Key legal question raised in the Legal Opinion:
Whether § 13zs of Regulation of the Council of Ministers of 27 January 2015 on the detailed scope and methods of performing certain tasks of the Agency for Restructuring and Modernisation of Agriculture as well as the resulting refusals to grant assistance to single persons, violate the principle of equality and the prohibition of discrimination (Article 32(1) and (2) of the Constitution, Article 14 of the European Convention on Human Rights and Article 21(1) of the Charter of Fundamental Rights of the EU).
Outcome:
The opinion of the Ombudsman will be taken into account when introducing further legal solutions aimed at providing assistance to agricultural producers affected by adverse weather phenomena - reads the response of the Ministry of Agriculture and Rural Development.

The principle of equality and derogation from it under international law should be understood in the same way, especially since in the light of Article 21 of the Charter of Fundamental Rights of the EU, Member States are obliged to respect the prohibition of any discrimination at every stage of the implementation of programmes and projects financed from EU funds.
