement and the instruments concluded on the basis of Article 3(2) thereof, with regard to the extradition of wanted persons to the United States are matters of academic and theoretical interest which cannot be referred to the CJEU for a preliminary ruling but which are also not applicable to the present proceedings, the purpose of which is specific and the Court only examines whether specific conditions are fulfilled.

    Ο Χάρτης Θεμελιωδών Δικαιωμάτων της ΕΕ από μόνος του δεν δημιουργεί αρμοδιότητα. Άρα, για να μπορέσει να τύχει επίκλησης διάταξη του Χάρτη (και ως εκ τούτου να ζητηθεί ερμηνεία της), πρέπει να εφαρμόζεται στην οικεία περίπτωση κάποια άλλη διάταξη του δικαίου της ΕΕ.

    Αναφορικά με το πρώτο ερώτημα των αιτητών στην παρούσα, δηλαδή εάν οι διατάξεις του Άρθρου 8(3) του Κυρωθέντος διά του Νόμου 8(ΙΙΙ)/2008 Εγγράφου που προβλέπεται στο άρθρο 3(2) της Συμφωνίας της 25ης Ιουνίου 2003 μεταξύ της Ευρωπαϊκής Ένωσης και των Ηνωμένων Πολιτειών Αμερικής σχετικά με την έκδοση (ΕΕ 2003, L 181, σ.27) συνάδουν και είναι συμβατές με (α) το αντικείμενο και το σκοπό της Συμφωνίας ΕΕ-ΗΠΑ και (β) τις αρχές της αποτελεσματικής δικαστικής προστασίας και της αναλογικότητας, ως γενικές αρχές του Ενωσιακού δικαίου και ως αρχές απορρέουσες από τα Άρθρα 47 και 52 αντίστοιχα του Χάρτη των Θεμελιωδών Δικαιωμάτων της Ευρωπαϊκής Ένωσης, θεωρώ πως αυτό δεν είναι δυνατόν να αποτελέσει αντικείμενο εξέτασης από το ΔΕΕ, και υπό αυτή την έννοια δεν θα δοθεί απάντηση στο παρόν εθνικό δικαστήριο. Επαναλαμβάνω ότι δεν ενθαρρύνεται η ενασχόληση του ΔΕΕ με ξεκαθαρισμένα ζητήματα και θεωρώ είναι σαφές μέσα από την ίδια την κοινοτική διάταξη τί επιζητείται.

    Πλείστα εκ των θεμάτων που σχολιάστηκαν από την πλευρά των εκζητουμένων  και περιλαμβάνουν και το 2ο ερώτημα τους, κατά πόσον το άρθρο 6 της Συνθήκης για την Ευρωπαϊκή Ένωση και τα άρθρα 7 και 8 του Χάρτη των Θεμελιωδών Δικαιωμάτων της Ευρωπαϊκής Ένωσης έχουν εφαρμογή κατά την εκτέλεση από τα Κράτη Μέλη της Συμφωνίας ΕΕ-ΗΠΑ και των εγγράφων που συνάπτονται στην βάση του άρθρου 3(2) αυτής, αναφορικά με την έκδοση εκζητουμένων προσώπων στις ΗΠΑ αποτελούν θέματα ακαδημαϊκού και θεωρητικού ενδιαφέροντος τα οποία δεν μπορούν να τύχουν προδικαστικής παραπομπής στο ΔΕΕ αλλά και δεν μπορούν να τύχουν εφαρμογής στην παρούσα διαδικασία της οποίας ο σκοπός είναι συγκεκριμένος και το Δικαστήριο εξετάζει μόνο κατά πόσο συντρέχουν συγκεκριμένες προϋποθέσεις.
