Hasskriminalität ist die gravierendste Form der
Diskriminierung und stellt eine fundamentale
Verletzung der Grundrechte dar. Die Europäische
Union (EU) ist entschlossen, gegen Hasskriminalität
vorzugehen, und hat dies mit Rechtsvorschriften
wie dem Rahmenbeschluss des Rates zur
strafrechtlichen Bekämpfung bestimmter Formen
und Ausdrucksweisen von Rassismus und
Fremdenfeindlichkeit aus dem Jahr 2008 unter
Beweis gestellt. Ungeachtet dessen wird die
Mehrheit der in der EU begangenen Hassdelikte
nicht angezeigt und bleibt daher unsichtbar, sodass
die Opfer keine Wiedergutmachung erfahren.

Ensuring justice for hate crime victims: professional perspectives - Summary
Hate crime is the most severe expression of discrimination and a core fundamental rights abuse. The European Union (EU) has demonstrated its resolve to tackle hate crime with legislation such as the 2008 Framework Decision on combating certain forms and expressions of racism and xenophobia by means of criminal law. Nonetheless, the majority of hate crimes perpetrated in the EU remain unreported and therefore invisible, leaving victims without redress.

Le crime de haine est la manifestation la plus grave
de discrimination et constitue une violation majeure
des droits fondamentaux. L’Union européenne (UE)
a illustré sa détermination à lutter contre les crimes
de haine en prenant des mesures législatives telle
que la décision-cadre de 2008 sur la lutte contre
certaines formes et manifestations de racisme et de
xénophobie au moyen du droit pénal. Toutefois, la
majorité des crimes de haine perpétrés dans l’UE ne
font pas l’objet d’un dépôt de plainte et demeurent
par conséquent invisibles, laissant souvent les
victimes sans possibilité de former un recours.

The Council of the EU requested this FRA Opinion in its Conclusions on business and human rights. The expert opinion sought from FRA was to look at “possible avenues to lower barriers for access to remedy at the EU level” – the third of three pillars of the UN Guiding Principles.
