Článek 1 - Lidská důstojnost

Lidská důstojnost je nedotknutelná. Musí být respektována a chráněna.

    Lidská důstojnost není jen základním právem jako takovým, ale představuje samotný základ základních práv. Všeobecná deklarace lidských práv z roku 1948 zakotvila lidskou důstojnost ve své preambuli: „U vědomí toho, že uznání přirozené důstojnosti a rovných a nezcizitelných práv všech členů lidské rodiny je základem svobody, spravedlnosti a míru ve světě“. Soudní dvůr v rozsudku ze dne 9. října 2001 ve věci C-377/98 Nizozemsko v. Evropský parlament a Rada, Sb. rozh. 2001, p. I-7079 v 70. až 77. bodě potvrdil, že základní právo na lidskou důstojnost je součástí práva Unie.
    Z toho vyplývá, že žádné z práv stanovených v této listině nesmí být použito na újmu důstojnosti jiného a že lidská důstojnost je součástí podstaty práv stanovených touto listinou. Musí být proto respektována, a to i tam, kde určité právo omezuje.

    Preamble - Explanations relating to the Charter of Fundamental Rights:
    Tato vysvětlení byla původně vyhotovena pod vedením prezídia Konventu, který vypracoval Listinu základních práv Evropské unie. Byla aktualizována pod vedením prezídia Evropského konventu s ohledem na změny návrhu znění Listiny provedené Konventem (zejména článků 51 a 52) a na vývoj práva Unie. Ačkoliv sama nemají právní závaznost, jsou cenným výkladovým nástrojem pro vyjasnění ustanovení Listiny.
