Άρθρο 21 - Απαγόρευση διακρίσεων

1. Απαγορεύεται κάθε διάκριση ιδίως λόγω φύλου, φυλής, χρώματος, εθνοτικής καταγωγής ή κοινωνικής προέλευσης, γενετικών χαρακτηριστικών, γλώσσας, θρησκείας ή πεποιθήσεων, πολιτικών φρονημάτων ή κάθε άλλης γνώμης, ιδιότητας μέλους εθνικής μειονότητας, περιουσίας, γέννησης, αναπηρίας, ηλικίας ή γενετήσιου προσανατολισμού.
2. Εντός του πεδίου εφαρμογής των Συνθηκών και με την επιφύλαξη των ειδικών διατάξεών τους, απαγορεύεται κάθε διάκριση λόγω ιθαγενείας.

      Η παράγραφος 1 πηγάζει από το άρθρο 13 της Συνθήκης ΕΚ, που πλέον έχει αντικατασταθεί από το άρθρο 19 της Συνθήκης για τη λειτουργία της Ευρωπαϊκής Ένωσης, από το άρθρο 14 της ΕΣΑΔ καθώς και από το άρθρο 11 της Σύμβασης για τα ανθρώπινα δικαιώματα και τη βιοϊατρική όσον αφορά τη γενετική κληρονομιά. Εφόσον συμπίπτει με το άρθρο 14 της ΕΣΑΔ, εφαρμόζεται σύμφωνα με το εν λόγω άρθρο.
      Δεν υπάρχει καμία αντίφαση ή ασυμβατότητα μεταξύ της παραγράφου 1 και του άρθρου 19 της Συνθήκης για τη λειτουργία της Ευρωπαϊκής Ένωσης, το οποίο έχει διαφορετικό πεδίο εφαρμογής και αντικείμενο: το άρθρο 19 απονέμει στην Ένωση την αρμοδιότητα να θεσπίζει νομοθετικές πράξεις, μεταξύ άλλων προς εναρμόνιση των νομοθετικών και κανονιστικών διατάξεων των κρατών μελών, για την καταπολέμηση ορισμένων μορφών διακρίσεων που απαριθμούνται εξαντλητικά στο εν λόγω άρθρο. Η συγκεκριμένη νομοθεσία μπορεί να καλύπτει τη δράση των αρχών κράτους μέλους (καθώς και τις σχέσεις μεταξύ ιδιωτών) σε οποιοδήποτε τομέα εντός των ορίων των αρμοδιοτήτων της Ένωσης. Αντίθετα, η διάταξη της παραγράφου 1 του άρθρου 21 δεν παρέχει καμία αρμοδιότητα θέσπισης νόμων κατά των διακρίσεων σε αυτούς τους τομείς δράσης των κρατών μελών ή ιδιωτών, ούτε καθορίζει γενικές απαγορεύσεις διακρίσεων στους εν λόγω τομείς. Αντ’ αυτού, αφορά μόνο περιπτώσεις διακρίσεων από τα θεσμικά και λοιπά όργανα της Ένωσης, κατά την άσκηση των αρμοδιοτήτων τους που τους έχουν ανατεθεί δυνάμει των Συνθηκών, καθώς και από τα κράτη μέλη μόνον όταν εφαρμόζουν το δίκαιο της Ένωσης. Επομένως, η παράγραφος 1 δεν επηρεάζει το εύρος των αρμοδιοτήτων που παρέχονται δυνάμει του άρθρου 19 ούτε την ερμηνεία που δίνεται στο άρθρο αυτό.
      Η παράγραφος 2 αντιστοιχεί στο άρθρο 18, πρώτο εδάφιο της Συνθήκης για τη λειτουργία της Ευρωπαϊκής Ένωσης και πρέπει να εφαρμόζεται σύμφωνα με το εν λόγω άρθρο.

      Οι κάτωθι παρατιθέμενες επεξηγήσεις καταρτίσθηκαν αρχικά υπ’ ευθύνη του Προεδρείου της Συνέλευσης που συνέταξε τον Χάρτη των Θεμελιωδών Δικαιωμάτων της Ευρωπαϊκής Ένωσης. Ενημερώθηκαν με ευθύνη του Προεδρείου της Ευρωπαϊκής Συνέλευσης, κατόπιν των αναπροσαρμογών που επήλθαν στο κείμενο του Χάρτη από τη Συνέλευση αυτή (ιδίως στα άρθρα 51 και 52) και των εξελίξεων του δικαίου της Ένωσης. Αν και οι επεξηγήσεις αυτές καθαυτές δεν έχουν νομική ισχύ, αποτελούν πολύτιμο εργαλείο ερμηνείας για την εξήγηση των διατάξεων του Χάρτη.

(5) Nothing contained in any law shall be held to be inconsistent with or in contravention of sub-article (1) of this article to the extent that it makes provision: (a) with respect to qualifications for service or conditions of service in any disciplined force; or (b) with respect to qualifications (not being qualifications specifically relating to sex) for service as a public officer or for service of a local government authority or a body corporate established for public purposes by any law. (6) Sub-article (2) of this article shall not apply to anything which is expressly or by necessary implication authorised to be done by any such provision of law as is referred to in sub-article (4) or (5) of this article. (7) Nothing contained in or done under the authority of any law shall be held to be inconsistent with or in contravention of this article to the extent that the law in question makes provision (not being provisions specifically relating to sex) whereby persons of any such description as is mentioned in sub-article (3) of this article may be subjected to any restriction on the rights and freedoms guaranteed by articles 38, 40, 41, 42 and 44 of this Constitution, being such a restriction as is authorised by article 38(2), 40(2), 41(2), 42(2) or 44(3). (8) Nothing in sub-article (2) of this article shall affect any discretion relating to the institution, conduct or discontinuance of civil or criminal proceedings in any court that is vested in any person by or under this Constitution or any other law. (9) A requirement, however made, that the Roman Catholic Apostolic Religion shall be taught by a person professing that religion shall not be held to be inconsistent with or in contravention of this article. (10) Until the expiration of a period of two years commencing on the lst July, 1991, nothing contained in any law made before the 1st July, 1991, shall be held to be inconsistent with the provisions of this article, in so far as that law provides for different treatment to different persons attributable wholly or mainly to their respective description by sex.       ‘(7) Equality between women and men is one of the Union's founding values. Unequal treatment between women and men violates fundamental rights. Moreover, the promotion of equality between women and men also contributes to achieving the objectives of the Europe 2020 Strategy. The objective of promoting equality between women and men should be implemented in a mutually reinforcing manner with other Union or Member States activities that have the same objective, in particular with those referred to in the European Pact for gender equality for the period 2011 to 2020.
      (8) Discrimination on the ground of sex includes, in line with the case-law of the Court of Justice of the European Union, discrimination arising from gender reassignment. In the implementation of the Programme, regard should also be had to developments in Union law and in the case-law of the Court of Justice of the European Union with regard to further gender related aspects, including gender identity.
      (9) The right to be treated with dignity in the workplace and society in general is an expression of the founding values of the Union and coordinated action is necessary to permit targeted activities in relation to the employment market. Therefore, actions in the area of gender equality and non-discrimination should include promoting equality between women and men and combating discrimination in the workplace and the employment market.‘
