FRA signposts fundamental rights safeguards in the EU’s Migration and Asylum Pact

The European Migration Forum in Brussels from 28 to 29 November focused on the role of civil society in implementing the EU’s Migration and Asylum Pact. FRA spoke during a panel on the fundamental rights of migrants, together with the EU Asylum Agency.

FRA presented its 2024 guidance on national independent monitoring mechanisms, underlining the importance of fundamental rights monitoring under the Pact. 

The Pact also strengthens the role of guardians for unaccompanied children. FRA’s handbook on guardianship can support guardians carrying out this key role, a challenge in light of insufficient child protection capacities in Member States

FRA also highlighted the stronger safeguards on working conditions under the new asylum instruments. If adequately implemented, the new rules should better protect asylum applicants and international protection beneficiaries from labour exploitation. FRA’s recent manual for labour inspectors could also help in this area. 

FRA pointed out that the EU’s Eurodac Regulation encourages Member States to make use of FRA’s checklist to act in compliance with fundamental rights when obtaining fingerprints. 

FRA underlined the need to work together to make sure that these safeguards work in practice.
