Artikel 21 - Nichtdiskriminierung

  1. Diskriminierungen insbesondere wegen des Geschlechts, der Rasse, der Hautfarbe, der ethnischen oder sozialen Herkunft, der genetischen Merkmale, der Sprache, der Religion oder der Weltanschauung, der politischen oder sonstigen Anschauung, der Zugehörigkeit zu einer nationalen Minderheit, des Vermögens, der Geburt, einer Behinderung, des Alters oder der sexuellen Ausrichtung sind verboten.
  2. Unbeschadet besonderer Bestimmungen der Verträge ist in ihrem Anwendungsbereich jede Diskriminierung aus Gründen der Staatsangehörigkeit verboten.

    Absatz 1 lehnt sich an Artikel 13 EGV, der nun durch Artikel 19 des Vertrags über die Arbeitsweise der Europäischen Union ersetzt wurde, und Artikel 14 EMRK sowie an Artikel 11 des Übereinkommens über Menschenrechte und Biomedizin in Bezug auf das genetische Erbe an. Soweit er mit Artikel 14 EMRK zusammenfällt, findet er nach diesem Artikel Anwendung.
    Absatz 1 und Artikel 19 des Vertrags über die Arbeitsweise der Europäischen Union, der einen anderen Anwendungsbereich hat und einen anderen Zweck verfolgt, stehen nicht in Widerspruch zueinander und sind nicht unvereinbar miteinander: In Artikel 19 wird der Union die Zuständigkeit übertragen, Gesetzgebungsakte — unter anderem auch betreffend die Harmonisierung der Rechtsvorschriften der Mitgliedstaaten — zur Bekämpfung bestimmter Formen der Diskriminierung, die in diesem Artikel erschöpfend aufgezählt sind, zu erlassen. Diese Rechtsvorschriften können Maßnahmen der Behörden der Mitgliedstaaten (sowie die Beziehungen zwischen Privatpersonen) in jedem Bereich innerhalb der Grenzen der Zuständigkeiten der Union umfassen. In Absatz 1 des Artikels 21 hingegen wird weder eine Zuständigkeit zum Erlass von Antidiskriminierungsgesetzen in diesen Bereichen des Handelns von Mitgliedstaaten oder Privatpersonen geschaffen noch ein umfassendes Diskriminierungsverbot in diesen Bereichen festgelegt. Vielmehr behandelt er die Diskriminierung seitens der Organe und Einrichtungen der Union im Rahmen der Ausübung der ihr nach den Verträgen zugewiesenen Zuständigkeiten und seitens der Mitgliedstaaten im Rahmen der Umsetzung des Unionsrechts. Mit Absatz 1 wird daher weder der Umfang der nach Artikel 19 zugewiesenen Zuständigkeiten noch die Auslegung dieses Artikels geändert.
    Absatz 2 entspricht Artikel 18 Absatz 1 des Vertrags über die Arbeitsweise der Europäischen Union und findet entsprechend Anwendung.

    Die Erläuterungen wurden ursprünglich unter der Verantwortung des Präsidiums des Konvents, der die Charta der Grundrechte der Europäischen Union ausgearbeitet hat, formuliert. Sie wurden unter der Verantwortung des Präsidiums des Europäischen Konvents aufgrund der von diesem Konvent vorgenommenen Anpassungen des Wortlauts der Charta (insbesondere der Artikel 51 und 52) und der Fortentwicklung des Unionsrechts aktualisiert. Diese Erläuterungen haben als solche keinen rechtlichen Status, stellen jedoch eine nützliche Interpretationshilfe dar, die dazu dient, die Bestimmungen der Charta zu verdeutlichen.

(4) Sub-article (1) of this article shall not apply to any law so far as that law makes provision - (a) for the appropriation of public revenues or other public funds; or (b) with respect to persons who are not citizens of Malta; or (c) with respect to adoption, marriage, dissolution of marriage, burial, devolution of property on death or any matters of personal law not hereinbefore specified; or (d) whereby persons of any such description as is mentioned in sub-article (3) of this article may be subjected to any disability or restriction or may be accorded any privilege or advantage which, having regard to its nature and to special circumstances pertaining to those persons or to persons of any other such description and to any other provision of this Constitution, is reasonably justifiable in a democratic society; or (e) for authorising the taking during a period of public emergency of measures that are reasonably justifiable for the purpose of dealing with the situation that exists during that period of public emergency; Provided that paragraph (c) of this sub-article shall not apply to any law which makes any provision that is discriminatory, either of itself or in its effect by affording different treatment to different persons attributable wholly or mainly to their respective description by sex. (5) Nothing contained in any law shall be held to be inconsistent with or in contravention of sub-article (1) of this article to the extent that it makes provision: (a) with respect to qualifications for service or conditions of service in any disciplined force; or (b) with respect to qualifications (not being qualifications specifically relating to sex) for service as a public officer or for service of a local government authority or a body corporate established for public purposes by any law. (6) Sub-article (2) of this article shall not apply to anything which is expressly or by necessary implication authorised to be done by any such provision of law as is referred to in sub-article (4) or (5) of this article. (7) Nothing contained in or done under the authority of any law shall be held to be inconsistent with or in contravention of this article to the extent that the law in question makes provision (not being provisions specifically relating to sex) whereby persons of any such description as is mentioned in sub-article (3) of this article may be subjected to any restriction on the rights and freedoms guaranteed by articles 38, 40, 41, 42 and 44 of this Constitution, being such a restriction as is authorised by article 38(2), 40(2), 41(2), 42(2) or 44(3). (8) Nothing in sub-article (2) of this article shall affect any discretion relating to the institution, conduct or discontinuance of civil or criminal proceedings in any court that is vested in any person by or under this Constitution or any other law. (9) A requirement, however made, that the Roman Catholic Apostolic Religion shall be taught by a person professing that religion shall not be held to be inconsistent with or in contravention of this article. (10) Until the expiration of a period of two years commencing on the lst July, 1991, nothing contained in any law made before the 1st July, 1991, shall be held to be inconsistent with the provisions of this article, in so far as that law provides for different treatment to different persons attributable wholly or mainly to their respective description by sex. (11) Nothing in the provisions of this article shall apply to any law or anything done under the authority of a law, or to any procedure or arrangement, in so far as such law, thing done, procedure or arrangement provides for the taking of special measures aimed at accelerating de facto equality between men and women, and in so far only as such measures, taking into account the social fabric of Malta, are shown to be reasonably justifiable in a democratic society.

    Subject matter

    This Regulation establishes the Citizens, Equality, Rights and Values Programme (the ‘Programme’) for the duration of the multiannual financial framework 2021-2027, as laid down in Regulation (EU, Euratom) 2020/2093.

    It lays down the objectives of the Programme, the budget for the period 2021–2027, the forms of Union funding and the rules for providing such funding.

    Preamble:
    ‘(7) Equality between women and men is one of the Union's founding values. Unequal treatment between women and men violates fundamental rights. Moreover, the promotion of equality between women and men also contributes to achieving the objectives of the Europe 2020 Strategy. The objective of promoting equality between women and men should be implemented in a mutually reinforcing manner with other Union or Member States activities that have the same objective, in particular with those referred to in the European Pact for gender equality for the period 2011 to 2020.
    (8) Discrimination on the ground of sex includes, in line with the case-law of the Court of Justice of the European Union, discrimination arising from gender reassignment. In the implementation of the Programme, regard should also be had to developments in Union law and in the case-law of the Court of Justice of the European Union with regard to further gender related aspects, including gender identity.
    (9) The right to be treated with dignity in the workplace and society in general is an expression of the founding values of the Union and coordinated action is necessary to permit targeted activities in relation to the employment market. Therefore, actions in the area of gender equality and non-discrimination should include promoting equality between women and men and combating discrimination in the workplace and the employment market.‘
